HHSAR 352.239-78 Information and [Communication] Technology Accessibility Notice.
[(Deviation)] (FEB 2024)
(a) Any offeror responding to this solicitation must comply with established HHS Information and Communication Technology (ICT) accessibility standards. Information about Section 508 is available at https://www.hhs.gov/web/section-508/index.html.
(b) The Section 508 accessibility standards applicable to this solicitation are stated in the clause at 352.239-79 Information and Communication Technology Accessibility. In order to facilitate the Government’s determination whether proposed ICT supplies, products, platforms, information, and documentation meet applicable Section 508 accessibility standards, offerors must submit an appropriate HHS Section 508 Accessibility Conformance Checklist (see https://www.hhs.gov/web/section-508/accessibility-checklists/index.html) or an Accessibility Conformance Report (ACR) (based on the Voluntary Product Accessibility Template (VPAT) see https://www.itic.org/policy/accessibility/vpat), in accordance with the completion instructions. The purpose of the checklists and conformance reports are to assist HHS acquisition and program officials in determining whether proposed ICT supplies, products, platforms, information, and documentation conform to applicable Section 508 accessibility standards. Checklists and ACRs evaluate—in detail—whether the ICT conforms to specific Section 508 accessibility standards and identifies remediation efforts needed to address conformance issues.
(c) If an offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that supplies, products, platforms, information, documentation, or services support delivered do not conform to the described accessibility standards, remediation of the supplies, products, platforms, information, documentation, or services support to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.
(d) In order to facilitate the Government's determination whether proposed ICT supplies meet applicable Section 508 accessibility standards, offerors must submit an Accessibility Conformance Report, in accordance with its completion instructions and tailored to the requirements in the solicitation. The purpose of the Report is to assist HHS acquisition and program officials in determining whether proposed ICT supplies conform to applicable Section 508 accessibility standards.
The template allows offerors or developers to self-evaluate their supplies and document, in detail, whether they conform to a specific Section 508 accessibility standard, and any underway remediation efforts addressing conformance issues. Instructions for preparing the HHS Section 508 Evaluation Template are available at https://Section508.gov/.
(e) In order to facilitate the Government's determination whether proposed ICT services meet applicable Section 508 accessibility standards, offerors must provide enough information to assist the Government in determining that the ICT services conform to Section 508 accessibility standards, including any underway remediation efforts addressing conformance issues.
(f) Respondents to this solicitation must identify any inability to conform to Section 508 requirements. If an offeror claims its supplies or services meet applicable Section 508 accessibility standards, and it is later determined by the Government, i.e., after award of a contract or order, that https://www.hhs.gov/web/section-508/accessibility-checklists/index.html https://www.itic.org/policy/accessibility/vpat https://section508.gov/ supplies or services delivered do not conform to the described accessibility standards, remediation of the supplies or services to the level of conformance specified in the contract will be the responsibility of the Contractor at its expense.
(g) Items delivered as electronic content must be accessible to HHS acceptance criteria. Checklist for various formats are available at http://508.hhs.gov/. Materials, other than items incidental to contract management, that are final items for delivery should be accompanied by the appropriate checklist, except upon approval of the Contracting Officer or Contracting Officer’s Representative.

Section M- Evaluation Factors for Award
M.1 GENERAL PROCEDURES FOR AWARD
An Offeror should not assume that the Contracting Officer will independently obtain information necessary to evaluate its proposal and should therefore supply all information required to evaluate its proposal.
The Centers for Medicare & Medicaid Services (CMS) will conduct an evaluation of your proposal to determine if your proposal offers the best combination of technical capabilities and estimated cost/price to the Government.
In accordance with FAR 9.103, contracts shall be awarded to responsible prospective contractors only.
Before awarding any contract, the Contracting Officer must make an affirmative determination of the prospective contractor’s responsibility. FAR 9.104-1, General Standards, lists the areas that shall be considered.
M.2 FAR 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL
SERVICES
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
CMS shall evaluate the Offeror’s technical proposal based on the following:
1. VOLUME I - TECHNICAL EVALUATION
a. Technical Understanding and Approach
The offeror’s proposal is complete and demonstrates an understanding of the SOW. This includes having an awareness of contract objectives and the tasks required that produce the required service as defined by the requirements. The proposed approach is sound and well documented and ensures the achievement of timely and acceptable performance.
b. Personnel Qualifications
The staff proposed is competent and experienced in the skills required to accomplish the SOW.
Resumes of staff and consultants reflect not only academic qualifications, but also actual on-the-job experience in tasks similar to those in this SOW.
c. Management and Staffing Plan
The offeror’s response shall demonstrate its ability to manage all aspects of the proposed effort including technical performance, time and delivery constraints, price and use of subcontractors.
CMS will evaluate the offeror’s ability to identify, address and resolve problems; and maintain a positive working relationship with CMS staff. The Management Plan should identify the offeror’s plan for accomplishing the work in a logical sequence that will lead to successful performance.
d. Section 508 Accessibility Compliance Checklist – Adequate/Inadequate
The Government will evaluate the successful Offeror’s completed CMS Accessibility Checklist for adherence to applicable Section 508 standards for the apparent successful Offeror(s).
Additionally, the Contracting Officer may use other information, besides that disclosed by the Offeror, in the Contracting Officer’s evaluation of adherence to section 508 standards.
As deemed necessary prior to award, the Contracting Officer may have exchanges with the successful Offeror to remedy any issues or request additional information as it pertains to the successful Offeror’s CMS Accessibility Checklist submission. These exchanges with the successful Offeror(s) do not constitute discussions and will be utilized to ensure that award is made to contractor(s) capable of meeting the 508 accessibility standards.
The 508-compliance evaluation will not result in a score/rating as it is only applicable to the apparent successful Offeror.
2. VOLUME II - BUSINESS PROPOSAL EVALUATION
The business/price proposal will be evaluated through various price analysis techniques in order to determine proposed price estimates are fair and reasonable. Additionally, analysis will be performed to determine if the level of effort and the mix of labor proposed are appropriate to perform the requirements set forth in the Statement of Work and correspond to the technical proposal. The Government reserves the right to consider the realism of the offeror’s proposed price(s), if necessary, as a method of determining if price reveals problems that would impact performance risk and responsibility matters. Price realism analysis will be performed, if necessary, in accordance with the methodology set forth in FAR 15.404-1(d).
3. VOLUME III - CONFLICT OF INTEREST EVALUATION
In accordance with FAR 9.504(e) and Section H.2, the Government will evaluate the Attachment 3 - CONTRACTOR/OFFERORCONFLICT OF INTEREST as well as other information, as appropriate. The conflict of interest evaluation will not result in a score/rating as it is only applicable to the apparent successful Offeror.
(b) Options. Evaluation of the option periods will be conducted pursuant to FAR 52.217-5, Evaluation of Options.
The combined evaluated costs for the Base Year and all option periods will be utilized in determining the best value. This includes the options under FAR 52.217-8, Option to Extend Services, which is applicable to this solicitation. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers or quotations for award purposes by adding the total price for all options to the total price for the basic requirement to determine the total evaluated price. This includes options under FAR clause 52.217-8, Option to Extend Services, which applies to this solicitation, and shall be evaluated by taking half of the cost of the last option period and adding it to the total. Evaluation of options will not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
