About this file

This document is a Simplified Acquisition Procedures (SAP) Justification for Other than Full and Open Competition under FAR 13.106-1(b). It explains the rationale for awarding a sole source firm fixed price contract to Eastern Lift Truck Co Inc for the repair of four material handling equipment items used by the Coast Guard's Surface Force Logistics Center Inventory Control Point.

The justification states that the four forklifts are currently non-mission capable, and repairing them is critical to ICP operations and support to the Coast Guard fleet. Eastern Lift Truck is the sole source capable of performing these repairs without delay, as they already have existing contracts with the Coast Guard to maintain this equipment. The total estimated value of the sole source purchase order is less than $40,759.23. The justification outlines the market research efforts and explains why an adequate purchase description for full and open competition is not available at this time. It indicates that the Contracting Officer and COR are working to modify the current contract to cover future major repair requirements.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SIMPLIFIED ACQUISITION PROCEDURES (SAP) FAR 13.106-1(b)

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABLE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM THE CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS "ONLY KNOWN SOURCE" OR "ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE" ARE INADEQUATE TO

SUPPORT A SOLE SOURCE PURCHASE.

BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE.

Repair services for the four (4) pieces of equipment listed to include removal and installation of all parts listed out on the SOW.

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED. Currently the Surface Force Logistics Center (SFLC) Inventory Control Point (ICP) has four (4) major forklifts down in need of major repairs. The equipment listed on the SOW directly affect the ICP’s ability to stow, pick, and load heavy pieces of inventory required to ship out to the Coast Guard (CG) Fleet. Repairing these forklifts is absolutely critical to ICP operations and service to the CG Fleet.

A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT QUOTATIONS OR OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS PRACTICABLE (INCLUDE YOUR MARKET RESEARCH EFFORTS HERE). The CG currently holds a contract with one (1) base year and four (4) options years with Eastern Lift Truck (ELT). ELT currently conducts Preventative Maintenance (PM) and repairs on ICP equipment to include the four listed on the SOW.

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES.

Due to funding shortfalls of the PM and Repair contract, the CG is unable to fund the repairs against the contract. Furthermore, as part of the contract, ELT has conducted inspections and diagnostics for all four forklifts and have the full capability to bring these forklifts back to operational status without delay. Time is of the essence as the non-mission capable status of the equipment is causing direct delays in the movement of critical material.

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE. These forklifts have been non-mission capable for at least a month and any further delay of repairs will affect operations further.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED. Currently the COR and KO are working to modify the current formal contract in place to cover future major repair evolutions.
