BASIS FOR AWARD
FAR 52.212-2, Evaluation – Commercial Products and Commercial Services Under HHS-adopted FAR 12.203, the Government will use a best-value comparative evaluation of timely quotations. The Government will consider technical capability and management approach, past performance, and price. The two non-price factors combined are significantly more important than price. As non-price benefits become more similar, price becomes more important. Selection may be made at a higher price when the documented benefits warrant the additional cost.
The Government intends to make a selection from initial quotations. It may request clarification, additional information, or revised quotations when useful. This is a simplified acquisition evaluation; establishing a Part 15 competitive range or conducting formal Part 15 discussions is not required. The solicitation basis governs all comparisons.
Submit the best technical and price quotation initially. A quotation must demonstrate the capability, compliance, and credible delivery approach needed to successfully perform the required services.
Evaluation Factors
The Government will evaluate quotations using the following factors:
• Technical Capability and Management Approach
• Past Performance
• Price Technical Capability and Management Approach, together with Past Performance, are the non-price factors.
When combined, they are significantly more important than Price.
Non-Price Factor Rating Definitions
The Government will evaluate the non-price factors using the adjectival rating definitions below. For Past Performance, a quoter without available recent and relevant past performance will receive a Neutral assessment, as described under Factor 2, rather than a favorable or unfavorable rating solely because of the absence of history.
Adjectival Rating Description Outstanding Greatly exceeds all minimum requirements of the criteria; has a high probability of success; contains no weaknesses or deficiencies.
Good Exceeds all minimum requirements of the criteria; has an above-average probability of success; contains no significant weaknesses and only minor correctable weaknesses exist.
Acceptable Meets all minimum requirements of the criteria; has an average probability of success; and no significant weaknesses and no deficiencies.
Marginal Fails to meet one or more of the minimum requirements of the criteria; has a low probability of success;
major weaknesses and/or a significant number of deficiencies exist.
Unacceptable Fails to meet the minimum requirements of the criteria; the quotation needs major revisions; has a very low probability of success.
Evaluation Framework
Factor Evaluation Focus 1 – Technical Capability and Management Approach
Qualified APP personnel; mobilization and credentialing readiness; staffing and coverage continuity;
recruitment, retention, quality control, replacement arrangements, and Contractor supervision.
Combined Synopsis 5
Factor Evaluation Focus
2 – Past Performance Relevance and quality of recent performance for similar clinical services, including continuity, responsiveness, staffing scale, and customer information.
3 – Price Total price for the three-month base and all three three-month options; fairness and reasonableness;
relationship to the non-price benefits offered.
Factor 1 – Technical Capability and Management Approach
Evaluate the quotation’s demonstrated ability to supply two qualified APPs and perform the current outpatient PWS. Consider the quality and credibility of the staffing and mobilization approach, candidate availability, qualification information, credentialing readiness, coverage continuity, recruitment and retention resources, quality control, replacement arrangements, and Contractor supervision. Consider the extent to which the approach reduces the risk of delayed or interrupted patient care.
Minimum PWS qualifications remain mandatory. A favorable comparison does not waive required credentials or privileges. The Government will assess the supporting information and the overall likelihood of successful performance; a representation that requirements will be met without a credible delivery approach may be insufficient.
The comparative evaluation will consider the credibility and supporting detail of the proposed staffing, availability, and performance information. Unsupported assertions may receive less favorable consideration than a substantiated delivery approach.
Factor 2 – Past Performance
The Government will evaluate recent, relevant performance for APP services, outpatient care, healthcare staffing, or comparable non-personal clinical services. Recent performance means work performed within the three years preceding the quotation closing date.
Evaluate the relevance and quality of recent performance for similar clinical services. Consider service scope, staffing scale, continuity, responsiveness, and customer information. Sources may include submitted references, CPARS, Government records, commercial customers, and other reasonably available information. A quoter without available recent relevant performance will receive a neutral assessment, rather than a favorable or unfavorable inference solely from the absence of history.
Factor 3 – Price
Evaluate the total price for the three-month base and all three three-month options, as calculated in Section F.
Assess price reasonableness using competition and other appropriate price-analysis information. Consider price in relation to the non-price benefits when determining best value. This RFQ does not establish a separate price-realism scoring factor.
The Government may use comparison of quotations, the Government estimate, historical pricing, market research, and other appropriate price-analysis information to assess fairness and reasonableness.
Eligibility, Responsibility, and Resulting Purchase Order
The selected quoter must satisfy ISBEE eligibility and applicable responsibility and exclusion requirements. A favorable sources sought review is not a solicitation evaluation or award decision. A quotation is not a binding offer. The Government’s purchase order is its offer; a binding contract results upon supplier acceptance under FAR 12.201-1(b). The Government intends to request written acceptance of the resulting purchase order.
Evaluation of options does not obligate the Government to exercise them. Each exercise will require the Contracting Officer’s determination and timely notice under the purchase order and applicable option provisions.
J. CONTRACT TERMS AND CONDITIONS
FAR 52.212-4, Terms and Conditions – Commercial Products and Commercial Services, and applicable FAR and HHSAR terms and conditions apply in the versions prescribed for HHS. The separate Provisions and Clauses attachment contains the applicable text, editions, and completed fill-ins.
The Contractor shall comply with applicable Federal, HHS, IHS, Rosebud IHS Hospital, medical staff, credentialing and privileging, privacy, security, patient-safety, and professional-practice requirements identified in the solicitation, PWS, and resulting purchase order.
Combined Synopsis 6

1. BACKGROUND AND PURPOSE
The Indian Health Service (IHS) is responsible for providing federal health services to American Indians and Alaska Natives (AI/AN). The Rosebud IHS Hospital is a 35-bed comprehensive medical and surgical facility located on the Rosebud Sioux Indian Reservation in Rosebud, South Dakota. The hospital serves as the primary healthcare provider for members of the Rosebud Sioux Tribe (Sicangu Oyate) and surrounding communities — a predominantly rural and medically underserved population.
Health disparities among AI/AN populations are well-documented and include elevated rates of chronic disease, behavioral health needs, and limited access to consistent primary care. Sustained access to qualified Advanced Practice Provider (APP) services is essential to improving population health outcomes, supporting chronic disease management, and providing culturally responsive primary care on the Rosebud Reservation. This Performance Work Statement (PWS) establishes the requirements for two (2) full-time Advanced Practice Provider (APP) contractor positions either Physician Assistants (PAs) or Nurse Practitioners (NPs) to provide outpatient primary care services in the Rosebud IHS Hospital Outpatient Department (OPD) Clinic.

3. SCOPE OF WORK
The Contractor shall provide professional Advanced Practice Provider (APP) services consistent with the published competencies and standards of practice of the National Commission on Certification of Physician Assistants (NCCPA) and the American Academy of Physician Associates (AAPA) for Physician Assistants, and the American Association of Nurse Practitioners (AANP) and American Nurses Credentialing Center (ANCC) for Nurse Practitioners; IHS clinical policies; applicable federal and state laws governing practice at IHS facilities and the licensure requirements in Section 5.3; and Rosebud IHS Hospital medical staff bylaws and credentialing standards. This is a non-personal services contract. The Contractor is an independent contractor responsible for managing its own personnel and shall not be subject to the supervision or control of Government employees in the day-to-day performance of work. The Government retains the right to evaluate the quality, timeliness, and completeness of services delivered against the performance standards set forth in this PWS.
