| 1 | B.4 Fair Opportunity Process for CDC-placed orders | What is the intent of this language? | This clause was added to CDC’s vaccine contracts beginning with the 2023 Adult contract to explain the way that decisions are made about which vaccines are purchased. Specifically, orders are placed by CDC based on actual orders placed and submitted by providers. Those provider orders are in turn based on the following factors: vaccines and presentations identified by awardees and healthcare providers as clinically appropriate for their patients; recommendations by state-level medical vaccine advisory committees; and the level of federal and state vaccine funding available to each jurisdiction which incorporates the established contract prices. While manufacturers who currently contract with CDC are generally aware of this, new manufacturers are not and inclusion of this clause is meant to ensure all manufacturers have the same understanding. | |
| 2 | C.2.1 FAR 52.216-32 Task-Order and Delivery-Order Ombudsman (Sept 2019) | What is the intent of this language? | This clause is a required clause for multiple award IDIQ contracts. Given the fair opportunity process included in B.4, the need for the ombudsman is not anticipated. | |
| 3 | C.3.5 Place of Delivery | Will the Clermont, KY warehouse service all vaccines? Is this warehouse operating today? | CDC currently utilizes three depots for distribution (Olive Branch, Aurora, Clermont)—two for distribution of routine vaccines and a third (Clermont) that is currently used solely for the distribution of COVID-19 vaccines. Clermont was added to the clause to address the possibility of consolidation from three to two depots over the course of this contract. The timing for a possible consolidation has not yet been determined and may not occur during this contract, but we wanted manufacturers to be aware of the possibility. |
