8.0 CONTRACTOR QUALITY CONTROL (QC) REQUIREMENTS.
8.1 In this contract the quality contract program is the driver for product quality. The contractor is required to develop a comprehensive program of inspections and monitoring actions. The first major step to ensuring a “self-correcting” contract is to ensure that the quality control program approved at the beginning of the contract provides the measures needed to lead the contractor to success. Once the quality control program is approved, careful application of the process and standards presented in the remainder of this document will ensure a robust quality assurance program.

9.0 GOVERNMENT QUALITY ASSURANCE (QA) REQUIREMENTS.
9.1 FUNDAMENTAL GOVERNMENT RESPONSIBILITIES: The Contract Officer’s Representative (COR) is responsible for representing the Contracting Officer for all facets of refuse collection, recycling and disposal service quality. The designated personnel will carry out inspections, reviews and approvals, handle deficiencies; and, ultimately accept on behalf of the Contracting Officer. The functions of the COR are identified in paragraphs 9.2 and 9.3 below. Government personnel, other than the Contracting Officer and the COR, from time to time, may observe the Contractor’s operations. However, these personnel may not interfere with Contractor performance
9.2 GENERAL QUALITY ASSURANCE FUNCTIONS: To facilitate the surveillance of the contractor’s quality control program by the Government, the COR will verify contractor compliance with designated performance requirements. In addition, for noncompliance and/or untimely corrective action to deficiencies of specific tasks, the contractor is subject to re-performance. With this intent, the surveillance approach may not be one that stays the same throughout the duration of the contract. The COR will periodically update the surveillance approach when the need arises. The COR will inspect the contractor’s QCP regularly for compliance with the requirements herein.
9.3 SPECIFIC QUALITY ASSURANCE FUNCTIONS: The COR will establish an Inspection Schedule using the Quality Checklists from the Contractor’s QC Program. The COR will perform the following quantitative and evaluative functions, which comprise the Government Quality Assurance Surveillance Plan (QASP):
(1) Carry out periodic inspections using the Quality Checklists to evaluate the contractor’s performance to ensure contract services are received. The COR will evaluate the contractor’s performance through intermittent on-site inspections of the contractor’s quality control program and receipt of complaints from base personnel. The COR may inspect each task as completed or increase the number of quality control inspections if deemed appropriate because of repeated failures discovered during quality control inspections or because of repeated customer complaints. Likewise, the government may decrease the number of quality control inspections if performance dictates. The government will also receive and investigate complaints from various customers located on the installation. The contractor shall be responsible for initially validating customer complaints. However, the COR shall make final determination of the validity of customer complaint(s) in cases of disagreement with customer(s).
(2) Report any findings resulting from these inspections to the Contractor/Contracting Officer.
(3) Perform monthly reviews of the contractor’s reports and records to ensure they adequately reflect the quantity of refuse disposed, materials recycled by commodity, and gross proceeds from recyclables sales.
(4) If discrepancies are discovered as a result of the periodic inspections, or any other means, use Contract Discrepancy Report (CDR) to communicate them to the contractor and follow up to ensure nonconformance are corrected.
(5) Meet with the Contractor’s Representative as agreed to or as often as necessary. The contractor and COR will sign the written minutes of these meetings, prepared by the COR. Any area(s) of non-conformance by the Contractor with the minutes must be specified in writing to the COR within 5 calendar days of receipt of the signed minutes.
(6) Perform annual and final Performance Evaluations
PERFORMANCE REQUIREMENTS SUMMARY
1. ELEMENTS OF THE PERFORMANCE REQUIREMENTS SUMMARY (PRS)
This PRS will be used to measure the Contractor’s performance and determine any applicable payment deductions from the Contractor’s monthly payment if the Contractor does not render satisfactory performance under the terms and conditions of the contract.
1.1 The absence from this PRS or any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the Government under any other provision of the contract, including the clauses entitled Contract Terms and Conditions –
Commercial Items (Inspection/Acceptance & Termination for Cause).
1.2 Column 1 lists the contract requirements considered most critical for satisfactory contract performance. The Government will measure contract performance in each of the various areas to determine the quality of performance and contract payment. Each service on the PRS will be evaluated in accordance with the established maximum allowable deviation from the requirement.
1.3 Column 2 provides the Standard of Performance of each required service
1.4 Column 3 shows the maximum allowable degree of deviation (AQL) from perfect performance for each requirement that shall be allowed by the Government before contract performance is considered unsatisfactory.
1.5 Column 4 identifies the method of surveillance the Coast Guard will use to evaluate the Contractor’s performance in meeting the contract requirements.
1.6 Column 5 shows the percentage of the contract price that each Standard of
Performance output listed in column 2 represents.
2. SURVEILLANCE METHODS
The Government may use a variety of surveillance methods to evaluate the Contractor’s performance. The Government may unilaterally change the type and frequency of inspections as it deems necessary. Valid customer complaints will not be added to the defective samples found under random or planned sampling for the purposes of deductions in contract payment. The methods of surveillance that may be used are
Random Sampling, Planned Sampling, Unscheduled Inspection and Customer
Comments. For the purpose of this contract, the word “sampling” is synonymous with the word “inspections.”
3. PERFORMANCE CRITERIA
The criteria for acceptable and unacceptable performance are as follows:
3.1 When the number of defects in the Contractor’s performance discovered by the
Quality Assurance Evaluator exceeds the allowable number of defects, the Government will issue the Contractor a Contract Discrepancy Report (CDR). The Contractor shall reply in writing by the suspense date explaining why performance was unsatisfactory, how performance will be returned to satisfactory levels and how recurrence of the problem will be prevented in the future.
3.2 The Contractor shall not be paid for unsatisfactory services in accordance with the standards set under this contract. If the Contractor is required to rework the services found by the Government to be unacceptable, it will be at his expense. Because the sample represents the entire work requirements, the rework of the defects found by the
Government shall not reduce the overall rating of that service.
4. PAYMENTS
The Contractor shall be paid for all work performed to the contract standards. Monthly payment will be reduced for unsatisfactory performance, using the following method.
4.1 Contractor performance will be compared monthly to contract standards and AQL, using the Quality Assurance Surveillance Plan (QASP).
4.2 If performance in any required service is unsatisfactory, and the poor performance was not caused by Government action, or lack of action, and the Contractor was not able to successfully re-perform the service in a timely manner, an amount of money up to the monthly line item price times the percentage stated in Column 5 of the PRS table, shall be deducted.
5. REDUCED PAYMENTS
Monthly payment to the Contractor will be reduced for unsatisfactory performance (three examples are provided below). When areas are not surveyed by sampling, a defect will not be counted when the service can be re-performed within a reasonable time frame.
5.1 Example of Payment Computation for Random Sampling
Assume an AQL of 4 defects per month for Level I Service a lot size of 450 units, a resulting sample size of 50 units, and that 10 defects were found by the QAE.
The payment would be as follows:
(1) Maximum contract payment per month $10,000
(2) Maximum payment percentage for the service
(Column 5, PRS Table) x 28.32%
(3) Maximum payment for acceptable service $2,832
(4) 10 defectives exceeds AQL
(5) Percentage of sample found unacceptable=20%
(10 defects divided by 50 samples = 20%)
(6) Percentage of sample found acceptable
(100% minus Line 5)
(7) Credit for sample defective corrected = (1 defect corrected)
(defects in sample corrected divided by lot size, then multiplied by 100) or (1 divided by 450X100) = 2.2%
(8) Acceptable percentage 82.2%
(Line 6 & 7)
(9) Payment for percentage of acceptable services $2,328
5.2 Payment Computation for Services Not Surveyed by Sampling For services surveyed by periodic inspection, or customer complaint, the maximum payment percentage for the service (column 5, PRS table) is multiplied by the percentage of the lot found acceptable. The resulting percentage is the percentage of the monthly contract price that the Contractor will be paid for the listed service. The total number of defectives found, not just the defects in excess of the AQL, are used to determine the percentage of the lot found unacceptable. The percentage of the lot found unacceptable subtracted from 100 percent determines the percentage of the lot found acceptable.
5.3 Example of Payment Computation for Services Not Surveyed by Sampling:
In the area of management responsibilities, the AQL is 10 defects per month, the lot size is for example a lot size of 216 units (48 opportunities for on site supervision, 2 shifts x
24 weekdays) + (24 opportunities for training, 1x24 weekdays) + (48 opportunities for
Quality Control, 2 shifts x 24 weekdays) + (48 opportunities for Conservation of utilities, 2 shifts x 24 weekdays), and that fifteen defects were found.
The payment would be computed as follows:
(1) Maximum contract payment per month $10,000
(2) Maximum payment percentage for the service
(Column 5, PRS Table) x 7%
(3) Maximum payment for acceptable service $700
(4) 15 defects exceeds AQL
(5) Percentage of lot found unacceptable =
(15 defects divided by 216 units = 6.94%) 7%
(6) Percentage of lot found acceptable =
(100% - line 5) 93%
(7) Payment for percentage of lot found acceptable service
(Line 3 x Line 6) $651

Contract. It is provided to the Contractor solely for informational purposes and is subject to change by the Government at any time during the contract performance period. Therefore, the Government reserves the right to perform more or less surveillance than is provided in this QASP.
2. Introduction: The QASP establishes a method to evaluate the services the Contractor is required to furnish. It is designed to provide an effective method of monitoring Contractor performance for each listed objective on the Performance Requirements Summary (PRS) in the contract. The Government is concerned with the quality of the services provided, and not with the method that the Contractor uses to provide these services. If performance of any required service is unsatisfactory as a result of the Contractor's actions or omissions, then the
Government may reduce the contract payments to reflect the decreased value of the services received in accordance with the PRS and/or applicable FAR clauses.
3. Responsibility for Quality Control: The Contractor, not the Government, is responsible for quality control and management actions to meet the terms of the Contract. The Government performs quality assurance to monitor whether Contract standards are achieved.
4. Surveillance Methods: The Government will evaluate the Contractor's performance under this contract. Government surveillance may include, but is not limited to, the following methods:
a. Inspections.
b. Customer complaints with COR verification.
5. Deduction Methods: The Government will record all instances of substandard performance, whether through inspections, direct observation, customer complaint, or any other mechanism. The Government's preferred course of action will be discussions with the
Contractor to make the Contractor aware of the problem, and to effectively prevent any recurrence of substandard performance. However, the Government may also take the following actions in addition to, or instead of, discussions with the Contractor:
a. Presentation of a Contract Discrepancy Report requiring a written explanation for substandard performance;
b. Payment deductions in accordance with the PRS; and/or
c. Payment deductions in accordance with the applicable FAR clause(s).
