About this file

This document contains questions and answers related to a federal solicitation for wastewater treatment improvements. The solicitation seeks a contractor to renovate and expand an existing 32.6-acre, six cell wastewater lagoon facility located on tribal lands into a 49-acre, five cell treatment system. Through a two-phase construction approach, the contractor will furnish all labor, materials and equipment to upgrade the facility. The solicitation is set aside for Indian Small Business Economic Enterprises in accordance with the Buy Indian Act and is issued by the Department of Health and Human Services Indian Health Service. The questions and answers provide clarification on issues such as the estimated volume of sludge removal, material sourcing, construction measurement and payment terms, wastewater management during construction, and licensing requirements.

QUESTIONS AND ANSWERS

Q1. During the pre-bid meeting it was stated that there approximately 1” of sludge to be removed in the existing ponds. Question #9 in amendment #5 stated that “it is the responsibility of the contractors’ to estimate quantity of sludge in the existing cells.” Can the IHS estimate the cubic yards that will need to be removed and the sludge removal be changed to a surveyed cubic yard price so both the IHS and contractor are protected should quantities vary?

A1. IHS will not be reporting an estimated volume of the sludge. As indicated by the lump sum measurement & payment approach for Price Item No. 8 (See Attachment 3, Price Schedule), it is the responsibility of the Contractor to estimate the amount of sludge that he/she will be responsible for handling.

Q2. Can the location and the available quantities of the gravel and 6” riprap from the Zuni Tribe, listed in resolution no. M70-2002-B045 be provided?

A2. It is recommended that contractor’s consider acquiring necessary gravel and base coarse material from alternate sources, rather than locally from the Pueblo of Zuni. After consulting with the Pueblo of

Zuni, it seems that the Pueblo will not be able to offer base coarse to the Contractor, the Pueblo also reported that the availability of gravel is limited.

Q3. Can the wastewater lagoon construction bid items be changed to cubic yard bid items? This again is to ensure bids are comparable and protect the IHS and contractor should quantities vary.

A3. IHS will not be reporting estimated cut and fill volumes. As indicated by the lump sum measurement and payment approach for Price Items 5 & 6 detailed in TP-4012.A, it is the responsibility of the

Contactor to estimate the volume of earthwork that will be required to construction the lagoon cells. A

DXF file containing the existing versus design contours were made available to support bidders with determining the efforts required to complete the work prescribed by Price Items 5 and 6.

Q4. Can any of the existing cells 1,2,3,5 and 6 be drawn down prior to the completion of phase 1, in order to prevent a delay in starting phase 2?

A4. Potentially one or two (max) may be drawn down prior to the completion of phase 1 work. Please note this response does not constitute as an absolute approval. Such approval would be based upon: (1.)

the successful Contractor presenting a proposed approach for draining the cells while adequately managing the incoming wastewater flows, and (2.) the proposed approach meeting the collective satisfaction of the Zuni Utility Department and IHS.

Q5. How will the limits of sludge removal be determined?

A5. The specifications were developed to ensure the land application (stockpiling) of the anticipated sludge will be executed in accordance with presiding environmental guidelines, therefore IHS is not concerned be applied to quantify the volume of sludge removed.

Q6. If water from the lagoons were treated with a proper amount of bleach, could it be used to moisture condition embankment material?

A6. No. The existing lagoon facility is severely undersized and is therefore providing little to no biological treatment of the wastewater it receives and is currently retaining. The effluent from the existing lagoons is essentially raw (untreated) sewage water due to the lack of biological treatment.

Bleach additive is not a sufficient wastewater treatment solution that will ensure the wastewater effluent is safe to be utilized as construction water and subsequently introduced into the environment in an uncontrolled manner.

Q7. On Drawing Sheets 8 and 9, reference is made to the 536 lf of 18-inch diameter transfer piping running along the berm between Cell 1 and Cell 4. Could we get a cross section of that portion of the term in order to know location & depths within the berm?

A7. It is not clear which section of pipe this question is referring to as this contract does not prescribe new transfer piping to be installed between New Cells 1 and 4. Neither is there an existing section of transfer piping between existing Cells 1 and 4 that is 536 feet in length, as indicated by the question. If contractor is inquiring about the 536 linear feet of new 18-inch transferring piping to be installed between

New Cells 3 and 4, they should refer to the details provided for the “Transfer Piping Structure Between

Treatment Cells – TYPE A” on Sheet 14 to determine the pipe depths for the transfer piping to be installed between New Cells 3 and 4.

Q8. Question #5 in amendment #5 discusses anchor trenches. There appear to be two types of anchor trenches, perimeter and center anchor trenches. Are perimeter anchor trenches (as shown on the bottom left detail of sheet 16) required for all the liners?

A8. Correct, there are two types of anchor trenching for the HDPE liner that is to be installed under this

Contract. Please refer to Detail 40A on Sheet 14 to view the installation of the perimeter anchor trenching that is to be installed at the top of berm (perimeter of HDPE liner).

Q9. Do any of the areas require re-seeding?

A9. No.

Q10. In regards to the liner system, are we to assume that we are placing a complete layer of geocomposite under the liner in all the ponds1-5, then placing an added GGVL of 10' wide strips on 50' centers in cells 2,3,4,5? Or is there no underlying geocomposite layer in the ponds except for the GGVL

10' wide strips in cells 2 through 5?

A10. After reviewing the details within the construction documents (specifications and drawings) concerning the prescribed HDPE liner and GGVL system, please refer to sections TP-4008 - HDPE Liner, TP-4009 - GGVL System, and Sheets 8, 9 10, 14 & 16 of the construction plans, as the provided documentation illustrates a clear technical illustration of the required design.

Q11. Would consideration be made for a bidder with an out of state Contractor’s license if a New Mexico

Contractor’s license is currently in the application process, and would be finalized after award?

A11. After further review, it has been determined that a New Mexico Contractor’s license is not required for this project as it is being performed on Federal/Tribal lands and is not a requirement for this contract.
