Request for Proposal 75D301-18-R-67998 Amendment No. 1.
Questions and Answers.
1. The RFP states, “…offerors should prepare their proposals assuming that 3,120 dose reconstructions will be required each year (60 per week for 52 weeks).” And, “…(estimated at 3,000 dose reconstructions and re-works annually).” Please clarify the estimated number of dose reconstructions annually. Pgs. 5&8. Section C.3.
A.1-The offerors should prepare for a TOTAL of 3,120 dose reconstructions annually. This will include both initial and rework dose reconstructions combined.
2. The RFP States, “An inventory of the servers and summary of the personal computers that will be available is included under Attachments in Section J. However, the personal computers will be at or near their expected replacement time at the start of this contract, so the contractor should anticipate procuring replacement items during this contract.” Please clarify that, in addition to personal computers, eligible “replacement items” include other computer equipment such as servers, as listed in Attachment J. Pg.13, Section C 9.0.
A.2-“Replacement items” do include other computer equipment such as servers, as listed in Attachment J.
Pg.13, Section C.
3. The RFP states, “iii. Specifies the use of a disclosure statement (required by Section (e)(3) of the Privacy Act of 1974, as amended) to appear on documents used to PII from individuals to be maintained in a Privacy Act System of Records (SORN).” Please clarify the phrase, “…used to PII from individuals…” as there is a verb missing between “to” and “PII”. Pg.24. Section C.3.iii.Privacy Act.
A.3-The missing word is “obtain.” It should read “…used to obtain PII from individuals…”
4. The RFP states, “Federal Policies. The Contractor (and/or any subcontractor) shall comply with applicable federal laws that include, but are not limited to, the HHS Information Security and Privacy Policy (IS2P), [enter applicable OpDiv policy if any].” Please specify if there are there applicable OpDiv policies. Pg.26. Section L.
A.4-No OpDiv policy has been identified as applicable.
5. Section M.3.D states, “A brief narrative must be provided that explains the duties and responsibilities of all key staff, including direct technical supervisors, management supervisors, and technical staff…” Does the government define “key staff”, as listed in M.3.D, as “key personnel”? Please clarify. Pg. 93, Section M.3.D.
A.6-Key staff for this narrative would be as identified as Key Personnel listed in section M.3.D.
6. The current contract contains a provision that allows the contractor to pay exempt personnel for hours worked over 40 in a week. Will this clause be included in the new contract? If yes, does that imply that uncompensated time cannot be used as a means of reducing overall cost to the government? Pg. 80 Section L.6.
A.6 Under Section I.2, Page 61 insert the following:
I.6 FAR 52.222-2 Payment for Overtime Premiums (Jul 1990)
The use of overtime is authorized under this contract if the overtime premium does not exceed ($0) or the overtime premium is paid for work—
1. Necessary to cope with emergencies such as those resulting from accidents, natural disasters, breakdowns of production equipment, or occasional production bottlenecks of a sporadic nature;
Page 3. Continued from page 2.
2. By indirect-labor employees such as those performing duties in connection with administration, protection, transportation, maintenance, standby plant protection, operation of utilities, or accounting;
3. To perform tests, industrial processes, laboratory procedures, loading or unloading of transportation conveyances, and operations in flight or afloat that are continuous in nature and cannot reasonably be interrupted or completed otherwise; or
4. That will result in lower overall costs to the Government.
Any request for estimated overtime premiums that exceeds the amount specified above shall include all estimated overtime for contract completion and shall—
1. Identify the work unit; e.g., department or section in which the requested overtime will be used, together with present workload, staffing, and other data of the affected unit sufficient to permit the Contracting Officer to evaluate the necessity for the overtime;
2. Demonstrate the effect that denial of the request will have on the contract delivery or performance schedule;
3. Identify the extent to which approval of overtime would affect the performance or payments in connection with other Government contracts, together with identification of each affected contract;
and
4. Provide reasons why the required work cannot be performed by using multishift operations or by employing additional personnel.
(End of clause)
7. Are all technical and past performance evaluation criteria of equal weight or point value? Section M does not specify except to say that, when taken together, technical and past performance are significantly more important than cost. Section M.3, pg 91-94.
A.7 After the last paragraph under M.3 add the following: Criteria C and D are of equal importance and highest weight. Criteria B is weighted lower than Criteria C and D. Criteria A and E are of equal importance weighted lower than B.
Add M.5 Evaluation Process on page 94.
M.5 Evaluation Process
The Government will assess all responsible proposals against the solicitation requirements and criteria. The Government will use the criteria to make a "best value" determination. All evaluation factors other than cost or price, when combined, are more significantly more important than cost or price.
Criteria C and D are of equal importance and highest weight. Criteria B is weighted lower than Criteria C and D. Criteria A and E are of equal importance and weighted lower than B.
Past performance is weighted less than all technical criteria when combined, but more important than cost or price.
The Government will evaluate the Technical Proposal using the following adjectival rating.
Definitions:
-A strength is a quality or characteristic in the proposal that increases the probability of successful contract performance.
-A weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. A significant weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance.
-A deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
Page 4. Continued from page 3.
Ratings
Adjective Narrative Outstanding Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weaknesses. Risk of unsuccessful performance is very low.
Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements.
Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements.
Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Proposal is unawardable.
The Government will evaluate Past Performance using the following adjectival rating.
Adjective Description High Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Limited Confidence
Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Neutral No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
