About this file
This document is an amendment to a federal solicitation. The purpose of this amendment is to provide answers to questions received and amend the solicitation document for the Center for Biologics Evaluation and Research (CBER), Biologics Effectiveness and Safety (BEST) Initiative #3: Data Sources for Surveillance of Biologics (Solicitation #75F40124R00002).
The key details are:
- The amendment addresses questions related to Section E.2.1.2, specifically regarding the requirement that subcontractors may only team and propose with one prime offeror. The agency is removing this language, clarifying that commercial software, analytic platforms, and data linkage packages would be considered Other Direct Costs (ODCs) not subject to this limitation. The agency also clarified that the subcontractor limitation only applies to Phase II, not Phase I.
- This is a civilian agency solicitation issued by the Department of Health and Human Services Food and Drug Administration Office of Acquisition and Grant Services.

The questions are related to section E.2.1.2, under Offeror Participants, sub bullet d., "Subcontractors may only team and propose with one (1) prime Offeror in response to this solicitation." Our questions are as follows:
1. Are technologies such as commercial statistical software packages (eg, SAS, SPSS, Stata, etc); commercial analytic platforms; commercial data linkage packages, etc classified as Other Direct Costs (ODC), thereby excluding them from the clause limiting them to one prime offeror?
Response: We are removing this language from the solicitation. These would be considered ODCs. However, please refer to the IDIQ Performance Work Statement Section 1.2 where it states, “This solicitation does not seek IT software solutions, IT analytic platforms, open-source healthcare databases, aggregated and linked healthcare data collected from disparate sources, and healthcare data without access to full medical charts.”
2. Given this clause is only mentioned under Phase II, can FDA clarify if subcontractors can support more than one (1) prime offeror for Phase I, or does this clause apply to all phases?
Response: Phase I deals with “Demonstrated Prior Experience” and does not require subcontractor support. If your demonstrated prior experience was as a subcontractor to a prime, then that would be noted in your Phase I response.
