About this file

This document provides an amendment to a solicitation for the Zuni Wastewater Treatment Improvements project. The amendment answers questions from potential offerors and makes clarifications to the solicitation. The Contractor shall renovate and expand an existing 32.6-acre, six cell lagoon facility to a 49-acre, five cell treatment system through a two-phase construction approach. This acquisition is set aside for Indian Small Business Economic Enterprises in accordance with the Buy Indian Act. The proposal due date remains unchanged as of the date of Amendment 03. The amendment replaces references to a MATOC with the word "contract" and clarifies that joint venture agreements do not require SBA approval as this is not an 8(a) set aside. It also specifies that offerors shall provide the DeZurik Eccentric Plug Valve or equal, disregarding the 100% port requirement.

QUESTIONS AND ANSWERS

Q1. Section L.6.1(g) on page 59 states that “Small Business Administration approval of small business status shall be included with the proposal submission. Failure to include SBA certification of small business status for purposes of this solicitation with submission of the proposal may result in rejection of the offer.”

What “approval” is the agency seeking that offerors provide? Does submission of a company’s 8(a) certification letter satisfy this requirement?

A1. All Joint Venture offerors shall provide a copy of their Joint Venture Agreement. As this is not an

8(a) set-aside, the requirement to provide SBA approval is not required and deleted from this section.

Reminder that this is an Indian Small Business Economic Enterprise (ISBEE) set aside and any JV must also be an ISBEE.

Q2. Section L.6.1(g) on page 59 states that “If a business concern is contemplating an 8(a) Mentor-

Protégé Joint Venture on this MATOC, evidence shall be provided…...”. Our understanding is that this is not a MATOC. Please confirm that the reference to a MATOC is inadvertent.

A2. This is not a MATOC. Replace the term ‘MATOC’ from this paragraph with the word ‘contract’.

Q3. Please note that SBA only will review and approve a joint venture agreement in connection with an

8(a) contract and will do so prior to award, not proposal submission. See 13 C.F.R. § 124.513. As this is not an 8(a) set-aside, will the agency remove the requirement that SBA must approve the joint venture agreement?

A3. Joint Venture Agreements are not required to be approved by the SBA as this is not an 8(a) set aside.

However, per section (d)(1)(i) of 13 C.F.R. §125.9: “SBA must approve the mentor-protégé agreement before the two firms may submit an offer as a joint venture on a particular government prime contract or subcontract in order for the joint venture to receive the exclusion from affiliation.”

Q4. Spec TP-40031.5, states that “Ports shall be rectangular and 100% port” and “Plug Valves shall be equal to the DeZurik Eccentric Plug Valve, Rectangular Port (AWWA C517) (PEC) for sewer applications.” Per the Dezurik rep the PEC is NOT 100% port. The DeZurik full port valve is the PEF.

Shall the DeZurik PEC or PEF valves be provided?

A4. The Contractor shall install the DeZurik Eccentric Plug Valve (PEC) or equal; disregard the 100% port opening requirement.

Q5. The current bid date for this Solicitation is 4/30/20 @ 2:00pm PDT. Considering the concentrated effort for the highest quality response we wish to provide IHS with, information we wish to potentially implement from Q&A and the virtual walk through via ZOOM on 4-16-2020, and also considering complications we have experienced due to the COVID-19 epidemic, we respectfully request a bid date extension of two weeks.

A5. As of the date of this amendment, the proposal due date remains unchanged.
