Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form

This is a self-certification form used by the Indian Health Service (IHS), Office of Management Services, Division of Acquisition Policy, to verify that offerors meet the definition of an "Indian Economic Enterprise" (IEE) under the Buy Indian Act (25 U.S.C. 47) in response to sources sought notices, requests for information (RFI), or solicitations. The form applies to contract opportunities set-aside or sole-sourced under Buy Indian Act authority.

An enterprise must maintain IEE eligibility status at three critical junctures: at the time an offer is submitted, at the time of contract award, and throughout the entire contract performance period. Any changes in eligibility status require immediate written notification to the Contracting Officer. Offerors must self-certify their IEE status by indicating whether they do or do not meet the definition and must provide the name of the federally recognized tribal entity, the 51% owner name, business name, certifying signature, printed name, and UEI SAM registration number. The form warns that false or misleading information constitutes a violation under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Individual Contracting Officers may require documentation to support eligibility claims, and contract awards may be subject to protest if the successful offeror's eligibility is questioned.
