6.
Question: Would the government please define criteria b) order projects. Does aggregate value mean a individual task order, or all the orders referenced in this section.
Government Response
The aggregate value amount of $10M must be awarded from a ceiling of $35M from each IDIQ/BPA contract
7.
Solicitation Section/Subsection Number: General
Question: Is there an incumbent contractor supporting this effort?
Please reference question 2
8.
Solicitation Section/Subsection Number: Section No 22/Page 123
Question: Many companies are structured with multiple divisions or multiple legal entities that individually perform Prime Contracts but fall under a broader corporate umbrella.
Recognizing such corporate structures exist across the industry, the procurement rules and numerous GAO decisions have made clear that procuring agencies may evaluate and credit an offeror with the past performance and corporate experience of sister subsidiary companies where the offeror’s proposal demonstrates that the resources of the sister subsidiary (e.g., workforce, management, facilities, or other resources) will be meaningfully contributed to contract performance. See GM–Bulltrack, B- 414591.6 (Comp. Gen. Oct. 30, 2018) (holding that an agency may properly attribute the experience or past performance of a sister subsidiary), and Iyabak Construction, LLC, B-409196 (Comp. Gen. Feb.6, 2014) (holding that the agency failed to articulate a rational basis for solicitation’s refusal to consider experience and past performance of sister subsidiaries).
Would the Government please confirm that the Offeror may cite the prime contract past performance and corporate experience of a sister subsidiary company so long as the Offeror demonstrates how the resources of the sister subsidiary will meaningfully contribute to the performance of the opportunity?
Government Response
The government will accept past performances which at least one must be from the prime and other two can be from the partners
9.
Solicitation Section/Subsection Number: Section No. 22/ Page 123
Question: The solicitation requires an ordering vehicle such as a BPA or Indefinite Delivery Indefinite Quantity (IDIQ) contract award where the award ceiling is at least substantial to 35 million dollars.
Given that the size standard for this opportunity is $19.5M most companies that are within this size standard will struggle to meet this requirement.
Will the Government please consider lowering the threshold to $25 million?
No
10.
Solicitation Section/Subsection Number: N/A
Question: The RFQ requirement for Phase I states that bidders are required to provide up to 3 contract references.
Please specify that the following requirement applies to only one of the three contract references: "Ordering vehicle such as a BPA or Indefinite Delivery Indefinite Quantity (IDIQ) contract where the award ceiling is at least substantial is $35 Million"
Government Response
All 3 references must be of $35M ceiling each with an aggregated amount of $10M which one of the references must be from the Prime
11.
Question: The requirements make numerous references to “ISO 2000.”
Please confirm that those should read “ISO 20000” rather than “2000” IAW page 130 of the
RFP.
Please reference question 4
12.
Solicitation Section/Subsection Number: Section No. 22 page 122
Question: The RFP states: “When considered together, the relevant experience references cited should cover the entire scope of the Task Areas (section 3; tasks 3.1-3.6) in the IDIQ
SOW”.
Please confirm this should be section 4, tasks 4.1 to 4.6?
That is confirmed, section 4, tasks 4.1 to 4.6
13.
Question: Phase I – Volume 1: Past Relevant Experience – We suggest modifying the sentence: “At least 1 of the 3 efforts shall be as the Prime contractor or from a small business Joint Venture member.” To have a fair evaluation across small businesses, a JV company needs to show past performance from its small team member and not rely on their large business partner.
At least 1 of the 3 past performances shall be from the prime.
14.
Question: In reference to the statement: “Ordering vehicle such as a BPA or Indefinite Delivery Indefinite Quantity (IDIQ) contract award where the award ceiling is at least substantial to 35 million dollars.”
Can 1 of the 3 past performance references that demonstrate experience in a public health agency be from an agency specific stand-alone (not a BPA or IDIQ) contract that is similar in size to FDA’s Scientific Support Services?
Yes
15.
Solicitation Section/Subsection Number: Section No 1.3/Page 4
Question: The RFP Specifies the NAICS Code of 541990 with a stated size standard of $16.5 million.
Please confirm that the current size standard is $19.5 million for NAICS Code 541990 is applicable for this solicitation.
Confirmed
16.
Question: Do the CMMI and ISO requirements apply only to prime company, or can they be covered by partnering companies?
To the Prime
17.
Question: Is this a new requirement? If not, can you provide the incumbent(s) name(s), associated contract number(s) and contract value.
18.
Question: Can you provide information on how what is the mechanism for funding the IDIQ task orders?
Government Response
Each task order will be funded upon request from the specific center or office based on the need and funding for that specific office and needs.
19.
Solicitation Section/Subsection Number: 22.0 Instructions to offerors
Question: Is it possible to have an extension to the Phase 1: Volume 1 – Past Relevant Experience submission date? Anything would be greatly appreciated.
20.
Solicitation Section/Subsection Number: 4.7 Transition
Question: Who is the current incumbent and are there associated details to share?
21.
22.0 INSTRUCTIONS TO OFFERORS
Phase I -Volume 1: Past Relevant Experience Page 122
Question: It appears the government is severely limiting fair competition for this opportunity by requiring “at least a CMMI Level II and ISO 9001 & 2000 frameworks” for corporate operations. However, given the preponderance of work will be performed within the FDA operating environment and worksites, this is not reasonable given the selected use of NAICS 541990, nor is there sufficient detail to justify this in the IDIQ scope of work described in SOW sections 3.3 and 4.0 through 4.6. Additionally, it precludes many small businesses not able to make such a large investment in multiple certifications, limiting competition heavily towards Alaskan Native Corporations. Will the government please remove these requirements from the RFP Phase I down-selection criteria to promote fair competition amongst all small business offerors?
22.
22.0 INSTRUCTIONS TO OFFERORS
Phase I -Volume 1: Past Relevant Experience Page 122
Question: Can the government confirm if the ISO 9001 & “2000” references on page 122 were intended to be ISO 9001 and “20000”?
23.
FDA Scientific Support IDIQ RFP, page 123, Section Phase I Volume I Evaluation Criteria
Question: Would the Government consider proposals from an 8(a) prime where the $35M IDIQ requirement was met by a subcontractor rather than the prime, provided the collective team could still demonstrate high confidence in their ability to do the work and met all other Phase I evaluation criteria?
Please reference question 10
24.
FDA Scientific Support IDIQ RFP, page 123, Section Phase I Volume I Evaluation Criteria
Question: Very few companies exist which meet all of the required evaluation criteria in Phase I (i.e., A) Existing ordering criteria such as a BPA or IDIQ contract award where the award ceiling is at least substantial to 35 million dollars. B) order projects, aside from ordering vehicles, and aggregate award value of at least 10 million dollars. C) at least CMMI Level II and ISO 9001 & 2000 Frameworks). If the Government does not receive a minimum of two
(2) fully qualified Phase I submissions, will they consider slightly modifying the minimum requirements to allow for full competition from other qualified bidders and to avoid a single company receiving award by default?
Government Response
That is an assumption. The government will evaluate the submissions and select the most qualified company (s) that will advance to phase II
25.
Solicitation Section/Subsection Number: FDA Scientific Support IDIQ RFP
Question: The Government has indicated that this is a new effort, however it is believed by industry that this IDIQ will be issuing Task Orders for work which were previously being accomplished by contractors on other contracts and contract vehicles. Can the Government please confirm which existing or previous contract numbers are intended to be reorganized into this IDIQ vehicle, and as such who the incumbent contractors are for this effort?
26.
Solicitation Section/Subsection Number: Page 126 and 128 of the RFP
Question:
Page 126 and 128 of the RFP references completion of a “Task Order Resource Matrix”;
however, no documents have been provided with this title. Please confirm what should be provided to meet this requirement.
Please reference attachment 10
27.

May a searchable PDF be submitted for all documents, other than the pricing spreadsheets?
28.
Solicitation Section/Subsection Number: RFP Page 126
Question:
Please confirm that Phase II Volume I Sample Task Order Technical Proposal is not included as part of the overall 15 page limit.
Phase II technical response is limited to 15 pages. Please reference page 126 of the SOW
29.
RFP page 125, “Advisory Down- Selection Notification”
Question:
Since the government will be rating Phase I submission, would the government provide those ratings in the Phase I notifications?
30.
General, Page 125 Advisory Down- Selection
Question:
Can the government provide the estimated minimum and maximum number of offerors that will receive an advisory notification to proceed to Phase II?
Government Response
No, the government does not have a minimum or maximum number of offerors that will advance to Phase II
31.
Solicitation Section/Subsection Number: General, Page 125- Advisory Down- Selection
Question:
How many offerors does the Government intend to advance to Phase II?
Please reference questions 30
32.
Solicitation Section/Subsection Number: RFP page 123
Question:
Since our Federal customers are currently engaged with Fiscal Year End work loads, can CPARS be submitted in lieu of completed PPQs?
Please reference question 5
33.
Solicitation Section/Subsection Number: RFP page 123
Question:
Due to the Phased- Advisory down-select approach, will the government consider accepting completed PPQs during the Phase II submission, and not in Phase I? This will help alleviate added workload on government customers.
Please reference question 5
34.
Solicitation Section/Subsection Number: RFP page 125
Question:
Advisory Down-Select Notification statement: “For those Offerors that are highly rated and advised to proceed to Phase II of the proposal submission process, see below for instructions and evaluation factors for Phase II.” Please confirm Offerors not selected for Phase 2 but opt to proceed will have their proposals reviewed and evaluated the same as all other offerors.
35.
RFP page 123 “Phase I Volume I Evaluation Criteria”
Question:
As this is an 8a set aside with a NIACS code of 541990, with a $19.5M size standard, limiting relevant experience to a $35M BPA/IDIQ would limit competition to only 8a Joint Ventures with a Large business. We respectfully request that the Government lower this relevancy standard to a $25M ceiling which would equate to this IDIQs total value divided by the 4 ordering periods.
36.
Solicitation Section/Subsection Number: RFP Page 122
Question:
Since there is overlap in CMMI and ISO certifications to maintain a qualifiable level of quality support and project risk management, will the Government accept CMMI Level II or all three ISO certifications ISO 9001, 20000, and 31000 (ISO 9001 Quality Management System; ISO 20000 IT Service Management; and 31000 Risk Management), as this combination of ISO standards contains all of the elements the Government is seeking.
37.
Solicitation Section/Subsection Number: RFP page 122
Question:
Can you please clarify if the CMMI Level II is a pass/fail or will the government consider a proposal with alternative certifications/solutions that meet similar risk mitigation concerns for the government?
No, please reference question 4
38.
Question:
Phase I- Volume “The narrative must demonstrate that the Offeror possesses at least a CMMI Level II .” Please clarify that the Offeror can include teammate certifications to meet this requirement.
39.
Question:
Phase I- Volume “The narrative must demonstrate that the Offeror possesses at least a CMMI Level II and ISO 9001 & 2000 frameworks.” Please clarify that the Offeror can include teammate certifications to meet this requirement.
40.
Solicitation Section/Subsection Number: RFP page 42 Section 6.3; pages 127 and 129 Technical Factor 3
Question:
Please clarify the LCAT level of the IDIQ key personnel. It is referenced as both Program Manager IV and Program Manager III.
Government Response
The government is requesting a Program manager IV at the IDIQ level and Project Manager III at the task order level
41.
Solicitation Section/Subsection Number: RFP page 130 Volume II Business/Price Evaluation Criteria.
Question:
Please clarify if the price will be evaluated by the total evaluation price (each labor rate applied to the government’s estimated number of labor hours for each labor category) or if each LCAT labor rate will be evaluated individually.
Government Response
The government will evaluate the business proposal based on best value should price becomes a determining factor.
42.
Solicitation Section/Subsection Number: RFP page 128
Question:
The solicitation documents posted on SAM.gov include an excel document titled “Attachment 5 Labor hour rates IDIQ” and an “Attachment 9 Pricing Schedule”. The instructions indicate to submit a completed “IDIQ LCAT Price Template”. Please clarify if one or both of these files are to be submitted.
Both should be submitted
43.
Solicitation Section/Subsection Number: Attachment 9
Question:
Please confirm that the Attachment 9 Pricing Schedule should only include “No VISA Assistance” rates, and that “VISA Assistance” rates are to only be submitted on the Attachment 5 Labor hour rates spreadsheet, which includes both VISA and Non-VISA rates.
Attachment 5 has been updated and will be posted to SAM.gov on Monday September 18, 2023.
44.
RFP page 129 Technical Factor 4:
Sample Task Order Resources and Approach
Question:
Please clarify if the Sample Task Order Price Template will be evaluated for total price.
45.
RFP page 129 Technical Factor 4:
Sample Task Order Resources and Approach
Question:
Is Sample Task Order Price Template being used as part of the Government’s evaluation of the Offeror’s approach to Task Orders (and not as a price comparison being conducted at the IDIQ rate level)?
46.
RFP page 128 Sample Task Order Pricing, Attachment 8- Task Order Template
Question:
Since the candidates are examples, please confirm if the pricing sheet should be completed with both VISA and NO-VISA rates in order to evaluate Offerors in the same manner, or should the pricing sheet be completed based on our example candidates' VISA status?
Government Response
The Visa status/rates has been removed, please see the updated pricing and rates sheets that will be posted to SAM.gov on Monday, September 18, 2023.
47.
Solicitation Section/Subsection Number: RFP, Overall Basis of Award, page 130
The RFP states, “The offeror must possess at least CMMI Level II and ISO 9001 & 20000 frameworks.” These requirements appear to be excessive for the work required. Many qualified small businesses that do not possess these certifications, including our joint venture, are capable of successfully executing the work. Thus, it appears that requiring these certifications will unreasonably limit competition for this opportunity.
The offeror is required to have both certifications.
Solicitation Section/Subsection Number: Section 22.0/Phase I Volume I Evaluation Criteria
48.
Question: Under Phase I Volume I Evaluation Criteria, paragraph a, the government requires the offeror (in order to substantiate past performance size) to have: “Ordering vehicle such as a BPA or Indefinite Delivery Indefinite Quantity (IDIQ) contract award where the award ceiling is at least substantial to 35 million dollars.” Based on the Solicitation’s NAICS code of 541990 that has a small business size standard of $16.5M, it would seem any small business with three of these ordering vehicles over $35M would not qualify to bid this requirement.
Would the government please consider changing the NAICS code to 541714? NAICS code 541714 would be most appropriate to this requirement supporting scientific services in the health sector.
Government Response
No, the requirement is 3 BPA/IDIQ past performance of that only $10M is required for each contract
49.
Section 22/ Phase I-Volume I: Past Relevant Experience
Question: The government requires that the Offerrer possesses at least a CMMI Level II and ISO 9001 and ISO 20000 frameworks. Obtaining certifications in these frameworks is very expensive and a heavy burden on small businesses which limits competition. Would the government consider dropping the requirement or at a minimum, allowing a subcontractor to the prime offering those certifications?
Please reference question number 4
50.
Section 22/ Phase I-Volume I: Past Relevant Experience
Question: As the CMMI Level II and ISO 20000 frameworks are redundant, would the government consider changing the RFP language to require at a minimum only CMMI Level
II?
51.
Solicitation Section/Subsection Number: Section 2.3/Contract Type
Question: As this contract replaces a minimum of three 8(a) small business contracts/BPAs, would the government consider making this multiple award to continue broad opportunity within the small business community?
52.
Question: Which contracts, and their contractors, are being consolidated for this effort?
Solicitation Section/Subsection Number: Instructions to Offerors, Phase I – Volume I: Past Relevant Experience
53.
Question: In regarding the following requirement “The Offeror must possess at least CMMI Level II and ISO 9001 & 20000 frameworks”, must the ISO standard be specifically ISO 20000 or can the standard also reside within the same series as ISO 20000, for example, ISO 27001?
54.
Instructions to Offerors, Phase I – Volume I: Past Relevant Experience
For the following requirement “The Offeror must possess at least CMMI Level II and ISO 9001 & 20000 frameworks”, does a Joint Venture itself have to have this or may the two members of the Joint Venture have it?
Either member of the JV can hold the certifications.
55.
Instructions to Offerors, Phase I – Volume I: Past Relevant Experience
Question: For Past Performance references, for Offerors responding as a Joint Venture, please confirm the Past Performance references can be from either JV partner.
Yes, this is correct
56.
Instructions to Offerors, Phase I – Volume I: Past Relevant Experience
Question: For Past Performance references, if citing a multiple award IDIQ, please confirm the associated PPQ needs to be submitted for just one Task Order.
This is confirmed
57.
Instructions to Offerors, Phase I – Volume I: Past Relevant Experience
Question: How much time will the government take to assess Phase I Past Performance responses? If longer than one (1) week, will the due date for the Phase II response be extended accordingly?
Government Response
The government does not anticipate any delays in the review processes. We will act accordingly if the timeline needs to be adjusted.
58.
Solicitation Section/Subsection Number: 4.6 Task Management / Staffing Management
Question: Regarding the requirement to “assist its applicable proposed Contractor personnel with completion of VISA documentation and H1B sponsorship and processing fees”, can the government provide a historical average percentage of its contractor personnel who required VISAs and H1B sponsorship?
The visa status has been removed, please reference attachment 5, 8 & 9 which will be posted on Monday, September 18, 2023 to SAM.gov.
59.
Solicitation Section/Subsection Number: 4.6 Task Management / Staffing Management
Question: Regarding the requirement for a staffing plan, can the government provide a historical contractor FTE count over the last five (5) years for the primary centers at FDA, e.g., Center for Biologics Evaluation and Research, Center for Devices and Radiological Health, Center for Drug Evaluation and Research, Center for Food Safety and Applied Nutrition, Center for Tobacco Products, Center for Veterinary Medicine, National Center for Toxicological Research, Office of Regulatory Affairs, and Office of Operations?
60.
Solicitation Section/Subsection Number: Phase I – Volume 1: Past Relevant Experience RFP p. 122
Question:
With both the CMMI and ISO certifications utilized to achieve the same result, requiring both seems overly restrictive since acquiring and maintaining both certifications is costly to a small business and will severely limit the competition pool for a negligible increase in contractor capability. Would the government amend the language to require either a Capability Maturity Model Integration (CMMI) Level II or International Standardization Organization (ISO) 9001 & 20000 certifications, rather than both CMMI and ISO. This will allow for a wider range of qualified candidates for this opportunity.
Please reference questions 4
61.
Phase I – Volume 1: Past Relevant Experience RFP p. 122
Question:
We respectfully request the Government allow CMMI to be obtained within 6 months to one year after award.
Please reference questions 4
62.
Solicitation Section/Subsection Number: Overall Basis of Award RFP p. 130
Question:
The current past performance ceiling requirement of $35 Million would likely require 8(a) firms to partner/team/JV with a large business. We would respectfully request the Government lower the ceiling to $25 Million to allow maximum participation by small disadvantaged offerors.
No, the requirement stands at $35M
63.
Solicitation Section/Subsection Number: IDIQ RFP Section 2.3 Contract Type, Question: With several qualified 8(a)s primes with teaming/ partnership with other qualified companies having capabilities and corporate experiences to support this FDA Scientific Support IDIQ program, we believe it would be in government’s best interest to make this a multiple-award IDIQ, please. Considering the vastness of this IDIQ scope, the IDIQ ceiling value being $99.9M, we suggest that the government make at least four (4) awards.
The government intends to award to only one vendor.
64.
Solicitation Section/Subsection Number: IDIQ RFP Section 22. Instructions to Offerors, page 121, Paragraph 1
Question: How many qualified firms is the government considering notifying on the advisory down select? In other words, is there a minimum number of companies that FDA considering to down select and send the advisory notices to?
Government Response
The government will make this determination and notify the selected vendors who will advance to Phase II
65.
IDIQ RFP Section 22. Instructions to Offerors, page 123, Phase I- Volume I Evaluation Criteria, Paragraph 1(c)
Question: Since ISO 9001-2000 was already withdrawn by the International Standards Organization (ISO) and revised by ISO 9001-2008, we believe ISO 9001-2008 is acceptable.
Also, since the Phase I evaluation requires offerors to possess at least CMMI Level II and ISO certs, we believe the government is accepting the combined certifications of the “offeror” (prime and subcontractor team ).
Solicitation Section/Subsection Number: IDIQ RFP Section 22. Instructions to Offerors, page 123, Phase I- Volume I
66.
Evaluation Criteria, Paragraph “Complexity”
Question: The government staffing level provision of SMEs and requirement of more than
(10) labor categories as compared to the LCATs of the IDIQ SOW, and/or two or more concurrent orders is too restrictive for many qualified 8(a) firms. We request the government to remove this requirement.
Government Response
The government position is that a vendor must show they are capable of managing concurrent task orders with a minimum of 10 labor categories. To allow the government to evaluate the offerors experience with an objective degree of confidence. The criteria of 10 LCATS or concurrent execution of two more task orders is in-line with the level of equal value
67.
Solicitation Section/Subsection Number: RFP, Ordering Period 1: Period of Performance: 12 Months, Page 5
Question:
What does the government imply by Non-Visa Assistance Labor Hour Rate vs Visa Assistance Labor Hour Rate?
Government Response
Address and removed from all documents, please reference updated attachments. Updated documents will be posted to SAM.gov on Monday, September 18, 2023.
Solicitation Section/Subsection Number: RFP, 19. Privacy Language, Page 111
Question:
This section states: “It has been determined that this contract is subject to the Privacy Act of 1974, because this contract provides for the design, development, or operation of a system of records about individuals from which records are retrieved by name or other identifying particular,” and goes on to name a number of systems that the contractor will have access to,
68. such as employee Performance File System Records, Employee Medical File Systems Records, and so forth.
Can the government elaborate on how this requirement specifically ties to the Statement of Work?
All vendors must comply with the privacy act
69.
RFP, 22.0 Instructions to Offerors, Phase I: Volume I – Past Relevant Experience, Page 121-124
Question:
This requirement states: “The confidence rating is not intended to be a product of a mechanical or mathematical analysis of an Offeror’s performance on a list of contracts but rather a product of subjective judgements by the Government after is considers relevant information.”
Would the government provide more detail behind the subjective judgements of these ratings, given the PPQs do request clients to provide numerical ratings, and would the government consider providing a numerical rating scale for its evaluation?
No, the evaluations factors are already determined by the government.
70.
RFP, 22.0 Instructions to Offerors, Phase I: Volume I – Past Relevant Experience, Page 121-124
Question:
Is government planning to allocate points for high, some and low confidence ratings to assist in determining the Offerors chosen to receive down select notification? How will offerors with similar confidence ratings be weighed against each other?
No, refer to the previous question #69
71.
RFP, 22.0 Instructions to Offerors, Phase I: Volume I – Past Relevant Experience, Page 121-124
Question:
The RFP states: “A PPQ shall be submitted for each of the past examples cited. The Offeror shall send Attachment 6 Past Performance Questionnaire to each of the samples cited. Each reference must complete the PPQ and email an electronic copy to the contract specialist Howard S. Yablon at howard.yablon@fda.hhs.gov and cc the contacting officer Ian Weiss at ian.weiss@fda.hhs.gov by the proposal due date.”
Can you please confirm that the Offeror will be submitting the completed PPQ to the contract specialist/contracting officer for the referenced past relevant experience example?
Yes, this is confirmed v
72.

Question:
Can a subcontractors past experience be used for Phase I requirements? Specifically, 3 IDIQs/BPAs with >$35M ceiling and $10M in task order awards
Government Response
1 of the 3 past performances must be from the prime. The past performance can be as a sub-contractor so as long as the total awarded to the sub meets the amount as required.
73.
Solicitation Section 22.0 Instructions to Offerors/Phase I Volume I Evaluation Criteria (bottom of page 123 of 133)
Question:
Can a subcontractors CMMI and ISO certifications qualify if the prime is not yet CMMI and ISO certified?
74.
Question: Can the government provide the name of the current incumbent for this work?
75.
Question: Can the government provide the period of performance and total value of incumbent’s contract for this work?
76.
Question: Can the offeror use a subcontractor’s past performance for the past relevant experience?
