Questions and Answers 75H70626Q00013

Abatement and Demolition of two quarters buildings in Rosebud, South Dakota Solicitation closes November 28, 2025

1. Can we get copies of the Legend survey reports for both properties?

Reports attached to this document.

2. Is it possible to schedule a site visit?

No site visits will be scheduled.

3. Is it possible to speak over the phone?

All questions regarding the solicitation must have been submitted in writing by November 14, 2025.

4. Can you supply the asbestos and lead paint testing reports for this project?

Based on the Phase.I.Environmental.Site.Assessment.and.Hazardous.Materials.Report prepared by Legend Technical Services, Inc. (February 24, 2023 (Appendix B)), asbestos and lead-based paint were identified in both Building 0035 and Building 0036. Building 0035 contains asbestos in sheet vinyl flooring, white tape on the basement corner wall, and kitchen sink bowls. Building 0036 contains asbestos in sheet vinyl flooring. Lead-based paint was detected extensively in both units—specifically in the wall and ceiling plasters and wood siding (including the original siding beneath newer exterior siding).

These materials remain present within the structures as of the assessment date. All of these items will have to be abated lawfully before demolition.

5. Could you please confirm whether ANC [Alaska Native Corporation] subsidiaries such as [redacted] qualify as ISBEEs for this solicitation, or whether only entities majority-owned and controlled by federally recognized tribes or individual Indians are eligible?

Following publication of the rules codified at HHSAR, 48 CFR part 326, subpart 326.6., Congress amended the Buy Indian Act through Public Law 116-261 (December 30, 2020) to incorporate the definition of “Indian economic enterprise” (IEE) set forth in 48 CFR

1480.201 (or successor regulations). To maintain consistency with the statute, IHS is utilizing the definition of an Indian economic enterprise in 48 CFR 1480.201. IHS will also utilize the definitions of “Indian” and “Indian Tribe” from 48 CFR 1480.201 in the final rule, since these terms are included in the definition of IEE. As defined in 48 CFR 1480.201, the term “Indian Tribe” encompasses a Tribe, band, nation or other recognized group or community that is recognized as eligible for the special programs and services by the United States to Indians because of their status as Indians. This definition also includes Alaska Native village or regional or village corporation under the Alaska Native Claims Settlement Act (ANCSA).

The Buy Indian Act (25 U.S.C. § 47) itself does not mention "wholly owned subsidiary" in the context of eligibility. The act gives preference to Indian Economic Enterprises (IEE), defined as a business that is at least 51% Indian-owned and controlled. Whether a subsidiary is eligible depends on whether it meets this 51% ownership threshold and is otherwise considered an IEE, regardless of its structure as a subsidiary.

A subsidiary can be an eligible Indian Economic Enterprise if it is at least 51% Indian-owned and controlled. The key is the ownership and control, not the corporate structure as a subsidiary.

The act does not require a company to be a "wholly owned" subsidiary to qualify. It focuses on the 51% ownership and control requirement.

BUILDING 00035

HAZARDOUS MATERIALS SURVEY

LEGEND NO. 22-4702

Building 00035 was surveyed for hazardous/regulated materials and the following determined:

• Asbestos-containing materials are limited to uninstalled sink drain bowl coating on both bowls

• Sheet vinyl flooring in the bathroom and back stair landing

• A strip of white tape in the corner in the basement in the fuel oil tank area

Lead-based paint is present on most of the plaster finishes in the building. Some of the closets do not have lead-based paint. The woodwork does not have a lead-based coating nor do the painted doors. It is suspected that the painted woodwork and doors were originally varnished and the paint was applied at a later date. The exterior of the building has wood siding under the metal siding. This has lead-based paint on it based on the XRF readings. The plaster is on a fiber mat system from observation and not wood lath.

It is recommended that the plaster and paint be removed and the fiber mat. Removal of the paint only from the plaster is more difficult and will not be as complete as removing the entire wall system and ceiling system. The bathroom appears to have already had this done as it is finished with non-lead based painted GWB. In order to remove the lead-based painted wood siding, the metal siding will need to be removed. The siding is acting as a barrier to dispersal of the remaining lead-based paint and it is not a significant exposure risk at this time. The paint on the wood siding is suspected to be in poor condition and will flake when the metal siding is removed.

The building has two fuel oil tanks on the basement level that need to be removed. It looks like these can be removed by transport up the steps and out the back door if some disassembly is done. The small fuel spill on the floor needs to be cleaned up. This can be done by first removing the particulate matter and then cleaning with a soap that is designed for cleaning up petroleum spills.

The vandalism appears to be limited to items that can go into a regular landfill. There may be some materials buried that may require special handling. Much of the paint was splashed on plaster with lead-based paint so lead paint remediation will remove much of the wall damage. The flooring could be sanded and re-finished.

NARRATIVE REPORT

1.0 INTRODUCTION

Legend Technical Services, Inc. (LEGEND) representative Cheryl A Sykora,CIH,CSP,CHMM South Dakota Certified Asbestos Inspector and EPA Tribal Certified Lead Risk Assessor visited the Rosebud Agency Indian Health Service buildings including Residence 00035 and performed both asbestos and lead-based paint surveys of the buildings. The survey work was performed on October 19, 2022.

2.0 BACKGROUND INFORMATION

Rosebud Quarters Building 00035 is part of Installation 11547. Its approximate age is 1936. The size of the building is 2,131 square feet. This building has metal siding over the original wood siding on the exterior. The interior was in the process of being renovated with new paint, etc.

when the work was stopped, and vandals got into the building and threw the cans of paint around.

The building is a single story above grade with a poured concrete basement. The basement is not finished. The interior of the ground level has varnished woodwork and wall and ceiling plaster finish. The living room has a fireplace with a chimney extending from the basement level up through the roof line. The fireplace appears to have burned logs. The basement level has a forced air furnace that is suspected to being fueled by LP gas based on the presence of the LP tank in the yard. The presence of fuel oil tanks in the basement suggests once there was a fuel oil furnace in the basement or the current furnace was converted from fuel oil to lp. The tanks were empty but may contain some fuel oil residue. There was a fuel oil stain on the concrete below the fuel oil tanks. The chimney clean out could not be opened in this building.

The flooring is hardwood with areas of sheet vinyl in the bathroom and back stair area. The kitchen sink is not installed and is in the living room. It has a bowl coating. There is a room of sheet vinyl flooring in the basement otherwise basement finishes are minimal.

The pipes are either bare or have fiberglass insulation. It appears that the fittings may have been removed in the past as the elbows and joint areas are not insulated.

The rear of the building (northwest side) foundation is higher above the ground than the front or sides. Original window openings in the rear have been filled in with concrete block creating smaller window openings. This can be seen in the exterior photos.

The washer and dryer are present in the basement of this building. The basement is substantially empty otherwise.

3.0 METHODOLOGIES

3.1 Asbestos

Asbestos samples were collected in accordance with the Asbestos Hazard Emergency Response Act (AHERA) Rules, Section 40 CFR Part 763.86. Analysis for the presence of asbestos fibers in

00035 - 3 | P a g e bulk samples was performed in LEGEND’s laboratory using polarized light microscopy (PLM) and dispersion staining techniques. The analysis was performed using an Olympus BHSP microscope at 40-200X magnification in accordance with current U.S. Environmental Protection Agency (USEPA) protocols, "Method for the Determination of Asbestos in Bulk Building Materials," EPA 600/R-93/116, 1993. All reported percentages are by visual estimates. In the case of nonhomogeneous samples, each material or layer is analyzed separately, and the reported percentages are based on the total sample as received. An asbestos containing material (ACM) is defined as any material containing greater than one percent asbestos as analyzed by PLM techniques.

3.2 Lead-Based Paint

Lead-based paint (LBP) testing was performed on painted surfaces inside and on the exterior of the building, and the condition of the paints were noted. Lead paint readings were collected in a nondestructive manner using X-ray fluorescence (XRF). Readings were collected using the Viken Detection Pb200i Handheld XRF Lead Paint Analyzer, model Pb200i, serial number 2392, which uses a radiation source of Cobalt-57 with a maximum radiation activity of 5 millicuries (mCi). X-ray fluorescence quantitatively measures the concentration of lead within paint by bombarding it with ionizing radiation. This process causes the sample to emit X-rays which are detected and analyzed by the XRF to give a concentration of lead in the sample. An instrument calibration check is performed prior to and after testing to ensure accuracy of measurements; the Viken is also calibrated after four hours of use. The instrument uses the federal limit of 1.0 milligram per square centimeter (mg/cm2) of lead to identify the presence of lead-based paint on a surface.

3.3 Mold

Mold was assessed visually only.

3.4 Regulated/Hazardous Materials

LEGEND conducted a facility walk-through and visual survey of the building materials. Materials surveyed included the following: mercury-containing materials, polychlorinated biphenyls (PCBs), chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), oil and oil products (including treated timbers), household hazardous-waste (paints, varnishes, solvents, and cleaning chemicals), fuel oil tanks, miscellaneous hazardous materials, and solid waste.

4.2 Lead-Based Paint

Thirty-eight (38) xrf readings were taken from painted surfaces both inside and on the exterior of 00035. Plaster throughout the house had lead-based paint. The exception was one closet interior identified as room 6 did not have lead-based paint on the inside plaster. It is suspected that the closets may have had unpainted plaster initially and were painted later using a non-lead based paint. The doors, door frames, window trim were not lead-based finished even when painted.

The stairway gray paint was non-lead based. The bathroom is entirely gypsum wallboard and did not have lead-based paint. The basement level had some lead-based paint on walls but wood trim was not lead-based paint. The exterior foundation paint was non-lead based and the deteriorated paint on basement windows was non-lead based paint. The metal siding was testing variable even though visually the same on all sides until it was noted that the old siding remained under the metal siding and it was painted white. The original siding has lead-based paint and it has variable coverage is what appears to be the cause of the XRF readings. The metal siding is non-lead based paint covered.

Given the variability in data in this building, an XRF should be on site during the remediation to determine what is and isn’t lead-based paint as some of the plasters may be able to be removed as non-lead based or kept in place.

4.3 Mold

There was no visible mold, however, plaster harbors both Penicillium and Aspergillus molds without them being visible to the viewer. Given the amount of water and deterioration in this unit, it is likely it harbors both Penicillium and Aspergillus molds in the plaster.

00035 - 5 | P a g e

4.4 Other Regulated/Hazardous Materials

The paint that remains appears to be dried and can be disposed of as normal demolition waste.

The two fuel oil tanks on the basement level need to be drained of any fuel oil residue (seemed close to empty based on hollowness when tapped) and removed intact if possible. The enclosure is partially wood allowing disassembly to remove the tanks. The area of fuel oil spillage on the floor below the tanks can be cleaned up. There are piles of dis-assembled cabinetry that were vandalized in Room 2. There also may be mercury containing thermostats in this building. There can be items hidden under the vandal debris.

5.0 STANDARD OF CARE

BUILDING 00036

HAZARDOUS MATERIALS SURVEY

LEGEND NO. 22-4702

Building 00036 was surveyed for hazardous/regulated materials and the following determined:

Asbestos-containing materials included sheet vinyl flooring in the kitchen area.

The wall and ceiling plaster is painted with lead-based paint. There is significant damage to the plaster from prolonged water infiltration through the roof. The ceiling has caved in in areas and the attic insulation and attic are visible on the ground level. The lead-paint plaster is mixed with other debris in the building. The hard wood floors are significantly damaged from water intrusion. The interior of the building needs a full demolition as a lead remediation. The exterior siding is painted with lead-based paint. When remediation is completed in this building it will be taken down to the frame. The roof area is significantly damaged and will need structural repair. The basement level has minimal lead-based paint. The wood members could be removed and the lead-based paint removed from the poured concrete foundation. Remediating this building of lead-based paint hazards will require a full demolition of the interior finishes, and structural replacement where needed. Remediation performed prior to demolition is generally more cost effective in situations like this building. Consideration should be given to demolishing this building. The foundation could be saved and new constructed over it, however, not much to salvage in the wood structure.

The chimney ash was tested and it is not a hazardous waste.

There may be some containers of chemicals, etc. requiring special disposal under all the debris but there will not be many and they are likely household chemicals.

NARRATIVE REPORT

1.0 INTRODUCTION

Legend Technical Services, Inc. (LEGEND) representative Cheryl A Sykora,CIH,CSP,CHMM South Dakota Certified Asbestos Inspector and EPA Tribal Certified Lead Risk Assessor visited the Rosebud Agency Indian Health Service buildings including Residence 00036 and performed both asbestos and lead-based paint surveys of the buildings. The survey work was performed on October 19, 2022.

2.0 BACKGROUND INFORMATION

Rosebud Quarters Building 00036 is part of Installation 11547. Its approximate age is 1915. The size of the building is 3,422 square feet. According to information received at the site from Facilities, this building was originally the main clinic for Rosebud but was converted to a residential building sometime in the past. The building is painted wood sided with asphalt shingled roof. The paint on the outside is very deteriorated but no significant chips were noted in the grass around the outside of the building. The roof has openings allowing rain to get down into the building and extensive damage has occurred to the ceiling plaster/lath system causing deterioration of both the plaster and the lath exposing the attic and insulation above particularly on the southeast side. Suspended ceiling panels including both 2 x4 and 2 x 2 lay-in panels were installed at some date on the southeast side but were also generally water damaged on the floor. The entire ground level is finished with a single coat plaster/wood lath system with some changes made in some areas where gypsum wallboard was installed. These are assumed to be repairs to damaged plaster since construction. The flooring is hardwood that has significant damage because of water infiltration. No carpeting was noted. There is sheet vinyl flooring in some areas but no vinyl composition tile was noted in this building. The attic insulation was generally exposed through openings created by the damage and was not asbestos-containing fiber. No vermiculite was noted in the building indicating that vermiculite was not present in the attic. The attic was not structurally sound to explore. The kitchen area still had a refrigerator, oven, and stove top. The sink was enamel with no bowl coating.

The basement level is poured concrete with dirt floored crawlspace areas on the northeast side.

The basement is empty with a chimney in a central location. The chimney had a clean out that could be opened. A sample of the ash was collected for heavy metal analysis. There was no insulated piping on the basement level. The basement was generally empty. There was no evidence of an original heating system that used the chimney. The ground level had electric baseboard that did not appear to be a recent installation. There was a limited amount of gypsum wallboard and taping compound on the basement level. There were no fuel oil tanks or lp tanks. There was a concrete bump out from the foundation that could have concealed an old coal chute but no evidence existed inside the building of why the bump out was there.

3.0 METHODOLOGIES

3.1 Asbestos

Asbestos samples were collected in accordance with the Asbestos Hazard Emergency Response Act (AHERA) Rules, Section 40 CFR Part 763.86. Analysis for the presence of asbestos fibers in

00036 - 3 | P a g e bulk samples was performed in LEGEND’s laboratory using polarized light microscopy (PLM) and dispersion staining techniques.

3.3 Chimney Ash

A sample of the chimney ash was taken from the clean out at the bottom of the chimney and analyzed for RCRA metals including mercury using Inductively Coupled Plasma Spectroscopy in accordance with EPA methodologies.

3.4 Mold

Visible mold was not present, however, wet plaster is suspected of harboring molds that are not visible. Aspergillus species readily grows in wet plasters and this building has extensive plasters that get wet when it rains. The basement level is dry with no evidence of water in the dirt floored crawlspaces.

3.5 Regulated/Hazardous Materials

LEGEND conducted a facility walk-through and visual survey of the building materials. Materials surveyed included the following: mercury-containing materials, polychlorinated biphenyls (PCBs), chlorofluorocarbons (CFCs), hydrochlorofluorocarbons (HCFCs), oil and oil products (including treated timbers), household hazardous-waste (paints, varnishes, solvents, and cleaning chemicals), fuel oil tanks, miscellaneous hazardous materials, and solid waste. This was

00036 - 4 | P a g e difficult to accomplish given the extensive plaster damage. A can of a petroleum based substance was noted on the basement level. Hazardous materials will require sorting from the plaster debris when this building is remediated.

4.0 FINDINGS

4.1 Asbestos

A total of 38 samples were collected and analyzed for asbestos content. Two (2) of the samples contained asbestos. This included the backing for the sheet vinyl in the kitchen area.

Location Material Quantity

Kitchen area Sheet vinyl flooring 200 sf

4.2 Lead-Based Paint

Twenty (20) xrf readings were taken from painted surfaces both inside and on the exterior of 00036. The plaster throughout this house was painted with lead-based paint. The exterior wood siding has lead-based paint. Anything painted white was identified as lead-based paint.

The foundation has lead-based paint. Thirteen of the twenty readings were lead-based paint.

Doors and door frames did not have lead-based paint. Assumed these were originally varnished and painted at a later date.

The lead-based painted plaster is significantly deteriorated from the roof water intrusion and is dispersed throughout the unit. The interior of this unit presents a significant lead hazard to small children who may be tempted to put some of it in their mouths or foot traffic taking it outside the building. The exterior has lead-based paint on wood siding and posts. This is significantly deteriorated but no obvious signs of lead paint contamination were noted walking around the building. The area is grass covered. There may need to be some verification of soil cleanliness post remediation.

The entire interior needs to be gutted to the wood structure and cleaned. The siding needs to be removed. A successful lead remediation will mean this building is just a stud frame on the ground level.

00036 - 5 | P a g e

The basement has some lead-based paint on the concrete and wood items but this is limited in area. This could be removed without impacting the foundation.

4.3 Chimney Ash

A sample of the chimney ash was collected from the base of this chimney from the clean out.

RCRA metals including: arsenic, barium, cadmium, chromium, lead, mercury, selenium and silver were determined as a total for the ash and a maximum TCLP leach limit calculated based on a 100% solubility of the total metal content. None of the metals will exceed the TCLP limits. The ash is not a hazardous waste. Table #3 Data.

4.4 Mold

There was no visible mold, however, plaster harbors both Penicillium and Aspergillus molds without them being visible to the viewer. Given the amount of water and deterioration in this unit, it is likely it harbors both Penicillium and Aspergillus molds in the plaster.

4.5 Other Regulated/Hazardous Materials

There was a can labelled boiled linseed oil located in the basement shown in the photographs.

The can had contents but whether it was linseed oil was not determined. The building has so much debris from dislodging of the plaster lath ceiling system that it is not possible to determine what is present. No thermostat was noted in the building but the age of the electric baseboards suggests it could contain mercury when found. The refrigerator and oven and cook top are still present in the kitchen.

Other items may be exposed when removing the layers of debris from the floor.
