Section C: Justification for Soliciting from a Single Source or Brand Name

This is a commercial, sole source requirement for the following reasons. Due to the circumstances described herein, the activity requests authority to acquire CMM and Portable Arms HW/SW maintenance services using Other Than Full and Open Competition (OTF&OC) prescribed by FAR 6.302-1. Hexagon Manufacturing Intelligence, Inc. is the Original Equipment Manufacturer (OEM) and the provider for the CMXG assets: Brown and Sharpe Global P 12 30 10 - CMM (SN 0413-6605UA) and Romer Portable Arm #1 (SN 7525SI-2029-UC)/Arm #2 (SN 7540SI-2043-UC) with integral laser scanners--the maintenance services which includes MyCare Service Subscriptions: Essential, Premium, and Basic plans are detailed in section B. These measuring assets are stationed in the Coordinate Measuring Machine (CMM) Lab located in building 140/Room 17 at Robins, AFB. These measuring assets are specialized measuring equipment used to perform inspections of critical milled metal parts to determine if they meet customer(s) required dimensional tolerances. This reoccurring workload also include spot inspections for new parts, reverse engineering, and tech data.

Continuing the Hexagon MyCare maintenance service contract is critical to ensure annual preventative maintenance, the necessary ISO annual calibrations, and to enable CMXG to certify measurement reports for accuracy. Also, services includes technical support for equipment, annual calibration, and technical support for the associated PC-DMIS software. Another benefit is that the equipment/software are stand-alone and never connected the Robins 2K network which minimizes the need for IT support resources. In addition, the costs associated bundling HMA/SMA for multiple assets onto one contract are discounted whereas splitting these services for individual pieces of equipment

April 2021 Page 3 of 4 would possibly cost the government additional funding. Furthermore, with the added training benefit included with this requirement--equipment transfer to other agencies will provide the opportunity for new incoming users to utilize that training benefit which minimizes the need and the resources required to solicit additional OEM contracts and/or GPC purchases to meet that training requirement. These maintenance services are necessary to maintain the peak operating condition of the measuring assets which are necessary to meet the agency's mission requirements to support the warfighter and are required to maximize operation performance which reduces production downtime.

Without this maintenance services contract, these specialized assets would be deemed inoperable due to lack of maintenance which reflects mismanagement of government resources utilized for the purchase of these assets and associated services--these are assets that have not reach the "end of life" (EOL) span and must be maintained at maximum production capacity.

In review, the assets' MyCare repair processes are proprietary to the OEM. There is no other source available to accomplish the maintenance requirements for these assets. Choosing another product or source to service this specialized equipment would cause premature EOL and increased costs associated with significant research/ development and delayed maintenance response for eventual transfer and/or replacements which could impact productivity. The alternative of utilizing another source would cause reduced production lead times due to lack of equipment availability, increased cost estimated at $100K to seek other equipment/maintenance, and risking mismanagement of resources.

A letter dated on 05 JAN 2024 from Hexagon states that the OEM is the sole provider for for the CMM and Portable Arms maintenance and replacement parts (see attached OEM letter). Due to the reasons stated above, Hexagon Manufacturing Intelligence, Inc. is the only source to accomplish the annual maintenance services for the these assets.

OEM

Company Name: Hexagon Manufacturing Intelligence, Inc.

CAGE Code: 1WUK4 Business Type: Large

Section D: Efforts to Obtain Competition

Market research was performed by Internet searches and reviewing the Dynamic Small Business Search (DSBS) database using North American Industry Classification System (NAICS) code 811210 - Electronic and Precision Equipment Repair and Maintenance with keywords "measuring" and "portable arm". A review of 8(a), HUB Zone, Service Disabled Veteran Owned Business, and Women- Owned Small Businesses resulted in 64 sources (see DSBS query), however, the OEM states that there are no authorized resellers including GSA and NASA Sewp contracts for these maintenance services (see attached GSA Query and OEM letter). A 2-Git search identified 0 sources (see 2-GIT attachment). Other Mandatory Sources such as Ability One were considered but did not meet this requirement (see Ability One attachment). Therefore, Hexagon Manufacturing Intelligence, Inc. having the proprietary rights for their products is the only sources. In review, there are no other sources other than the OEM, Manufacturing Intelligence, Inc. that can provide the required services, HW/SW updates, and replacement parts for this acquisition.

Recommendation to award to the OEM, Manufacturing Intelligence, Inc., for this acquisition.

Section E: Steps to Preclude Future Single Source or Brand Name Awards

Provide a statement of actions to be taken by the requiring activity to preclude the necessity for future sole source or brand name acquisitions of the same supplies/services (e.g., conducting a market survey to determine potential future sources).

Section F: Contracting Officer's Determination

I have determined, in accordance with FAR 13.106-1(b)(1), that the circumstances of this contract action deem only a single source is reasonably available.
