About this file
This is a Solicitation/Contract/Order for Commercial Items (Standard Form 1449) issued by the Gallup Indian Medical Center (GIMC), a facility within the Navajo Area Indian Health Service under the U.S. Department of Health and Human Services.
Procurement Details and Requirements: The solicitation seeks procurement of one (1) ASME Domestic Water Storage Tank, specifically a Wendland Manufacturing Model 969 Gallon Horizontal Domestic Water Tank (Style 48-9) with specifications including 125 PSI design rating, 48" OD x 11 ft. 2" OAH, .250" SA-516-70 plate shell and heads, SSPC-6 shop primer exterior, and SSPC-10 epoxy-lined interior suitable for potable water use. The tank is required to support the potable water system at GIMC, which currently relies on two aging 850-gallon hot-water storage tanks serving Building 2000. The procurement is classified as high priority due to active rust deterioration of the existing tank and critical impact on facility operations and patient care. The contractor shall provide manufacturer's data sheets, ASME certification, National Board registration documentation, coating specifications, and warranty documentation. Delivery is required 30 days after award to GIMC, 516 East Nizhoni Boulevard, Gallup, New Mexico 87301, with freight charges included. The estimated weight is approximately 1,850 lbs., and installation is not included unless specified by the Contracting Officer.
Contract Terms and Set-Asides: This is a total small business (SB) set-aside for unrestricted competition (100% for small business). The solicitation number is 75H71026Q00170, with an offer due date of June 10, 2026, at 1700 MT. The NAICS code is 332420 with a size standard of 750 employees. Evaluation criteria include technical capability to meet specifications, delivery time, and price. All invoices must be submitted electronically through the Department of Treasury Invoice Processing Platform (IPP) at www.ipp.gov. The contract incorporates FAR clauses 52.212-1, 52.212-4, and 52.212-5, along with numerous federal and HHS-specific requirements including clauses addressing small business program rerepresentation, contractor employee whistleblower rights, convict labor, child labor, equal opportunity, combating trafficking in persons, Buy American requirements, and sustainability. Contracting Officer is Jerlyn R. Begay, and inquiries should be directed to Stephen Silversmith, Contract Specialist, at Stephen.Silversmith@ihs.gov.

The following local Indian Health Service, Navajo Area terms also apply:
NAIHS-ACQ-09 UNAUTHORIZED COMMITMENTS NOV 2025
(a) Definitions.
Contracting Officer means a person with the authority to enter into, administer, and/or terminate contracts and make related determination and findings.
Ratification means the act of approving an unauthorized commitment by an official who has the authority to do so.
Unauthorized Commitment (UAC) means an agreement that is not binding solely because the Government representative who made it lacked the authority to enter into that agreement on behalf of the Government.
(b) Policy.
The Government is not bound by agreements with, or contractual commitments made to, prospective contractors by individuals who do not have delegated contracting authority. Unauthorized commitments do not follow the appropriate process for the expenditure of Government funds. Consequently, the Government may not be able to ratify certain actions, putting a contractor at risk for taking direction from a Federal official other than the contracting officer (see FAR 1.403-2). Government employees responsible for unauthorized commitments are subject to disciplinary action. Contractors perform at their own risk when accepting direction from unauthorized officials. Failure to follow statutory and regulatory processes for the expenditure of Government funds is a very serious matter.
(c) Procedure.
Any agreement, modification, or change to a contractual agreement made by a government personnel who lack authority will be deemed an unauthorized commitment. The Government is not liable to the Contractor or under the terms of the contract, financially or otherwise – unless the unauthorized commitment successfully passes the ratification process.
The ratification process does not have any lead time, nor does the Government make any promise that an unauthorized commitment will be ratified and, therefore, the Contractor would be paid. The Contractor proceeds at its own risk if any of the terms of the contract are altered, changed, or modified without the written concurrence by a Contracting Officer.

SECTION D – DOCUMENTS, EXHIBITS, ATTACHMENTS, ETC.
Attachment A – Statement of Work
Attachment B – Fully-Approved Brand Name Justification
Statement of Work (SOW)
Project Title:
Procurement of One (1) ASME Domestic Water Storage Tank Gallup Indian Medical Center (GIMC).
Introduction:
The Navajo Area Indian Health Service (NAIHS) is responsible for the delivery of health services to American Indians in portions of the States of AZ, NM, and Utah (a region known as the 4 Corners area of the US.) The Agency's mission is primarily responsible for healthcare to members of the Navajo Nation and Southern Band of San Juan Paiutes, but care to other Native Americans (Zuni, Hopi) is provided. The Navajo Nation is the largest Indian tribe in the United States and has the largest reservation, which encompasses more than 25,000 square miles in Northeast Arizona, Northwest New Mexico, Southern Utah, and Colorado, with three satellite locations in central New Mexico.
General:
The Gallup Indian Medical Center (GIMC) is part of the Navajo Area Indian Health Services, located in Gallup, New Mexico. It has one of the largest workloads within the Indian Health Service, featuring 380,000 outpatient encounters and 3,300 inpatient admissions annually. GIMC boasts the largest staff among all facilities in the Navajo Area IHS and serves as a referral center for more complex cases from other IHS facilities.
GIMC currently uses two 850-gallon hot-water storage tanks to provide domestic hot water for Building 2000.
The purpose of this Statement of Work (SOW) is to procure one (1) ASME-coded domestic water storage tank to support the potable water system at the Gallup Indian Medical Center. This tank will help maintain adequate domestic water storage capacity to support hospital operations and ensure compliance with relevant safety and operational standards.
