D. Justification:
1. The justification for this non-competitive action is:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency
☐ Exclusive licensing agreements/Proprietary data
☒ Brand name required
☐ Industrial mobilization
☐ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency
☐ Only One Source ☐ Logical Follow Up ☐ Brand name required
2. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The Seresto tick collar, manufactured by Bayer Healthcare LLC, provides a unique formulation of acaracidic activity using two active ingredients imidacloprid and flumethrin. The combination of these chemicals provides fast acting and long lasting tick control labeled for 8 months of activity. This is the longest period of efficacy available on the market. The collar is impregnated with the chemicals in flexible plastic to allow for stability and durability in harsh climates such as Arizona and Mexico. The collar further allows for easy visualization of treated animals which are necessary for establishing community-wide treatment.
b. What other products/services were considered and why did they not meet the need?
Other acaricide topical products and tick collars include Scalibor collars (Deltamethrin-based) and Preventics collars (amitraz-based) which are labeled for 3- 6 months of activity, oral products including Nexgard and Bravecto, and topical treatments such as Frontline and K-9 Advantix were considered. These other products are labeled for 1-6 months of activity and are not as durable in UV-rich
Rev. 5/15/17 environments. Topical and oral applications are labeled for 1-3 months of activity and do not provide visible indication of treatment.
c. How does this product help achieve CDC’s mission?
CDC’s strategic priority #3 aims to better prevention leading causes of illness, injury, disability and death. This activity is one of the central projects being used to fulfill the Division of Vector Borne Diseases’ goal of implementing vector-borne disease diagnostics, surveillance, and control and prevention programs. To achieve this goal, and in response to a growing need and recent fatalities, DVBD is scaling up its activities relating to RMSF prevention on tribal lands. CDC, in partnership with federal, state, tribal and private partners will aim to eliminate fatalities from RMSF in Arizona tribal communities in the next 5 years through development and support of strong RMSF prevention programs. CDC personnel will provide significant technical assistance and programmatic support in order to achieve this goal. Use of long acting tick control products for free-roaming dogs is an essential component of integrated RMSF prevention in highly impacted communities of Arizona and Mexico. CDC will be on site providing technical assistance to two tribes during their September prevention campaigns.
3. Program Office efforts to seek potential offerors:
Conducted internet search for licensed acaricide products for dogs, available for non-veterinary application, looking for the longest lasting product activity.
