SUMMARY OF CHANGES

For Solicitation Number 70Z080-18-Q-13003B00 Several questions were presented during the solicitation period. Below are the questions asked, answers to those questions and change(s), if any, that were made as a result of the question.

Question 1: Are parts to be overhauled onboard vessels or will they be shipped?

Answer: The equipment to be repaired will be shipped to the contractor’s facility, see “Place of Contract Performance” on page 4 of the solicitation.

Change: No change was required as a result of this question.

Question 2: Are there CLINs missing between CLIN 0004 and 0007 on the Schedule of Supplies/Services and Prices/Costs?

Answer: No. The CLIN numbering has been corrected.

Change: A revised Schedule of Supplies/Services and Prices/Costs in the solicitation and Attachment 3 have been posted.

Question 3: Does the Schedule of Supplies/Services and Prices/Costs list all of the equipment to be repaired? It looks like equipment is missing due to the missing CLIN numbers.

Answer: Yes. The list of Government Furnished Property to be provided to the contractor for overhaul under this requirement is listed in the Solicitation on page 38.

Change: No change was required as a result of this question.

Question 4: Can a large business submit a quote for this requirement even if it is a total small business set-aside?

Answer: The quote will not be able to be considered.

Change: No change was required as a result of this question.

Question 5: Why is this requirement a total small business set-aside?

Answer: The nonmanufacturer rule does not apply to service contracts, which allowed the requirement to be set-aside for small business.

Change: No change was required as a result of this question.

Question 6: What controls the Set Aside restrictions?

Answer: FAR 19.502-2 Total Small Business Set-Asides provides the total small business set-aside regulations:

"(a) ... Each acquisition of supplies or services that has an anticipated dollar value exceeding $3,500 ($20,000 for acquisitions as described in 13.201(g)(1)), but not over $150,000 ($750,000 for acquisitions described in paragraph (1) (i) of the simplified acquisition threshold definition at 2.101), is automatically reserved exclusively for small business concerns and shall be set aside for small business unless the contracting officer determines there is not a reasonable expectation of obtaining offers from two or more responsible small business concerns that are competitive in terms of market prices, quality, and delivery

(b) Before setting aside an acquisition under this paragraph, refer to 19.203(c). The contracting officer shall set aside any acquisition over $150,000 for small business participation when there is a reasonable expectation that-

(1) Offers will be obtained from at least two responsible small business concerns offering the products of different small business concerns (see paragraph (c) of this section); and

(2) Award will be made at fair market prices

(c) For small business set-asides other than for construction or services, any concern proposing to furnish a product that it did not itself manufacture must furnish the product of a small business manufacturer unless the SBA has granted either a waiver or exception to the nonmanufacturer rule (see 19.102(f)). ..."

13 CFR 121.406 further provides that:

... "(4) The nonmanufacturer rule applies only to the supply component of a requirement classified as a manufacturing, supply, or ITVAR contract. If a requirement is classified as a service contract, but also has a supply component, the nonmanufacturer rule does not apply to the supply component of the requirement."

I hope this gives you a better understanding of total small business set-asides and how the nonmanufacturer rule works when services are involved. Normally a requirement is set-aside for small business if offers/quotes are expected from 2 or more small businesses. If offers/quotes are not expected from 2 or more small businesses, then the requirement is normally not set-aside for small business. This determination is normally done on a requirement by requirement basis.

Change: No change was required as a result of this question.

Question 7: Mandatory replacement parts are only listed for the turbochargers. Can you supply mandatory list for the other components?

Answer: There are no mandatory replacement parts listed for the other components. The vendor will need to inspect and replace the parts that need replacing based on their parameters.

Change: No change was required as a result of this question.
