12. 52.212-2, EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

Addendum to FAR 52.212-2 – Evaluation – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government may award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(1) Ability to fulfill the minimum requirements of the government as specified in this solicitation

(2) Price

(3) Compliance with solicitation requirements

Ability to fulfill the minimum requirements of the government is significantly more important than price when being evaluated.

Compliance with solicitation requirements will be evaluated as either acceptable or unacceptable. Completion of pricing for each line item will be necessary in order to submit a quote for each Option Year (if options). The total evaluated price includes the total price for all options along with the basic requirement (if options). Evaluation of options shall not obligate the Government to exercise the option(s). Quotes with option prices that are significantly unbalanced will be evaluated as noncompliant. Offerors shall propose on all items. If there is to be no charge for an item, an entry such as “no charge”, or the letters “N/C” or “0” must be made in the unit price column. Quotes that fail to price each item or indicate services will be provided at no charge will be evaluated as noncompliant. An offer using a sliding price scale or subject to escalation based on a contingency will be evaluated as noncompliant. Other than firm fixed-price offers will be evaluated as noncompliant. The price evaluation will document the reasonableness of the proposed total evaluated price for the apparent successful offeror The award will be made using simplified acquisition procedures. For this reason, the final award decision may be made to the quoter whose quote is determined to be the Lowest Price Technically Acceptable (LPTA) in accordance with (IAW) the requirements in the SOW. A determination of the best value will be based on a comparative assessment of the quoter’s price and technical ability.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
