QUALITY ASSURANCE SURVEILLANCE PLAN

QUALITY ASSURANCE SURVEILLANCE PLAN (QASP)

REFUSE & RECYCLING COLLECTION & DISPOSAL

SERVICES FOR AIRSTA BORINQUEN AND THE

RAMEY SCHOOL, PUERTO RICO

1.0 Purpose

This Quality Assurance Surveillance Plan (QASP) describes methods that the Government will use to monitor whether the Contractor’s performance of the Contract is acceptable. The QASP is the

Government’s written plan for administering the Contract and monitoring major aspects of the

Contractor's performance. The QASP is not part of the Contract. It is provided to the Contractor solely for informational purposes and is subject to change by the Government at any time during the contract performance period. Therefore, the Government reserves the right to perform more or less surveillance than is provided in this QASP.

2.0 Introduction

The QASP establishes a method to evaluate the services the Contractor is required to furnish. It is designed to provide an effective method of monitoring Contractor performance for each listed objective on the Performance Requirements Summary (PRS) in the Contract. The Government is concerned primarily with the quality of the services provided and not with the method that the Contractor uses to provide these services. If performance of any required service is unsatisfactory as a result of the

Contractor's actions or omissions, then the Government may reduce the Contract payments to reflect the decreased value of the services received in accordance with the PRS and/or applicable FAR clauses.

3.0 Roles and Responsibilities of Government Representatives

3.1 Contracting Officer

The Contracting Officer has full authority to enter into, administer, or terminate contracts and make related determinations and findings on behalf of the Government. The Contracting Officer ensures performance of all necessary actions for effective contracting as well as ensures compliance with the terms of the contract and safeguards the interests of the Government in the contractual relationship.

The Contracting Officer assures the Contractor receives impartial, fair, and equitable treatment under the contract. The Contracting Officer is ultimately responsible for the final determination of the adequacy of the Contractor’s performance.

3.2 Contract Specialist

The Contract Specialist administers all aspects of the contract and will be the Contractor’s primary point of contact for all contract related matters. The Contract Specialist will also be responsible for the day-to-day monitoring of the Contractor’s performance in the area of contract compliance, contract administration, cost control and reviewing the COR’s assessment of the Contractor’s performance.

3.3 COR

The COR is the Contractor’s primary point of contact for all technical items related to the contract and is responsible for the administration of this surveillance plan. The COR is responsible for monitoring, assessing, and communicating the technical performance of the Contractor and assisting the Contractor. The COR will inspect the Contractor’s QCP regularly for compliance with the requirements herein.

3.4 Responsibility for Quality Control

The Contractor, not the Government, is responsible for quality control and management actions to meet the terms of the Contract. The Government performs quality assurance to monitor whether Contract standards are achieved.

3.5 Surveillance Methods

The Government will evaluate the Contractor's performance under this Contract. Government surveillance may include, but is not limited to, the following methods:

a. COR Inspections; and/or

b. Customer complaints with COR verification.

c. Random Sampling

3.6 Deduction Methods

The Government will record all instances of substandard performance, whether through inspections, direct observation, customer complaint, or any other mechanism. The Government's preferred course of action will be discussions with the Contractor to make the Contractor aware of the problem, and to effectively prevent any recurrence of substandard performance. However, the Government may also take the following actions in addition to, or instead of, discussions with the Contractor:

a. Presentation of a Contract Discrepancy Report (CDR) requiring a written explanation for substandard performance;

b. Payment deductions in accordance with the PRS; and/or

c. Payment deductions in accordance with the applicable FAR clause(s).

4.0 PERFORMANCE REQUIREMENTS SUMMARY (PRS)

This PRS will be used to measure the Contractor’s performance and determine any applicable payment deductions from the Contractor’s monthly payment if the Contractor does not render satisfactory performance under the terms and conditions of the contract.

4.1 The absence from this PRS or any contract requirement, however, shall not detract from its enforceability or limit the rights or remedies of the Government under any other provision of the contract, including the clauses entitled Contract Terms and Conditions – Commercial Items

(Inspection/Acceptance & Termination for Cause).

4.2 Column 1 lists the contract requirements considered most critical for satisfactory contract performance. The Government will measure contract performance in each of the various areas to determine the quality of performance and contract payment. Each service on the PRS will be evaluated in accordance with the established maximum allowable deviation from the requirement.

4.3 Column 2 provides the Standard of Performance of each required service

4.4 Column 3 shows the maximum allowable degree of deviation (AQL) from perfect performance for each requirement that shall be allowed by the Government before contract performance is considered unsatisfactory.

4.5 Column 4 identifies the method of surveillance the Coast Guard will use to evaluate the Contractor’s performance in meeting the contract requirements.

4.6 Column 5 shows the percentage of the contract price that each Standard of Performance output listed in column 2 represents.

5.0 SURVEILLANCE METHODS

The Government may use a variety of surveillance methods to evaluate the Contractor’s performance.

The Government may unilaterally change the type and frequency of inspections, as it deems necessary.

Valid customer complaints will not be added to the defective samples found under random or planned sampling for the purposes of deductions in contract payment. The methods of surveillance that may be used are Random Sampling, Planned Sampling, Unscheduled Inspection and Customer Comments. For the purpose of this contract, the word “sampling” is synonymous with the word “inspections.”

6.0 PERFORMANCE CRITERIA

The criteria for acceptable and unacceptable performance are as follows:

6.1 When the number of defects in the Contractor’s performance discovered by the Quality Assurance

Evaluator exceeds the allowable number of defects, the Government will issue the Contractor a Contract

Discrepancy Report (CDR). The Contractor shall reply in writing by the suspense date explaining why performance was unsatisfactory, how performance will be returned to satisfactory levels and how recurrence of the problem will be prevented in the future.

6.2 The Contractor shall not be paid for unsatisfactory services in accordance with the standards set under this contract. If the Contractor is required to rework the services found by the Government to be unacceptable, it will be at his expense. Because the sample represents the entire work requirements, the rework of the defects found by the Government shall not reduce the overall rating of that service.

7.0 PAYMENTS

The Contractor shall be paid for all work performed to the contract standards. Monthly payment will be reduced for unsatisfactory performance, using the following method.

7.1 Contractor performance will be compared monthly to contract standards and AQL, using the Quality

Assurance Surveillance Plan (QASP).

7.2 If performance in any required service is unsatisfactory, and the poor performance was not caused by

Government action, or lack of action, and the Contractor was not able to successfully re-perform the service in a timely manner, an amount of money up to the monthly line item price times the percentage stated in Column 5 of the PRS table, shall be deducted.

8.0 REDUCED PAYMENTS

Monthly payment to the Contractor will be reduced for unsatisfactory performance.

8.1 Payment Computation for Services Surveyed by Periodic Inspection or Customer Complaint

For services surveyed by periodic inspection, or customer complaint, the maximum payment percentage for the service (column 5, PRS table) is multiplied by the percentage of the lot found acceptable. The resulting percentage is the percentage of the monthly contract price that the Contractor will be paid for the listed service. The total number of defectives found, not just the defects in excess of the AQL, are used to determine the percentage of the lot found unacceptable. The percentage of the lot found unacceptable subtracted from 100 percent determines the percentage of the lot found acceptable.
