About this file
This document is a Justification for Sole Source Procurement under $250,000 for the Centers for Disease Control and Prevention (CDC) to acquire a P/ACE MDQ Plus Capillary Electrophoresis System from AB SCIEX LLC.
The justification states that the P/ACE MDQ Plus system is required to synthesize templates (synthetic oligos) at the CDC's Division of Core Laboratory Services and Response. It outlines the unique capabilities of the system, which include automated quantitative separation of charged and polar analytes, flexible modular design, and precise temperature control. The justification also notes that the CDC already owns an older MDQ system from the same manufacturer, allowing for a smooth transition. The total estimated procurement amount is $65,038.35. The CDC determined that AB SCIEX LLC is the sole manufacturer and distributor of this specialized equipment, meeting the criteria for a sole source procurement under FAR 13.106-1(b) and FAR 8.405-6.

Rev. 5/14/19
JUSTIFICATION FOR SOLE SOURCE PROCUREMENT (OPEN MARKET OR GSA)
UNDER $250,000
Sole source acquisitions may be used on a limited basis and only when the Contracting Officer’s Representative (COR)/Program Official has provided sufficient justification and the Contracting Officer has determined that the circumstances warrant such action. The content for a justification must contain detailed facts and rationale to justify the sole source acquisition. Soliciting from a single source must be done in accordance with FAR 13.106-1(b) or 8.405-6. At a minimum, the following information must be included:
Identification of Program Office, Contracting Activity, and Proposed Requirement, Justification and Program Office Certification:
A. Program Office:
Centers for Disease Control and Prevention Division of Core Laboratory Services and Response
NCEZID/DCLSR/ADBB
1600 Clifton Rd NE, Mailstop H23-12 Bldg 23, Room 12-435 Atlanta, GA 30329
B. Contracting Activity:
Centers for Disease Control and Prevention Office of Financial Resources Acquisition Branch II 2920 Brandywine Road, Mail Stop K-69 Atlanta, GA 30341
C. Identification of Requirement:
1. Nature of Action to be Approved by Contracting Officer:
a. Sole source acquisition:
This is a Sole source acquisition for the purchase of a new P/ACE MDQ Plus Capillary System that will be used daily to synthesize templates (synthetic oligos) at ADBB.
b. Procurement Request (PR) Number (if available): 000HCRHB-2024-87850
2. Proposed Vendor and Estimated Procurement Amount (if available):
a. Proposed Vendor:
AB SCIEX LLC
1201 Radio RD Redwood City
CA 94065-1217
b. Estimated Procurement Amount: $65,038.35
3. Is the requirement on GSA Schedule? ☒ Yes ☐ No
If yes, provide schedule number: GS-07F-0092X D. Justification:
☒ In accordance with FAR 13.106-1(b)(1), “only one source [is] reasonably available” which states that, “For purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). (ii) Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the documentation in paragraph (b)(1)(i) of this section only applies to the portion of the purchase requiring brand-name item. The documentation should state it is covering only the portion of the acquisition which is brand- name.”
☐ Urgency
☐ Exclusive licensing agreements/Proprietary data
☐ Brand name required
☐ Industrial mobilization
☒ Other (e.g., compatibility, space issues, continuity, compatibility, etc.)
☐ In accordance with FAR 8.405-6 “Limiting Sources” which states that, “the only circumstances that may justify the action are – (A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays; (B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or (C) In the interest of economy and efficiency, the new work is a logical follow-up to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original BPA must not have been previously issued under sole-source or limited-sources procedures.”
☐ Urgency
☐ Only One Source
☐ Logical Follow Up
☐ Brand name required
1. Other facts supporting sole source procurement:
a. What can this product/service do that other products/services cannot do?
The P/ACE MDQ Plus Capillary Electrophoresis System from AB SCIEX is a fully programmable and automated quantitative system for the separation of charged and polar analytes in a mixture. Innovative system design ensures dependable operation. and durability. Modular design provides for the simple interchange of detectors.
Optional modular detectors are available for future needs.
The P/ACE MDQ Plus includes:
High-resolution separation module
High-sensitivity UV/Vis detector module
High-speed system controller and with 32 Karat™ Software Version 10 running in a Win 7 environment providing instrument control, data acquisition and analysis
Built in auto-sampler and programmable array of 36 buffer pairs
Automated programmable methods and sample handling capabilities for walk-away operation Programmable multimode sample introduction; electro kinetic, pressure or vacuum Programmable internal fluidic system generates pressure or vacuum from -5 to 100 psi
Sample storage temperature control
Exclusive circulating liquid cooling system that precisely regulates capillary temperature
Direct control provides intuitive management of all system functions in real
Time installation Qualification (IQ1) and Operation Qualification (OQ1) of the system. System installation and training
Hence, this system can be used for a quick QC analysis of all synthetic DNA templates to be manufactured at the core facility to be utilized for outbreaks, kits and regular use.
b. What other products/services were considered and why did they not meet the need?
None, as this is the best MDQ Capillary system in the industry for our needs and has GSA approved pricing. The P/ACE MDQ Plus Capillary Electrophoresis System was initially manufactured by Beckman, but is now owned by AB-SCIEX, and is critical to our sample analysis because we need a modular detection system that allows for flexibility and quick analysis of the synthetic template oligos to be manufactured in the core facility that need to be released for outbreaks and kits. We already own the old MDQ from Beckman, hence it will be a smooth transition with no extra training.
This platform allows us to run single or batch samples and get results ASAP (within 10 minutes for individual oligos) for Quality Control of oligos. The P/ACE MDQ Plus is supplied with a UV (single wavelength detector) and has an efficient Temperature Control of capillary utilizing patented* cartridge design and recirculating liquid coolant which helps for running samples overnight without evaporating.
2. Program Office efforts to seek potential offerors:
We researched and compared other capillary systems on the internet, however, were unable to get something comparable to the AB SCIEX P/ACE MDQ Capillary System.
