INSTRUCTIONS TO OFFERORS

Mobile Doffing Containment System

Amendment 1

Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) Clauses and Provisions The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with Federal Acquisition Regulation (FAR)

13.004 constitutes acceptance of all terms and conditions contained herein.

The following clauses and provisions are included:

Period of Acceptance of Offers

(c) Prices must remain effective for 90 days after solicitation closes.

Award on Initial Quotations The Government retains the right to award without discussions. Offerors shall assume the Government has no prior knowledge of their experience and will base its evaluation solely on the information presented in the offeror’s quotation. Therefore, offerors are encouraged to provide their best quotation with the materials requested for evaluation. However, in the event that discussions are considered necessary, the Government retains the right to limit the number of offerors included in the competitive range for purposes of efficiency.

Evaluation Method

52.212.2 Evaluation-Commercial Items Oct 2014

(a) The Government will award a contract resulting from this Request for Quote (RFQ) to the responsible offeror whose quotation conforming to the RFQ is the most advantageous to the Government, price and non-price factors considered. The following factors shall be used to evaluate the quotations and are listed in relative order of importance:

Performance, commercial warranty, and delivery when combined are significantly more important that price.

Factor 1-Performance The Government will assess the information submitted with the offeror’s quotation to determine how well the product meets the salient characteristics of this solicitation. The offeror shall complete the Technical Specifications worksheet attached and submit with the quotation.

Factor 2-Commerical Warranty The Government will assess the offeror’s submitted warranty information to determine the warranty that offer the best outcome for the Government.

Factor 3-Delivery Under this factor, the Government will assess the offeror’s delivery schedule to determine if the offeror can meet the delivery requirement in the Statement of Work.

Factor 4-Price The offeror shall provide pricing as requested in the Schedule. Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable.

Technical Acceptability: Offerors shall complete the Technical Specifications and return with their quotations. Quotations will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. Technical Acceptability will be evaluated on the ability of the offeror to provide new manufactured commercial items. The United States Coast Guard (USCG) requires the following items on a brand name or equal basis:

Design Specifications:

Must have multi-stage filtration to include HEPA

HEPA Rated Filter – Must be able to capture composite dust, fiberglass dust, paint and primer dust containing hexavalent chromium

Must also contain 1st Stage Pre-Filter Must be completely self-contained and provide a negative pressure environment Must be able to fit through all AIA and NPFA compliant doors

Enclosure must have fire retardant capability to meet or exceed UL94 flammability rating

Must be UL/C-UL listed

Must be collapsible and be able to be set up within five (5) minutes

Must be able of supporting at least 500 pounds

Must be equipped with windows

Must provide variable airflow of 250 to 500 CFM

Must be wired for 115V power supply

Must be equipped with a minimum 25 foot power cord

Must be equipped with visual (light) indication to alert users of filter replacement

Must be equipped with heavy duty, locking, non-marking casters

Must be designed for daily use

Must be portable and able to be relocated by a maximum of two (2) people

Shall have adequate to ensure particulates down to a size of 0.3 micron are captured

Items to be Included:

Operator Training Standard Warranty Training on system use

The Offeror of an alternate part must submit data that adequately demonstrates that its product meets or exceeds the requirements of the solicitation. A general statement of compliance or restatement of the requirements is insufficient. An offeror must clearly identify in writing they are providing an alternate part by annotating it on their quote.

Past Performance: The Past Performance evaluation will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s demonstrated Past Performance. The Government may use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s Asset Maintenance Management Information System (AMMIS) system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS). The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the offeror.

Solicitation Provisions

52.212-3 Offeror Representations and Certifications-Commercial Items Jun 2020 X Alternate I of 52.212-3. Oct 2014 The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management

(SAM) Web site accessed through http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

52.252-1 Solicitation Provisions Incorporated by Reference Feb 1998 This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. Full Text Provisions

52.203-98 Prohibition on Contracting with Entities that Require July 2016 Certain Internal Confidentiality Agreements – Representation (Deviation)

(a) In accordance with Section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.

(b) The prohibition in paragraph (a) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

(c) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the execution of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.233-2 Service of Protest Sep 2006

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from:

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.

52.252-5 Authorized Deviations in Provisions Apr 1984

(a) The use in this solicitation of any Federal Acquisition Regulation (48 CFR Chapter 1) provision with an authorized deviation is indicated by the addition of “(DEVIATION)” after the date of the provision.

(b) The use in this solicitation of any Homeland Security Acquisition Regulation (48 CFR 30) provision with an authorized deviation is indicated by the addition of “(DEVIATION)” after the name of the regulation.
