About this file
This document is a Justification for Sole Source Procurement under $250,000 for the Centers for Disease Control and Prevention (CDC) Division of Core Laboratory Services and Response. The CDC is seeking to award a sole source firm fixed price purchase order to Illumina, Inc. for annual maintenance, repair, and support services for Illumina's NovaSeq 6000 and MiSeq instruments. Illumina is the sole manufacturer and maintenance provider capable of providing the required direct/remote repairs, parts, and support services within the turnaround time needed to support outbreak studies and public health emergencies. The estimated procurement amount is $144,910.12. The CDC has determined that Illumina is the only reasonably available source due to the urgency of the requirement and the unique and highly specialized nature of the services. Interested parties may submit documentation of their capabilities by October 21, 2024, but the government retains sole discretion in determining whether to conduct a competitive procurement.

Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. D. Justification:
1. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency
☐ Exclusive licensing agreements/Proprietary data
☐ Brand name required
☐ Industrial mobilization
☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency
☐ Only One Source
☐ Logical Follow Up

2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
These instruments participate in standard laboratory operations as well as public health emergencies and require maintenance and immediate support to ensure performance. Rapid turn-around time on processing and repairs is essential to maintain the operational standards of these instruments. Direct repairs and support through the manufacturer of the instrument ensure the turnaround time required to support outbreak studies and public health emergencies. These instruments have been on illumina service contracts previously and maintaining the continuity of support is also important.
b. What other products/services were considered and why did they not meet the need?
The other available options are available through third parties. These are not acceptable due to the added timeline and the use of these instruments for outbreak response. Third parties must assess the needs and then contact the manufacturer for parts or additional investigation/assessment. This adds time and sometimes
Rev. 5/14/19 error to repairs as the manufacturer is not the primary contact. Service packages direct through the manufacturer also includes full coverage for parts, labor, and travel; Reagent replacement upon HW failures; 1 PM; Remote Technical Support; 2 business day on‐site response; control software and hardware updates; on‐ site applications support; reagent replacement; discounts on advanced training; and remote monitoring available. Remote support is extremely advantageous to resolve issues immediately when they occur.
3. Program Office efforts to seek potential offerors:
There are no other market sources of direct manufacturer support which includes all entities present in the silver plan direct from the manufacturer as listed above.
