14. (cont’d)

Question 1: Work item 12, sections 3.1.4.1 and 3.1.4.2 specify that the fuel tanks are to be emptied of up to 600 gallons of fuel which is to be stored and restowed after the tank cleaning and inspection are completed by the contractor. Work item 36, sections 3.2 and 3.3 specify that 783 gallons of fresh/new fuel is to be provided. Is the intent to use the existing fuel, have if cleaned, replace it on the vessel and then add new fuel to bring the total amount of fuel on the vessel to 783 gallons or for us to provide 738 gallons of new fuel?

Work item 12, section 4.2 states that the Ship's force will procure new fluids and refill all tanks at the appropriate time. Work item 36, section

1.1 states that the contractor is required to refuel the vessel to 95% capacity. These two sections appear to be in conflict. Who is responsible for obtaining the fuel?

Answer 1: The intent of the work items are for the contractor to remove all diesel fuel and dispose in accordance with all local and state regulations. Also, the contractor must document the chain of custody for the fuel's final destination or delivery. The contractor will be responsible for procuring all new fluids and returning the fuel tanks to 95%. Sections 4.1 and 4.2 of Work Item 12 should have been deleted. Section 3.1.4.2 of Work Item 12 should have been changed to tell the contractor to dispose of the fuel in accordance with all local and state regulations.

Question 2: Work item 9 is for a leak test of the port and starboard skegs? Work item 12 calls for a leak test of the port and starboard skegs as well. Are the skegs to be leak tested twice?

Answer 2: The leak test for the port and starboard skeg should only be done once.
