About this file

This is a self-certification form for Indian Economic Enterprise (IEE) representation required by the Indian Health Service (IHS) under the Buy Indian Act authority.

The form is used in response to Sources Sought Notices, Requests for Information (RFI), or Solicitations to establish that an offeror meets the definition of an "Indian Economic Enterprise" as defined in HHSAR 326.601. Offerors must maintain this eligibility status at three critical points: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any changes in eligibility status during these periods require immediate written notification to the Contracting Officer. The form requires the offeror to self-certify whether it meets the definition of an Indian Economic Enterprise with Indian Ownership, and successful offerors must also be registered with the System of Award Management (SAM). Contracting Officers may require supporting documentation of eligibility before awarding set-aside or sole source contracts, and awards may be subject to protest if the offeror's eligibility is questioned. The form requires completion of fields including the solicitation number, project title, date, name of the federally recognized tribal entity, business name, DUNS number, name of the 51% owner, certifying signature, and printed name. False or misleading information submitted in connection with Buy Indian Act awards constitutes a violation of law with penalties under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
