About this file

This is a Questions and Responses (QnR) document for federal solicitation 75F40126Q133840 addressing inquiries from prospective quoters regarding a liquid nitrogen supply and delivery contract for the FDA facility in Laurel, Maryland.

The document clarifies four key requirements: (1) contractors must possess and document exact operational fleet capacity and physical plant redundancies within their prime organization or named subcontractors to guarantee uninterrupted delivery continuity, with supply-chain redundancy achieved through multiple delivery trucks and production plants within 100 miles of Laurel; (2) proactive, telemetry-driven deliveries are expected and acceptable to maintain a mandatory 10-day reserve threshold (approximately 855 gallons for the estimated 2,600 gallons monthly consumption in a 1,500-gallon tank), with Tuesday morning deliveries preferred to align with peak mid-week laboratory utilization and avoid federal holiday disruptions; (3) Amendment A00001 will establish a dedicated one-time Firm-Fixed-Price Transition Line Item (Line Item 3) for all non-recurring costs associated with disconnection, removal of existing vessel, and installation/validation of new tank infrastructure, which must not be amortized into monthly infrastructure lease pricing; and (4) a mandatory site visit is scheduled for Monday, August 3, 2026 at 10:00am Eastern time at 8401 Muirkirk Road, MOD 2, Laurel MD 20708, requiring attendee names submitted to suzanne.martella@fda.hhs.gov by July 31, 2026 at 2:00pm Central time with valid government-issued photo ID required for facility access, and technical questions from the site visit due by August 12, 2026 at 2:00pm Central time.

Questions and Responses (QnR)

The following Questions have been submitted in response to solicitation 75F40126Q133840 and following each questions are the government’s responses:

Question 1: Supply-chain redundancy: May a quoter satisfy the requirements for more than one delivery truck and more than one liquid nitrogen production plant within 100 miles of Laurel through its named subcontractor or supplier, with supporting documentation, while the prime contractor remains fully responsible for performance?

Response: The FDA is explicit in this requirement twice within the solicitation. The contractor, inclusive of any proposed subcontractors or supplier networks, must possess and document the exact operational fleet capacity and physical plant radius redundancies detailed in SOW Section 6 and Instructions to Offerors Section 2 to guarantee uninterrupted delivery continuity.

Question 2: Reserve and delivery frequency: At the estimated consumption of 2,600 gallons per month, a 10-day reserve is approximately 855 gallons. To maintain that threshold in a 1,500-gallon tank, we anticipate telemetry-driven deliveries more frequently than the estimated bi-weekly cadence.

Please confirm that proactive deliveries at the frequency necessary to maintain the 10-day reserve are expected and acceptable.

Response: Confirmed. Proactive, telemetry-driven deliveries are expected and acceptable to ensure the tank never falls below the mandatory 10-day reserve threshold. The current tempo is deliveries are made on Tuesday mornings. The Government prefers to maintain this delivery schedule due to the high volume of personnel on campus and the fact that the majority of laboratory work utilizing the house nitrogen occurs mid-week (Tuesday, Wednesday, and Thursday). In addition, this scheduled cadence minimizes potential delivery disruptions associated with federal holidays falling on Mondays or Fridays.

Question 3: Transition pricing: The solicitation states that a separate one-time transition CLIN may be used for rigging and installation, but the pricing schedule lists only the monthly lease and per-gallon refill CLINs. Should offerors amortize all transition costs into the monthly lease, or will FDA provide a separate transition CLIN?

Response: Offerors shall not amortize transition, rigging, or installation costs into the monthly infrastructure lease Line Items. The Government is issuing Amendment A00001 to include a dedicated, one-time Firm-Fixed-Price (FFP) Transition Line Item (Line Item 3) within the Base Period pricing schedule. All non-recurring costs associated with the physical disconnection, removal of the existing vessel, and installation/validation of the new tank infrastructure must be isolated within this single line item.

Question 4: Site visit: We would also like to schedule the earliest available inspection of the existing tank, instrumentation, concrete pad, and connection point.
