Amendment 0002 page 6 of 6
Question 1: reference clause (7) of the ATTCHMT 3 Continuation of Combined Synopsis, IS Rapid Gate still in effect?
Answer 1 to Q 1:
RapidGate is no longer required for access to Base Alameda. However, the below requirements apply. Upon award, Contractor will also be required to fill out the attached Access List to be verified by base and cutter security watch standers.
Those personnel that need access to the base, such as on-site personnel, including sub-contractors (including second and third-tier subcontractors) and suppliers, shall obtain TWIC identification and/or have an NCIC/III check completed. Please note that all costs associated with an NCIC/III check or obtaining TWIC identification is at the sole expense of the contractor.
In cases where a NCIC/III check is not practical or possible, or the contractor does not possess TWIC identification, the contractor/vendor must either present an acceptable form of identification, or have their identity verified by an authorized sponsor/escort, and be escorted at all times. The Real ID Act of 2005 established minimum security standards for license issuance and production and prohibits Federal agencies from accepting, for certain purposes, driver's licenses and identification cards from states not meeting the Act's minimum standards. Anyone requiring access to a military facility under this contract, to include subcontractors, who holds a driver's license from any state without approved licenses will be required to provide identification other than that driver's license to gain access. Government IDs annotated with "Federal Limits Apply" will not be accepted for access purposes. It is the responsibility of the Contractor to ensure that their personnel have federally acceptable personal photo identification and comply with any other requirements for base access
Question 2: regarding Attachment 3 Continuation of Combined Synopsis para 3. HSAR Clauses HSAR 3052.222-90 Local Hire is listed in the Combined Synopsis as well as 52.219-14 Limitations on Subcontracting. These two clauses make is almost impossible for a contractor outside of California to bid on this project. We are requesting HSAR 3052.222-90 be waived as per Section C for economic efficiency.
Answer 2:

(c) The Secretary of Homeland Security may waive the requirements of paragraph (a) the interest of national security or economic efficiency
Answer: In this case the unemployment at the BLS web site for CA is 3% and the National average per is 3.6%, so the use of CA labor isn’t enforced. https://www.bls.gov/web/metro/laummtrk.htm
