RFTOP in the future during the period of 5 years?

Answer: No.

Question 2

Regarding the list of key personnel, is there a limit on the amount of personnel that may be subcontracted by the prime contractor?

Answer: At this stage, offerors are required to provide the key personnel as required in the solicitation. Offerors may list additional technical positions if their technical judgement determines that the proposed positions are required to cover all the disciplines provided in the solicitation.

Question 3

What is the definition of local organization and locally established organization?

Answer: The definition of “local entity” means an individual, a corporation, a nonprofit organization, or another body of persons that:

(1) Is legally organized under the laws of;

(2) Has as its principal place of business or operations in;

(3) Is majority owned by individuals who are citizens or lawful permanent residents of; and

(4) Is managed by a governing body the majority of who are citizens or lawful permanent residents of the country receiving assistance.

For purposes of this section, ‘majority owned’ and ‘managed by’ include, without limitation, beneficiary interests and the power, either directly or indirectly, whether exercised or exercisable, to control the election, appointment, or tenure of the organization's managers or a majority of the organization's governing body by any means.

If eligibility for award is restricted to local or regional entities, U.S. organizations may not submit an application for the award unless the program is re-advertised to provide unrestricted eligibility, allowing all U.S. organizations an opportunity to submit an application.

The definition of “locally established partner (LEP)” means a U.S. or international organization that works through locally-led operations and programming models. LEPs:

Have maintained continuous operations in-country for at least five years and materially demonstrate a long-term presence in a country through adherence or alignment to the following:

- Local staff should comprise at least 50% of office personnel,

- Maintenance of a dedicated local office,

- Registration with the appropriate local authorities,

- A local bank account, and

- A portfolio of locally-implemented programs.

Have demonstrated links to the local community, including:

- If the organization has a governing body or board of directors, then it must include a majority of local citizens;

- A letter of support from a local organization to attest to its work; and

- Other criteria that an organization proposes to demonstrate its local roots.

This solicitation is open to all local organizations and locally established organizations.

Question 4

RFP for any of the RFTOP?

Answer: Yes. However, during the five year ordering period, the IDIQ holders are required to seek approval from the Contracting Officer, for any changes to the approved key personnel and/or subcontractors regardless of whether a specific Task Order has been issued.

Question 5

Regarding paragraph H-2, where can we find document 22 CFR?

Answer: You could access the specific 22 CFR part 228 “Rules on Procurement of

Commodities and Services Financed by USAID” through an internet search. However, at this stage offerors will not be procuring any goods or services.

Once pre-qualified firms are selected under the IDIQ, are these firms obligated to participate in the second phase of the award? For example, if USAID has a need and our firm does not address that need, are we obliged to respond to the RFTOP?

http://www.fedbizopps.gov/

Answer: No, firms are not obligated to respond to every RFTOP; it is at the Offerors discretion to respond to a RFTOP.

Question 12 Can one organization partner with others?

Answer: Yes. Partnering is encouraged to strengthen the technical and corporate capabilities of the offerors.

Question 13

If a pre-qualified organization partners with a sub-contractor, what happens when the sub-contractor is not available?

Answer: IDIQ holders may request approval for replacing the initially proposed/approved sub-contractors. However, any new proposed sub-contractors must meet the IDIQ eligibility requirements.

Question 14

What’s the meaning of rate?

Answer: Offerors are required to provide the list of the proposed key personnel based on

Section C of the solicitation. Services considered under this solicitation could be implemented in any geographic area of Mozambique. Any RFTOP issued under the IDIQ will clearly specify the geographic areas where services are to be performed. Question 25

Cost Engineer and Specification Writer – also known as (aka) Quantity Surveyor: How do we approach this necessity according with “Key Personnel” in the conception of the professional attributions? According with the country’s general practice, there is a lack of specialty.

Usually the architects and engineers involved in the project will produce the specifications, as well as the related BOQ/Cost Estimates. These elements are then revised and incorporated in the final process. This kind of approach has proved to be accurate in our economic reality, in which we do not have a Quantity Surveyor figure, such as in the South African market.

Therefore, it is mandatory for this specialist to be included and subcontracted from abroad in order to comply with USAID Key Personnel requirements, or can we keep the experience already developed?

Answer: Architects and Engineers could be proposed for the roles of Cost Engineer and

Specifications Writers as long as the proposed individuals meet the experience requirements for the positions listed in the solicitation.

Question 26

Can a subcontractor be integrated in two or more different proposals?

Yes, USAID understands that specific A&E disciplines may have limited sources.

Section H.21, 4a) on page 51 of the solicitation. Branding and Marking Plans will only be required from the IDIQ holders.

Question 29

Do we have to be registered in SAM?

Answer: No, not at this stage. Only the selected IDIQ holders will be required to register in

SAM prior to receiving an award.

Question 30

Please provide information on environmental compliance requirement.

Or just the international company?

Answer: Please see the eligibility criteria as specified in page 89 of the solicitation.

Question 34

Could we use international company expatriates for some of the key staff positions?

Answer: Yes. The Offeror is responsible for ensuring that any proposed expatriates are legally able to work in Mozambique.

Answer: For the purpose of this solicitation, rates should be fully loaded rates with taxes, overhead and other indirect costs included in the rate. Please do not include travel, accommodation, per diem or other costs specific to a task order in the proposed rate. Travel, accommodation, per diem and other related costs will be proposed in response to issued

RFTOPs.

Question 38

Are the Proposers allowed to present more than one specialist for each discipline?

Answer: Offerors should propose one specialist for each key personnel position. However, for technical positions offerors may propose more than one specialist if they deem necessary.

Question 39

On Section B.6 regarding labor, there’s a list of labor categories required for the contract.

However, on Section F.7 regarding Key Personnel, a good number of the labor categories are not presented. Therefore:

a) Is the Proposer required to elaborate the proposal considering the Key personnel or the labor section, i.e., F.7 or B.6?

Answer: Offerors are required to provide the proposed key personnel based on the requirements set forth under section F.7. However, USAID understands that specific

A&E disciplines may have limited sources.

Question 41

Are organizations required to be internationally certified?

Answer: Eligibility criteria for participating in this solicitation are provided on page 89 of the solicitation.

Question 42

What if an organization has a sub-contractor and is pre-qualified for the IDIQ, but during the ordering period the services of the sub-contractor are not needed, what happens then?

Answer: There may be instances when a subcontractor’s services are not needed. Specific
