(End of Provision)
FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)
A contract will be awarded to the offeror determined to represent the best value to the Government. IAW FAR 15.101-1, the Government will determine best value using the tradeoff process. The tradeoff process will lead to an award decision that is made on the basis of trade-offs between the following price and non-price evaluation factors:
Volume I Factor 1:
Price
Volume II Factor: 2 Past Performance
Volume III Factor: 3 Technical Sub-Factor 1: Technical Data
Sub-Factor 2: Past Experience
Sub-Factor 3: Facilities
Sub-Factor 4: COTS
Sub-Factor 5: Incumbent Vendors
Sub-Factor 6: Quality Assurance Plan
Sub-Factor 7: Sample Production Plan
Selection and award will be based on the above evaluation factors. The technical subfactors are equal in importance. Technical and Past Performance are of equal importance and are each more important than Price. Technical and Past Performance, when combined, are significantly more important than Price. Thus award will be made to the quote that presents the best value, all factors considered, and may not necessarily be made to the lowest price quote.
FACTOR 1 PRICE
A price analysis will evaluate the total quoted price for all CLINs. Although price is not the controlling factor in award of a contract, it is an important factor and shall not be ignored. The degree of its importance will increase with the degree of the equality of the offers in terms of the other evaluation factors upon which selection is based. If competing offers are substantially equal in technical and relevant past performance, price may be the controlling factor in award.
The price shall represent the best price in response to the request for quote. The price shall be evaluated to determine fairness and reasonableness. Offerors are required to provide firm fixed-prices for all CLINs for the Base and all Option years. The total of all CLINs will be added together to arrive at an aggregate total which will be used for the trade-off evaluation. Award may be made without any type of discussions or negotiations. The Government reserves the right to award to other than the lowest-priced offeror.
Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
FACTOR II PAST PERFORMANCE
The Government will evaluate each Offeror’s Past Performance for quality and relevancy related to the services to be performed under the RFQ. These evaluations will result in an overall performance confidence assessment of the offeror's ability to perform the effort described in the RFQ. This assessment will represent the Government’s judgment of the probability of the offeror successfully accomplishing the proposed effort based on the offeror's demonstrated past performance history. Offerors who lack the requisite past performance contracts shall submit a statement indicating as such.
In evaluating offeror’s past performance, the Government intends to review Past Performance Information Retrieval System (PPIRS). General trends in an offeror’s performance will also be considered. Offerors lacking recent, relevant past performance history will receive a Neutral Rating for the Past Performance factor. The offeror will be evaluated neither favorably nor unfavorably on past performance.
Each offerors past performance will be evaluated according to the following ratings and will be assigned an overall Confidence rating as a result.
PAST PERFORMANCE QUALITY RATINGS
Rating
Description
Exceptional
Performance met contractual requirements and exceeded them to the Government’s benefits. The contractual performance being assessed was accomplished with no problems.
Very Good
Performance met contractual requirements and exceeded most to the Government's benefit. The contractual performance being assessed was accomplished with less than two minor problems for which corrective actions taken by the contractor appear or was effective.
Satisfactory
Performance met contractual requirements. The contractual performance being assessed contained more than two but less than five minor problems for which corrective actions taken by the contractor appear or was satisfactory.
Marginal
Performance did not meet contractual requirements. The element being assessed reflects a serious problem(s) for which the contractor has not yet identified corrective actions.
Unsatisfactory
Performance did not meet contractual requirements and recovery is not likely in a timely manner. The element being assessed contains a serious problem(s) for which the contractor’s corrective actions appear or were ineffective.
PAST PERFORMANCE RELEVANCE RATINGS
Rating
Description
Very Relevant
Past performance provided was essentially the same scope and size as the SOW.
Relevant
Past performance provided was similar in scope and size to the SOW.
Somewhat Relevant
Past performance provided was somewhat similar in the scope and size to the SOW
Not Relevant
Past performance provided involved little or none of the scope or size of the SOW
The overall confidence rating shall be assessed after the evaluation of the offeror’s quality and relevance of their past performance. This rating will be based on the offeror’s performance as it relates to the probability of successfully accomplishing the current proposed effort in accordance with the following:
PAST PERFORMANCE CONFIDENCE RATINGS
Rating
Definition
High Confidence
Based on the offeror’s performance record, the government has high confidence the offeror will successfully perform the required effort.
Significant Confidence

Little Confidence
Based on the offeror’s performance record, substantial doubt exists that the offeror will successfully perform the required effort.
No Confidence
Based on the offeror’s performance record, extreme doubt exists that the offeror will successfully perform the required effort.
FACTOR III TECHNICAL
The Government will evaluate each Offeror’s Technical Volume to determine the Offeror’s capacity to perform all the requirements outlined in the SOW, as well as the contractor’s provision of everything called for in all the Sub-Factors noted below.
The sub-factors are of equal importance. The overall Factor rating will be based on consideration of the sub-factor ratings and evaluations.
Sub-Factor 1, Technical Data: The Government will evaluate each offeror’s Technical Data document to determine that the requested information has been provided and is realistic.
Sub-Factor 2, Past Experience: The Government will evaluate each offeror’s Past Experience document to determine that the requested information has been provided and is relevant.
Sub-Factor 3, Facilities: The Government will evaluate each offeror’s Facilities document to determine that the requested information has been provided and adequate capacity has been shown.
Sub-Factor 4, COTS: The Government will evaluate each offeror’s COTS document to determine that the requested information has been provided and adequate capability has been demonstrated.
Sub-Factor 5, Incumbent Vendors: The Government will evaluate each offeror’s Incumbent Vendors document to determine that the requested information has been provided and is sufficient.
Sub-Factor 6, Quality Assurance Plan: The Government will evaluate each offeror’s Quality Assurance Plan document to determine that the requested information has been provided and is sufficient.
Sub-Factor 7, Sample Production Plan: The Government will evaluate each offeror’s Production Plan document to determine that the requested information has been provided and is sufficient.

PARTS
Because this is an open engineering requirement the Coast Guard is not specifying to contractors the specific parts needed; instead the Coast Guard expects vendors to propose/specify the parts they will need. If replacement of existing equipment is deemed necessary, the Contractor shall use COTS (Commercial Off-the Shelf) equipment and shall not use proprietary software or hardware.
DATA
With regard to data rights (i.e. all intellectual property including software, firmware, and associated documentation etc… developed for this contract shall become the property of the government).
