About this file
This document contains a justification for a sole source procurement and a related federal contract opportunity notice. The Centers for Disease Control and Prevention intends to award a sole source purchase order to Revvity Health Sciences, Inc. for a gold plan preventative maintenance agreement on three specialized next-generation sequencing laboratory instruments. The two-year agreement will provide routine maintenance and emergency repairs for a SciClone G3 NGSx Workstation, Zephyr G3 NGS Workstation, and another SciClone G3 NGSx Workstation. These instruments require certified engineers and proprietary parts for consistent operation in supporting the agency's standard laboratory operations and emergency response efforts. Revvity is the only authorized source for maintenance and repairs. The contracting office has certified the sole source justification as accurate and complete.

☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency ☐ Exclusive licensing agreements/Proprietary data ☐ Brand name required ☐ Industrial mobilization ☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency ☐ Only One Source ☐ Logical Follow Up ☐ Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
This service maintains the operational readiness of highly specialized robotic liquid handling laboratory instruments. The instruments are central to our standard laboratory operations as well as public health emergencies including outbreak and high priority sample processing as well as surveillance efforts. We currently operate these instruments daily and cannot continue to perform our role for the agency if they stop working and repairs are not performed immediately. The instruments require regular maintenance by original equipment manufacturer (OEM) certified engineers and specific parts manufactured only by the OEM for consistent operation. This service agreement will ensure that our laboratory has access to these engineers and parts for routine maintenance and unexpected repairs within a timeline that will keep our lab operations running when instruments break down.
b. What other products/services were considered and why did they not meet the need?
Rev. 5/15/17
Revvity is the only approved source for new or remanufactured repair parts for these instruments. All repairs of these instruments must be performed by Revvity factory trained/certified engineers; the only source Revvity authorizes to provide service and installation for instrumentation manufactured and sold by Revvity. Any work performed on these instruments that is not done by engineers certified by the original equipment manufacturer will jeopardize our ability to keep these instruments running and therefore we did not consider third party vendors for this agreement. Any difficulties with the existing methods on these liquid handlers can only be addressed by Revvity engineers or program specialists.
3. Program Office efforts to seek potential offerors:
Given the highly specialized and technical nature of these instruments and the above justification, we are not seeking offerors outside of the OEM.
