| 2. Storage and Handling Requirements. Contractor is required to store Schedule II controlled substances in a vault and keep these products physically segregated in a separate space from non-controlled substances. Contractor will not have the capability to store all applicable Program Products that are Schedule II controlled substances in a vault in its Olive Branch Facility in order to meet the anticipated timelines of this Program, provided, however, these Program Products will be segregated by location and physical barrier that meets the qualifications of a Schedule 3-5 controlled substance cage as outlined in 21 CFR 1301.72(b) and under continual physical supervision by security guards and video. This arrangement may require an exemption or approval by the DEA and any applicable state authorities. Contractor is also required to keep documented records of all controlled substances in its facilities as part of its inventory maintained for the DEA, and will comply with this requirement. |
| Section D.3 includes provisions about storage of controlled substances (D.3.2) and shipment to contractor’s customers (D.3.3). These clauses seem more applicable to a contract for storage and distribution of controlled substances. Section D.2, however, indicates the contract is for procurement of pharmaceuticals to be delivered to the U.S. government. Can the agency confirm that it is not, at least via this solicitation, requesting the contractor to store and distribute pharmaceuticals? |
Has Government obtained any provisional agreement from or discussed the possibility of exemptions from requirements with DEA and / or state agencies?
Has Government successfully obtained such exemptions previously?
GOVERNMENT’S RESPONSE: This language should be removed. Appears to be a copy/paste error. Deleted.
