About this file
This document is a Justification for Other Than Full and Open Competition for the United States Coast Guard (USCG) to modify existing Regional Multiple Award Construction Contracts (RMACC II) across eight regions. The Coast Guard intends to extend the period of performance for these Indefinite Delivery Indefinite Quantity (IDIQ) contracts by up to 24 months and increase ordering capacity, with a total aggregate capacity increase of $430M. The modifications will maintain uninterrupted mission capability while the follow-on RMACC III contract is being competitively reprocured.
The contract modifications will impact multiple regions with different set-aside designations, including Small Business (SB), Service-Disabled Veteran-Owned Small Business (SDVOSB), and HUBZone contractors. The current contract ceilings will be increased in regions like Region 5 (from $300M to $435M) and Region 8 (from $125M to $175M). The contracts cover depot-level maintenance and general construction services for USCG facilities, including real property repair, marine construction, demolition, historical restoration, and remediation across various infrastructure types such as operations buildings, hangars, boat houses, and waterfront facilities.

JUSTIFICATION FOR OTHER THAN FULLAND OPEN COMPETITION
10 U.S.C. § 3204
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) 6.103 (FAR Class Deviation 25-11) and in accordance with the requirements of FAR 6.104 (FAR Class Deviation 25-11), the justification for the use of the statutory authority under FAR 6.103 (FAR Class Deviation 25-11) is justified by the following facts and rationale required under FAR 6.104-1 (FAR Class Deviation 25-11) as follows:
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), United States Coast Guard (USCG), Program Executive Office (PEO) – Shore, Office of Contracting and Procurement (CG-SHORE-C) proposes to enter into contract modifications on a basis other than full and open competition.
2. Nature and/or Description of the Action being Approved.
(a) Nature of the action: USCG intends to issue contract modifications to the existing forty-eight
(48) existing Indefinite Delivery Indefinite Quantity (IDIQ) Regional Multiple Award Construction Contracts (RMACC II), across eight (8) regions, to extend the period of performance for up to 24 months and to increase ordering capacity where needed. Currently the RMACCs are set to expire between 5/9/2026 to 9/19/2026. This action maintains uninterrupted mission capability while the follow-on RMACC III is competitively reprocured. The modifications do not change the scope, nature of work, or other terms and conditions of the contracts.
(b) Name and address of the contractor: See Appendix A: “RMACC II Current Contract List” for the names and addresses of all RMACC II multiple-award IDIQ holders in the affected regions.
(c) Type of action: Contract modifications to multiple-award IDIQ contracts.
(d) Estimated total value (including options): This action increases available ordering capacity (contract ceilings) for certain regions and extends ordering periods. Task order pricing remains at the order level and is competed among RMACC II holders. The estimated regional status and capacity adjustments are:
Region Set Aside Award Date Expiration Date

Note: This action modifies existing contracts; therefore, a base/option-year price schedule is not applicable. Task orders issued under RMACC II will continue to be priced and competed at the order level.
(e) Type of funding: Operations and Support funds. Task orders are funded at the order level, primarily via Coastal Shore Operations (CSO), historically referred to as AFC-43 (depot-level maintenance). Additionally, this extension supports use of Coast Guard Authorization Act of 2025 (H.R. 4275) which allocates $4.4B for shore infrastructure, training facilities and homeports.
(f) Year of funding: Fiscal Year 2025 (and subsequent fiscal years as task orders are issued during the extended ordering periods).
(g) Solicitation number: N/A (contract modifications to existing IDIQs; a new solicitation is not being issued for this action).
(h) Background information about the requirement: RMACC II is the USCG’s principal vehicle for depot-level maintenance and mission-critical construction across multiple regions. It enables rapid award of task orders for routine and emergency needs, supporting annual depot-level maintenance funding cycles, hurricane supplemental requirements, and execution of shore infrastructure priorities. The RMACC III re-procurement is underway, but source selection milestones do not align with RMACC II end dates. Currently, Phase One of the RMACC III pre-procurement due dates end February 2026, and the USCG anticipates Phase One completion by May 2026. Phase Two of the RMACC III re-procurement is anticipated to be completed in by January 2027 which necessitates an extension of RMACC II contracts.
Extending the ordering periods and increasing capacity of the RMACC II contracts will avoid gaps in capability and ensure continued fair-opportunity competition among RMACC II holders until RMACC III is awarded. It is anticipated that the RMACC III will replace the RMACC II if awarded prior to the end date of the RMACC II extensions.
3. Description of Supplies/Services.
RMACC II provides depot-level maintenance and general construction services for USCG facilities, with additional utilization by other DHS components. Task orders include real property repair and maintenance; general and marine construction; demolition; historical restoration; and remediation. Facilities include operations buildings, hangars, boat houses, firing ranges, residential and light commercial buildings (and their mechanical/electrical systems), site utilities, waterfront facilities, electronic surveillance/security construction, dredging, and airports/runways, along with other construction or related services that are similar in scope and required at the depot-level. Task orders may be design-build or design-bid-build, as appropriate.
4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. § 3204(a)(1), implemented by FAR 6.103-1 (FAR Class Deviation 25-11), “Only One or a Limited Number of Responsible Sources and No Other Supplies or Services Will Satisfy Agency Requirements.”
5. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the
Acquisition Require Use of the Authority Cited.
Pursuant to 10 U.S.C. § 3204(a)(1) implemented by the FAR Subpart 6.103-1 (FAR Class Deviation 25-11) entitled “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”), the Coast Guard seeks authority to issue resultant task orders and associated modifications under the existing RMACC II IDIQ contract without full and open competition. The exception applies for the following reasons:
(a) The RMACC II multiple-award IDIQ holders constitute the limited responsible sources capable of immediately performing depot-level maintenance and construction across the affected regions within the required timelines. Extending ordering periods and increasing capacity is necessary to avoid a capability gap while RMACC III reiteration is competitively reprocured. Task Orders will continue to be competed amongst the RMACC multiple awardees in accordance with the terms of the contract.
(b) Events leading to this situation and segmentation feasibility: RMACC III source selection milestones do not align with current RMACC II ordering period end dates. The required work is regionally distributed, time-sensitive, and funded in annual cycles. Segregating portions of the work to alternative vehicles is not feasible without substantial schedule risk and administrative burden, and the Government cannot compel other vehicles to accept projects outside their established task order ranges.
(c) Alternatives considered and why they are unsuitable:
• Competing discrete urgent requirements on open market: This would introduce significant delay and risk to the annual depot-level maintenance cycle and emergency response needs.
• Using other DHS/USCG construction vehicles: Available vehicles either lack appropriate regional coverage, socio-economic structures, or obligation ranges;
the RMACC II remains the Strategic Sourcing Vehicle for this class of acquisition for USCG/DHS.
• Pausing awards until RMACC III: This would create a gap in execution for mission-critical projects and jeopardize readiness. Accordingly, bridging RMACC II contracts is the only practical means to ensure continuity.
(d) Mission impact if not approved: Without the modifications, USCG risks insufficient contract capacity and expired ordering periods, resulting in delayed or canceled depot-level maintenance and construction projects, degraded mission readiness, and inability to timely execute annual and supplemental funding.
(e) Additional information (Only One or Limited Sources):
• Specific requirements: Timely execution of region-specific depot-level maintenance and construction tasks under established RMACC II scopes.
• RMACC II possess proven performance, vetted responsibility, regional mobilization, and bonding tailored to the RMACC II task order ranges.
• Extent of Government harm: Delays would impede maintenance cycles and emergency work, increasing lifecycle costs and operational risk.
6. Description of Efforts Made to Ensure that Offers are Solicited from as Many Potential
Sources as is Practicable.
This justification will be made publicly available on the System for Award Management
(SAM.gov) in accordance with FAR Class Deviation 25-11 for FAR Part 6 as required by 10 U.S.C. 3204(f) and 41 U.S.C. 3304(f). The public notification posting via SAM.gov will be provided within fourteen (14) days after implementation of the proposed action. The posting will inform industry of the Government’s intent to increase the RMACC II aggregate capacity.
7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.
The Contracting Officer determines that the anticipated prices will be fair and reasonable based on continued fair-opportunity competition at the task order level among RMACC II IDIQ holders, prior acquisition history for comparable depot-level maintenance and construction services, and established pricing practices under RMACC II. Individual task orders will be Firm Fixed Price and Contracting officers will continue to utilize price analyses consistent with FAR Part 15 (FAR Class Deviation 26-08), FAR 16.507 (FAR Class Deviation 26-04), and HSAM 3015 to ensure reasonableness.
8.Description of Market Research.
USCG reviewed the DHS Strategic Sourcing portfolio and existing DHS/USCG construction vehicles to identify viable alternatives for near-term depot-level maintenance and construction needs. The review confirmed that RMACC II is uniquely positioned to meet the distributed regional requirements and schedule constraints. Prior task order competitions under RMACC II provide relevant pricing history; this history, combined with continued fair-opportunity procedures, supports the determination that pricing will remain fair and reasonable.
9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.
(a) Technical documents and suitability: The existing RMACC II scopes, specifications, and ordering procedures are suitable for effective competition at the task order level; issuing modifications maintains the same framework and avoids disruption.
(b) Modification to enhance competition: This action extends ordering periods and increases capacity to maintain competition among multiple-award holders at the task order level until RMACC III is awarded.
10. A Listing of the Sources, if Any, that Expressed, in Writing, an Interest in the
Acquisition.
A notice of intent to issue a modification will be published in accordance with FAR 5.101 (FAR Class Deviation 25-17).
11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for Supplies or Services Required.
Actions to increase competition: USCG is executing the RMACC III competitive re-procurement. Aligning RMACC II extensions across regions will ensure an orderly transition to RMACC III, maximize competition at the task order level, and minimize any need for subsequent modifications.
