The following local Indian Health Service, Navajo Area terms also apply:

NAIHS-ACQ-09 UNAUTHORIZED COMMITMENTS NOV 2025

(a) Definitions.

Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.

Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.

Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.

(b) Policy.

The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority. Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a Federal official other than the contracting officer (see FAR 1.403-2). Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.

(c) Procedure.

Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.

The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid. The Contractor proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

Statement of Work

NORTHERN NAVAJO MEDICAL CENTER

Project: SimBaby (246-00150) Laerdal Medical Corporation

BACKGROUND

The Shiprock Service Unit’s Education Department (Northern Navajo Medical Center) is a Training Center (TC) for Navajo Area Indian Health Services (NAIHS) located in a remote area of New Mexico. The Shiprock Service Unit is comprised of Northern Navajo Medical Center, located in Shiprock, NM; Dzilth-Na-O-Dith-Hle Health Center (DZHC), located in Bloomfield, NM; and Four Corners Regional Health Center (FCRHC), located in Red Mesa, AZ.

The TC certifies an interdisciplinary team of clinicians and nurses in Pediatric Advanced Life Support (PALS) as required by credentialing and policy. Six to eight recertification PALS courses are delivered annually.

PALS courses require a simulator capable of simulating dysrhythmias, respiratory sounds, IV/IO access, and airway adjuncts/intubation associated with pediatrics in a high-fidelity simulation. The prior SimBaby exceeded its life cycle (a 2007 product) and is unrepairable, as the parts are no longer available. It was pulled from training related to a compressor malfunction, and for safety reasons, in October 2023. Updates to PALS require a fully functioning simulator for recertification in the 2025 guidelines. This simulator must be able to record chest compression fraction (CCF) and joules delivered.

OBJECTIVES

Shiprock Service Unit’s Education Department is seeking to replace the 2007 simulator with a fully functioning baby simulator to effectively deliver the six proposed courses and update the 65-95 providers within the service unit annually. In addition, the simulator will be used for mock codes to practice high-risk, low-volume life-saving events in a safe environment, trauma training in Mass Casualty Events (MCEs) drills, and procedural in-services.

PERIOD OF PERFORMANCE

No service contract is needed. Once purchased, the training equipment and associated software will be used by the Education Department. Consumables will be purchased as needed.

SCOPE

The Shiprock Service Unit is requesting the purchase of a baby simulator for training. This simulator must be compliant with the training requirements (specifically able to calculate CCF; defibrillation and cardioversion load requirements to apply therapy during cardiac arrest and tachycardia treatment; and intubation capable) of the service unit and the requirements for the training program. The simulator should be compatible with current equipment for high-fidelity simulation. Participants learn and retain knowledge when using existing equipment during resuscitation events. Overall, improves patient outcomes and survivorship from cardiac arrest. Some simulators on the market do not meet or cannot be modified to meet the service unit’s training needs. This particular simulator is compatible with the Zoll® ALS defibrillator, used Area-Wide for resuscitation. Enabling the mobility of the Education Department to offer classes throughout the NAIHS.

Rev. 09/30/2025

JUSTIFICATION TO RESTRICT COMPETITION (below SAT) Pursuant to Revolutionary FAR Overhaul (RFO) 12.102, for acquisitions valued at or below the simplified acquisition threshold (SAT) using RFO 12.201-1 Simplified Procedures for commercial products and services, the Contracting Officer (CO) hereby documents the decision that only one source is reasonably available.

1. Agency and Contracting Activity.

U.S. Department of Health and Human Services Indian Health Service Navajo Area Indian Health Service Shiprock Service Unit, Northern Navajo Medical Center Division of Acquisition Management & Contracts

2. Name and Address of Only Source.

Laerdal Medical Corporation 167 Myers Corners Rd Wappingers Falls, NY 12590-3869 United States

UEI CLZKN2N6KX41

3. Description of Supplies/Services and Estimated Cost.

***THIS ONLY JUSTIFIES THE BRAND NAME DESCRIBED AS FOLLOWS***

The Northern Navajo Medical Center Education Department requires a SimBaby Infant Simulator for Pediatric Advanced Life Support (PALS) Training.

4. Description of Circumstances, including why only one source is reasonably available.

IAW RFO 11.204(a)(1), specific characteristics of the SimBaby Infant Simulator that limit the availability to only one source are its capability to record and report measurable metrics needed to meet specific Joint Commission requirements. Only this suggested source can furnish the requirements, to the exclusion of other sources, because Laerdal Medical Corporation training simulators are equipped with software that can calculate chest compression fraction (CCF), time to first shock, time to first epinephrine dose, and time to successful intubation; all components of training and JC requirements for quality measurement in in-hospital and out-of-hospital cardiac arrest events. These measurable metrics are reported to the Code Committee and Quality Division to improve patient outcomes. In addition, the interchangeability of the Laerdal training equipment already in the inventory provides benefits for the program office. If another vendor were chosen, the entire training equipment may need to be repurchased, creating undue costs.
