A.1 PURPOSE
The purpose of this award is to procure technical services to support the reform of the non-fiscal revenue system in Serbia.
A.2 CONTRACT TYPE
The contract type is hybrid: Firm Fixed Price (FFP) and Fixed Price, Level of Effort (FP LOE).
A.3 PERIOD OF PERFORMANCE
The period of performance for this contract is two years from date of contract award.
A.4 PLACE OF PERFORMANCE
The place of performance under this contract is Serbia.
A.5 STATEMENT OF WORK
A.5.1 BACKGROUND
USAID Serbia seeks to provide technical assistance to reform the non-fiscal revenue system of Serbia.
This system entails all non-tax levies, and the logical rationale behind the reform of this system is that non-tax levies should be:
- Paid only for usage of public goods or services;
- Set at a predictable level related to public costs arising from the usage of a public good or rendering a public service;
- Eliminated or transformed into a tax if paid without receiving the right to use the specific public good or public service in return.
According to the generally accepted definition, a non-tax levy becomes a "parafiscal" after it is determined that the level of the levy paid is not proportional to the public good or service received in return.
The Serbian non-tax levy system includes charges, fees, and mandatory membership fees. The USAID Support to Regulation of Para-fiscal Charges Project implemented from 2017-2019 focused on charges only and worked with the Ministry of Finance (MoF) on creating a transparent and effective platform for monitoring and managing charges. This work culminated with the new Law on Charges, adopted by the National Assembly of the Republic of Serbia on December 7, 2018, which entered into force on January 1, 2019. A comprehensive inventory of charges in Serbia has been developed as a part of this assistance.
Serbia’s system of charges is now regulated by one single law, and the overall impact of this reform is improved transparency and predictability for the private sector (when it comes to charges for the use of public goods) and at the same time, improvements in the efficient regulation and monitoring of charges for the ministry. Also, the new law establishes a platform that insists on three basic tenets of economic regulation: that there is an economic basis for payments; a legal basis for payments; and, a transparent calculation (assessment) of charges to be paid. The adopted changes significantly improved the transparency and predictability of the system of charges compared to the previous situation, where there were no efficient control mechanisms over different authorities introducing new charges or changing the levels of existing ones. Moreover, the new law established an effective system for the monitoring and administration of the system of public sector charges under the Ministry of Finance; no new charges may be introduced without a legislative amendment to the Law on Charges.
Simultaneously, a web-based registry1 of all non-tax levies has been developed, and it is ready to be used by the Ministry of Finance (MoF) both as an instrument for the monitoring and management of non-tax levies and as a valuable source of information for citizens and businesses.
However, as charges represent only a part of the non-tax revenue system, the completed project addressed only a part of the system and the issue of fees remains to be addressed. While the reforms undertaken by the GoS greatly improve the transparency and predictability of Serbia’s non-tax levy system, charges represent only a part of non-tax revenue. According to most recent data, of more than 1,000 non-tax levies that exist within Serbian regulation, more than 600 different fees are charged by different ministries and other national and sub-national government entities at the moment. While most of these fees are regulated by the Law on Republic Administrative Charges, many fees are regulated by more than 80 different laws as well as by-laws, and other decisions. The opacity, complexity and lack of predictability of the current system directly impacts the ability of Serbian firms to effectively manage their finances and legal obligations and plan for growth, thus diminishing the role Serbian private sector firms can and should be playing in catalyzing economic growth.
A.5.2 OBJECTIVES
The objective of the proposed activity is to continue to support reform of Serbia’s non-fiscal revenue system by engaging in the reform of the regulatory environment related to non-tax levies, aiming to not only complete the effective reform of the system of fees, but also to significantly improve the conditions for doing business in Serbia and contribute to Serbia’s further economic transition and growth. This project will not address charges, only fees.
The contractor will provide technical assistance and services, as described below, to help the Government of Serbia (GoS) and its Ministry of Finance in its stated intention to complete its reform of the non-tax revenue system. The overarching objective of the proposed activity is to improve the transparency, predictability, and rationality of Serbia’s system of charging businesses and citizens fees for various services, and thus to further improve the overall environment for doing business in Serbia.
The contractor must provide this assistance via the following activities:
1 http://parafiskali.rs/registar-neporeskih-nameta/
CLIN #001
(1) Analysis and Recommendations – The contractor must conduct a detailed analysis of the existing grounds for establishing and collecting fees, to include an analysis of all relevant regulations on the national and subnational levels as well as to develop a classification system efficiently capturing all relevant descriptive data. This must culminate with an inventory of all fees by classification to clearly present data including, but not limited to, the existing grounds for establishing and collecting fees, the amounts charged, and the level of usage right or service received in return for the payment of these fees.
The analysis must be followed with a set of recommendations regarding fees that should be eliminated or reduced, as well as recommendations on how to offset reductions in revenue due to reclassification.
Finally the contractor must, in coordination with Ministry of Finance, develop specific recommendations for institutionalizing proposed changes and institutionalizing a system to ensure the adequate transparency/reporting/oversight of fees, to include recommendations on strengthening the capacities of relevant authorities where needed.
(2) Public Consultations Outreach and Communications – The contractor must engage in outreach efforts to raise awareness of and promote the reform and its impact on the overall business environment in Serbia. Accordingly, the contractor must develop a communication strategy in support of project objectives as well as an implementation plan for outreach, and implement it during project implementation. The communication plan must clearly present target audiences, anticipated impacts and a plan for monitoring of these impacts.
(3) Web-based Registry and Recommendations – The contractor must update the existing web-based registry of charges and add all fees classified as per criteria elaborated under the first set of activities above (Analysis and Recommendations). Though this update, the Contractor also must identify and implement improvements to the updated registry so that it can best serve the Ministry to monitor both charges and fees independently and effectively after project conclusion.
The Contractor must make recommendations for/to the relevant authorities in the Ministry of Finance on how to incorporate guidelines for MoF for the establishment, operation, maintenance, and sharing of the registry within the MoF’s processes and procedures for managing and monitoring non-fiscal revenues. In other words, the recommendations must help MoF institutionalize and operationalize the web registry so that it becomes a normal government function that MoF and other ministries regularly use when adding or removing fees so that this information remains accessible, transparent, and reliable for all stakeholders.
CLIN #002
(1) Assistance - The contractor must provide high-quality, professional, and timely assistance in accordance with best practices in:
• The process of preparation of new regulation(s) for fees and of adequate amendments to all the laws which now address fees. This may include, but is not limited to: drafting regulations or amendments to existing laws; getting input and feedback from various stakeholders.
• Building the capacity of relevant authorities within the Ministry of Finance to manage the registry. This may include activities such as, but not limited to, data entry; web site maintenance; providing support to data entry staff from other ministries; and outreach efforts related to the registry.
The estimated requirement is 200 work days of LOE by the end of the period of performance. All staff engaged under this Activity must be qualified – possessing necessary linguistic, education, qualifications and expertise - to perform the technical aspects of the Assistance.
All Assistance activities / LOE undertaken shall be agreed upon with and performed in coordination with the USAID COR.
All activities must be undertaken in coordination with the Ministry of Finance. The contractor is responsible for all logistical and IT needs to perform the activities.
A.5.3 PERFORMANCE MONITORING FRAMEWORK AND RISK ASSESSMENT
A performance monitoring plan, with indicators corresponding with desired results must be developed by the successful bidder and submitted to USAID for COR approval within 30 days following award.
Illustrative indicators:
