The purpose of Amendment No. 0001 to Request for Proposal (RFP) No. 72036723R00001 USAID Local Works Support is to:

1. Provide responses to questions submitted by prospective Offerors.

2. Add the following as the last paragraph of Section 1. Background and Purpose in SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK:

“None of the activities under this contract may include the use of the social networking service TikTok or any successor application or service of TikTok developed or provided by ByteDance Limited or an entity owned by ByteDance Limited, including any parent, subsidiary, affiliate or successor to ByteDance Limited.”

USAID Responses to Questions by Prospective Offerors:

General Questions:

1. Will the list of organizations to be served be provided prior to award or after award?

USAID Response: The list of local organizations to be served will be provided to the Contractor post award.

2. What is the tentative number of partner organizations involved in USAID Local Works Support?

USAID Response: USAID anticipates that 8 to 10 organizations will require support under the USAID Local Works Support award.

3. The statement of work doesn’t speak on the number of implementing partners that the contractor has to provide service and technical assistance. Can USAID provide the estimated number of implementing partners at this stage? This will help in financial proposal preparation.

USAID Response: USAID anticipates that 8 to 10 organizations will require support under the USAID Local Works Support award.

4. The terms ‘Local Actors’, ‘Local Partners’, ‘Local Organization’, and ‘Implementing Partners’ are interchangeably used in the RFP. Do they refer to the same as the “Local Actors”, or do we have different meanings for each term?

USAID Response: For the RFP purposes, the terms - local actors, locals orgs and local partners - are synonymous. "Implementing partners" is a term USAID uses for organizations that are awardees of USAID assistance awards. A local organization may be an implementing partner.

5. How will the activities supported by USAID Local Works Support be coordinated or interlinked with USAID Localization Support?

USAID Response: After the award is signed, USAID will discuss coordination with all pertinent activities, including USAID Localization Support.

Section L Questions:

6. Can three organizations partner up and form a team of applicant, or should one be the lead contractor and rest work as subcontractor?

USAID Response: Please adhere to FAR Part 9.601, which defines teaming arrangements as follows:

"Contractor team arrangement, as used in this subpart, means an arrangement in which-

(1) Two or more companies form a partnership or joint venture to act as a potential prime

USAID Local Works Support contractor; or

(2) A potential prime contractor agrees with one or more other companies to have them act as its subcontractors under a specified Government contract or acquisition program."

7. Could USAID please clarify whether section L.3 Limiting Competition on page 87 applies to the entire consortia bidding on this opportunity or only to the primes? In other words, does USAID prefer that consortia be comprised entirely of local entities, or is it open to international organizations participating as subcontractors?

USAID Response: USAID seeks that entities propose a consortium that enables them to best meet the USAID Local Works Support requirements and that adhere to the laws and regulations of the Government of Nepal.

8. Can we partner with an international organization such that we are the primary contractor, and international organizations are sub-contractors?

USAID Response: USAID seeks that entities propose a consortium that enables them to best meet the USAID Local Works Support requirements and that adhere to the laws and regulations of the Government of Nepal.

9. Is it only for the NGOs or can a profit-making company (with VAT registration) also be eligible to apply?

USAID Response: Section L.3 Limiting Competition (page 87 of the RFP) outlines the eligibility parameters of the RFP.

10. Is the offeror which has a Tax Clearance certificate of 2077/78 B.S. be eligible to apply? Or, must it have the tax clearance certificate of 2078/79 B.S.?

11. Is the ceiling price $ 1,989,000 is awarded to a single proposer or is it divided into many awards?

USAID Response: As per the RFP section L.5.a, USAID seeks to award one Time and Materials type contract in response to this RFP.

12. Can we get a Microsoft word file to submit the proposal?

USAID Response: As per the RFP section L.6. b, all submissions must be compatible with Adobe Acrobat (PDF) and Excel MS Office (2010 and later) in an MS Windows environment.

13. In this RFP, The total contract ceiling for this award is $1,989,000. Only one applicant will be

USAID Local Works Support selected from that contract ceiling ? or more.

USAID Response: As per the RFP section L.5.a, USAID seeks to award one Time and Materials type contract in response to this RFP.

14. Do Nepal based International Non-Governmental Organizations qualify as applicant?

USAID Response: Section L.3 Limiting Competition (page 87 of the RFP) outlines the eligibility parameters of this RFP.

15. Can we use the USAID projects as a Contractor's Past Performance Information?

USAID Response: Yes, Offerors may cite its previous work on USAID awards in accordance with Section L.7.7 of the RFP.

16. Can the consortium members participate in more than one consortium?

USAID Response: As stated in Section L.7.6 of the RFP, "USAID strongly discourages the use of exclusive agreements with organizations and key personnel as this limits USAID’s ability to receive the best services." As such, consortium members can be named in more than one consortium.

17. Can a proposal be submitted by a consortium or just a single entity?

USAID Response: Proposals may be submitted by either a consortium or a single entity.
