Factor 2 – Price

1.) Vendor's price shall represent the best price in response to the RFQ. The price shall be evaluated to determine fairness and reasonableness. Vendors are required to provide prices for all items/CLINs in accordance with the Schedule of Supplies/Services.

1a.) Schedule of Supplies and Services:

a.) To be filled out with a cost associated for each Definite CLIN and Option(s) CLIN with an overall total submitted on an Excel spreadsheet.

b.) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

1.1 Price Reasonableness

Price analysis techniques may be used to further validate price reasonableness. If adequate price competition is not obtained or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information will be required to support the proposed price.

1.2 TOTAL EVALUATED PRICE: The aggregate price determined by totaling the offer price for Definite Items, plus offer price for Option Items, plus foreseeable cost factors. Offeror's price shall represent the best price in response to the request for quotes. The price shall be evaluated to determine fairness and reasonableness.

Foreseeable cost factors: This work is to be performed within the continental United States, with a USCG provided transit distance no greater than 320 nautical miles / 368 statute miles location other than boat's homeport from the address of BUILDING 29 COAST GUARD YARD, BALTIMORE, MD 21226 as determined by the government:

1. An MLB's design limits its use to short transits. The asset and unit are not crewed for continuous steaming and is normally limited to daylight transits. Due to crewing and asset employment standards, 3 days transit is the limit of crew endurance under normal operating conditions. 8 hours of transit per day is the planning factor due to crew fatigue. MLB's have a maximum speed of 20 kts, however, environmental factors frequently limit average speed to less than maximum.

2. Foreseeable costs (crew lodging, messing, rental vehicles, fuel, and authorized crew travel in accordance with the Joint Travel Regulations) will be added to the pricing and will be an economic consideration for award."

In the event that the vendor providing the quote is OUTSIDE of 320 nautical miles / 368 statute miles as determined by the government:

The contractor will include the following in their proposal:

a. Planning document(s) (will include routes travelling, coordination made with city, state, federal transportation agencies)

b. Foreseeable costs (Crane rental, transportation to and from the vendor's facility and all applicable insurance) will be added to the pricing and will be an economic consideration for award. The offer will be evaluated to include foreseeable costs as follows:

(A) TRANSPORTATION COST:

(B) PER DIEM COST

(C) OPERATING COST:

Factor 3 - Past Performance

The Government will review the Vendor's Past Performance record in Contractor Performance Assessment Reporting System (CPARS) for those projects that are similar in nature, size and complexity as this requirement, performed or completed within the last two years. Contractor will provide three (3) awarded completed projects that are listed in CPARS for the Government to review.

In addition, the Government will also review responses to past performance questionnaires only if no record of past performance is available in CPARS.

Past Performance refers to the quality of recent project experience from the customer's perspective. The Offeror shall arrange for the reference customer point of contact for two projects to fill out the Past Performance Questionnaire included with this solicitation. Ensure the reference is clearly marked for the applicable Offeror when submitted. The Government will not release the questionnaire forms to the Offeror at any time, in order for the Government to solicit candid, unbiased responses and comments. These references must be relevant to the work which will be performed in this contract. Relevant work is defined as inspection, maintenance, repair/refit, testing, storage, and transportation services as detailed in the Specification.

References must be recent within the past three (3) years.

The Government will evaluate each of the three (3) CPARs records provided by the contractor or in lieu of CPARs record, each PPQ submitted by their customer. CPARs or PPQ ratings of "Satisfactory" or higher will be considered acceptable.

CPARs or PPQ ratings below "Satisfactory" will be considered unacceptable.

The following adjectival ratings will be assigned to the Past Performance:

RATING DESCRIPTION:

ADJECTIVAL RATING

DESCRIPTION

Acceptable

Past Performance record shows that the contractor received a rating of "Satisfactory" or above for each category rated.

Unacceptable

Past Performance record shows that the contractor received a rating below "Satisfactory" in one or more categories of their record, therefore does not meet the requirements.

Technical and past performance, when combined, are equal when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

45661 ADDITONAL CONTRACT REQUIREMENTS

The below contract requirements have been determined by the Contracting Officer to be necessary for this acquisition and consistent with customary commercial practices and Federal, DHS, and Coast Guard Regulations.

(1) ACCESSIBILITY OF CONTRACTOR'S FACILITY

The contractor shall provide a facility accessible from a navigable waterway at which a ship of the characteristics described in the attached specification can, using its own propulsion, safely arrive, lie afloat and depart at all states of the tide and at any time day or night. The facility and its approaches shall have a minimum water depth of 7' and a minimum vertical clearance of 25'. The facility shall insure 2 (two) additional feet below minimum water depth at the pier per SFLC Standard Specification 0000 section 3.3.2.1.1.

2. Comprehensive General Liability - $500,000 per occurrence.

3. Full insurance coverage in accordance with the United State's Longshoremen's and Harbor Worker's Act.

4. Full insurance coverage in accordance with the State's Workmen's Compensation Law (or its equivalent) for all places of performance under this contract.

The insurance certificate must provide the name of the US Coast Guard vessel and the contract number as specifically insured.

(b) The composite labor hour rate will be applied to production labor hours only. Production labor hours include only those hours necessary and reasonable to perform direct production functions and do not include the hours expended on the support functions listed above. This exclusion of support function hours applies whether such support functions are normally charged directly or indirectly by the contractor's accounting system. These support functions are to be priced into the composite labor rate quoted and shall not be separately compensated.

(c) The Quantity of Composite Labor hours indicated in the Schedule of Supplies/Services, is only an estimate and is an Optional Item pursuant to this solicitation. The Estimated Quantity represents the Government's best estimate of the total number of additional hours that may be required throughout the contract. The Government may elect to exceed this value at the prices stated in the schedule and its discretion during performance of the contract. The inclusion of this item does not obligate the Government to exercise the item nor entitle the contractor to compensation if not exercised.

(10) METHOD OF PAYMENT AND INVOICING INSTRUCTIONS FOR SHIP REPAIR

The Government will make payment under this contract based on a percentage or stage of completion. The contractor may invoice each contract line item/CLIN as work progresses. The amount invoiced shall be calculated based on those prices stipulated in the contract Schedule of Supplies/Services as follows:
