LIMITED SOURCE JUSTIFICATION
70Z07919FPT207200
This acquisition is conducted under the authority of Section 201 of the Federal Property and Administrative Services Act of 1949 (40 U.S.C.501) Multiple Award Schedule Program FAR 8.401 and is justified by the following facts and rationale required under 8.405-6(b)(1) as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), U.S. Coast Guard (USCG) Telecommunication and Information Systems Command located at 7323 Telegraph Road, Alexandria, VA 20598-7320.
(2) Nature and/or description of the action being approved.
It is the intent of the U.S. Coast Guard to award a limited source, brand name BPA Call under the DHS Enterprise Software Solutions (ESS) Enterprise License Agreement (ELA) Blanket Purchase Agreement (BPA), to procure existing brand name specific Symantec NetBackup software for continued licensed maintenance support. Only the parent company of Symantec or one of its resellers can provide the license maintenance support. On the DHS ESS ELA BPA, only one of the vendors, UNICOM Government Inc., is an authorized reseller of Symantec license maintenance support. Thus, award must be made to UNICOM Government Inc. on a brand name basis.
(3) Description of Supplies/Services.
The USCG requires the acquisition of license and maintenance subscriptions/support for existing and new upgrades for Symantec licensed software. This enterprise licensing maintenance subscription provides the Coast Guard access to technical support, upgrades normally provided under maintenance/support, delivered under Symantec via UNICOM current Technical Services Support Policy and Terms.
Symantec NetBackup software provides various robust products that offer a variety of features which are designed to speed backup and recovery and integrate backup with additional processes. Accelerator features reduce the time needed to complete a backup by eliminating the scan to determine file change percentages, maximizing client-side duplication, and then building a full backup image. NetBackup can search through an entire backup for any information needed for electronic discovery and compliance, places legal holds on the files to prevent expiration. Protects sensitive information and ensure compliance centrally by encrypting endpoints, files and emails for system with requirements throughout the Coast Guard. The estimated amount for this award is $619,991.64.
(4) Identification of the justification and the rationale.
This acquisition is being conducted under the authority of the Multiple Award Schedule Program in accordance with FAR 8.405-6(b), Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
The US Coast Guard requires Symantec license maintenance support for Symantec NetBackup.
Symantec is a brand name item peculiar to one manufacturer. Symantec software is currently utilized throughout the Coast Guard Infrastructure. Symantec is the only source that can provide upgrades and security patches for Symantec software products. Symantec Software and updates are required for continued operations and licensing/maintenance services/support. Failure to maintain system support, upgrades or software patches will expose system vulnerabilities and result in them being disconnected from the network and will eventually results in backup and recovery data loss and complete system failure.
Although there are authorized resellers, there is only one on the DHS ESS ELS BPA, which is a mandatory source. The BPA was competitively awarded against Federal Supply Schedule holders.
UNICOM is the only authorized Symantec NetBackup software reseller on the BPA and award must be made to UNICOM on a brand name basis.
(5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d).
The Contracting Officer determines that anticipated pricing will be fair and reasonable based on previously competed Symantec Product Support and Maintenance in the award of HSHQDC-11-A- 00042. The General Services Administration (GSA) has already negotiated fair and reasonable pricing.
The DHS BPAs have negotiated additional discounts to the GSA schedule prices and those prices were determined fair and reasonable. The Contracting Officer will also perform a price analysis to determine that the price at the time of award is fair and reasonable and is consistent with the BPA and contract terms.
(6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was conducted amongst the holders of the DHS ESS ELA BPA to determine if any vendor is an authorized Symantec reseller. It was determined that UNICOM is the one vendor capable of meeting the requirement under BPA HSHQDC-11-A-00042. The BPA is mandatory in accordance with Directive 060-01. The BPA discounts are deeper than those available on the GSA.
(7) Any other facts supporting the justification.
None.
(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.
Currently, Symantec is proprietary and used on the USCG network. The Coast Guard will continue to utilize any mandatory DHS strategic vehicles or authorized resellers off other vehicles to meet the requirement in order to ensure competition. The USCG will continue to utilize competition for Symantec products and will continue to research the industry for alternative products/solutions that would provide like services that integrates successfully within desktop and server application capabilities for continued enhancements, scalability and manageability as requirements allow.
(9) Contracting Officer’s Certification.
In accordance with FAR 8.405-6(c)(2)(ix), I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Richard J. Murphy Date Contracting Officer
(10) Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
