Summary of RFI 720-5242
This is a Request for Information (RFI) issued by the Virginia Department of Behavioral Health and Developmental Services (DBHDS) regarding Assisted Living Facility (ALF) services for Sexually Violent Predators (SVPs) who have been placed on conditional release or are pending conditional release by the court. The RFI seeks to gather information about community-based resources capable of providing ALF placements, treatment services, facility modifications, and associated costs for this specialized population. The issue date is September 18, 2026, with responses due by October 22, 2026, at 2:00 PM local time through the eVA electronic submission system. Questions about the solicitation must be submitted by October 20, 2026, at 5:00 PM. There are no site visits or bidder's conferences specified. This RFI is explicitly not a solicitation for services and does not represent a commitment to procure; responding to this RFI is not a prerequisite for future proposal submissions.
Respondents should provide estimated costs for proposed services, though pricing will not be used for evaluation purposes. The RFI seeks to determine Medicaid eligibility and billing potential, with the Commonwealth interested in minimizing costs through insurance reimbursement. Facilities must be licensed by the Virginia Department of Social Services, located within Virginia, and comply with all federal, state, and local regulations. DBHDS is committed to increasing procurement opportunities for small, women-owned, and minority-owned (SWaM) businesses. The actual number of individuals referred for services will depend on client populations, needs, and available funding. Respondents must address experience with ALF services, SVP treatment plans, facility modifications, staffing structure, Medicaid billing experience, admission requirements, and any past civil litigation or regulatory sanctions.

DEFINITIONS / ACRONYMS
ACRONYM / KEY TERM MEANING / DEFINITION
Federally Qualified Health Centers (FQHC) Safety net providers that primarily provide services are typically furnished in an outpatient clinic. FQHCs include community health centers, migrant health centers, health care for the homeless health centers, public housing primary care centers, and health center program “lookalikes.” They also include outpatient health programs or facilities operated by a tribe or tribal organization or by an urban Indian organization. (Federally Qualified Health Center
Healthcare Organizations Entities such as hospitals, private practice, mental health clinics, dental practices, etc. provide some form of mental health care, primary care, and/or specialized care.
I. Introduction
This Request for Information (RFI) is to gather information; it is not a solicitation for services. The information received will be informative and may assist in planning. Nothing in this RFI should be construed as intent, commitment or promise to solicit or procure a solution. DBHDS is not at this time seeking proposals and will not accept unsolicited proposals. Any response to this RFI shall not be considered a pre-requisite to submitting a proposal for any subsequent procurement.
DBHDS will not be liable for any costs incurred by responding to this RFI. Respondents should not provide any confidential or proprietary information. Information submitted in response to this RFI will become the property of the DBHDS.
Respondent is asked to provide estimated cost within their response for such services described in their RFI response. However, such cost will in no way be used for evaluation or considered as a proposal of a solicitation. Following receipt of responses to this RFI, DBHDS may contact some respondents to schedule clarification meetings to gain additional understanding.
II. Purpose
To gather information to assist the Commonwealth in effectively analyzing the available resources, cost, procedures and challenges to obtain Assisted Living Facility (ALF) services for individuals found to meet the criteria as Sexually Violent Predators (SVPs) pursuant to Va. Code Section 37.2-900 et. seq. and suitable by the court of jurisdiction for conditional release and reside in the community.
The RFI should:
1. Discover community-based resources that may be able to meet the needs of this population.
2. Determine details of these resources including length of stay, level of service provided, location where treatment will be provided (home-based versus facility based) and physical adjustments to facilities that may be needed (i.e. locked doors).
3. Project cost (if any) to obtain those services as well as determine Medicaid eligibility.
III. Present Situation
The Commonwealth, led by the Department of Behavioral Health and Developmental Services in the Office of the Secretary of Health and Human Services, must assess the impact and cost of issuing a contract to provide Assisted Living Facility (ALF) placements to individuals found to meet SVP criteria and who have been placed by the court of jurisdiction on conditional release in the community or who are pending conditional release. The information received from RFI respondents will help in the development of the Commonwealth’s strategy for addressing these needs.
While some SVP individuals require intensive sex offender treatment in a secure facility operated by DBHDS called the Virginia Center for Behavioral Rehabilitation (VCBR), others whose risk of reoffending the courts determine can be managed in the community, are placed on conditional release with GPS and, through a contract between DBHDS and the DOC, are under the supervision of the Department of Corrections (DOC) supervising officers. SVP individuals on conditional release live and work in the community and comply with the requirements of the Virginia Sex Offender Registry. There are currently a number of SVP individuals both on conditional release and civilly committed who are aged or infirm or who have disabilities and who would benefit from placement in a residential setting to accommodate those needs. As the SVP census increases and the current population ages, we anticipate the number of individuals meeting these criteria will increase. DBHDS is in need of licensed facilities to address the concerns of this population. Many of these individuals will be eligible for Medicare and Medicaid reimbursement. DBHDS is also interested in the potential for these services to be covered by Medicaid, thus minimizing or eliminating any costs to the Commonwealth.
Any vendor selected to provide skilled medical services to this population shall work closely with the VA DBHDS Office of Sexually Violent Predator Services. The actual number of individuals referred for treatment in any given year is dependent upon client populations, needs, and available funding.
Desired Criteria for ALFs
1. The provider shall ensure that any facility where services are being provided maintains compliance with all federal, state and local regulations. The facility shall be located within the Commonwealth of Virginia.
2. The provider shall be licensed by the Virginia Department of Social Services and comply with all standards and regulations related to ALFs.
3. The provider shall ensure that all staff comply with federal, state and local requirements for licensure or certification.
4. The provider shall agree to work closely with DBHDS and DOC staff to ensure that the individual can adhere to their conditions of supervision and their SVP conditional release plan when applicable.
5. The provider shall maintain a system of data collection and management mechanisms for clear reporting to DBHDS.
