TERMS AND CONDITIONS
BREATHING AIR MAINTENANCE
70Z03819QK0000004
Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) Clauses and Provisions The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with FAR 13.004 constitutes acceptance of all terms and conditions contained herein.
The following clauses and provisions are included:
52.212-1 Instructions to Offerors - Commercial Items Oct 2018
Period of Acceptance of Offers Prices must remain effective for 90 days after solicitation closes.
Service Contract Labor Standards The Service Contract Labor Standards could apply to any contract awarded through this solicitation. In accordance with (IAW) FAR 22.1009-4, the place of performance for this contract is currently unknown. The Contracting Officer has determined one (1) possible place of performance and has included a Wage Determination schedule as an attachment to this solicitation. The Contracting Officer will obtain wage determinations for additional possible places of performance if asked to do so in writing at Rose.A.Bateman@uscg.mil.
Offerors must request an additional wage determination no later than (date and time will be three
(3) business days before close of solicitation). Offerors who intend to perform in a place of area of performance for which a wage determination has not been attached or requested may nevertheless submit quotes. However, a wage determination shall be incorporated in the resultant contract, and there shall be no adjustment in the contract price.
Delivery Requirements Free On Board (F.o.b) Destination is requested as the F.o.b. point for all deliverables. All offers will be considered F.o.b. Destination unless F.o.b. origin is specified AND estimated shipping costs are included.
Award on Initial Quotations The Government retains the right to award without discussions. Offerors shall assume the Government has no prior knowledge of their experience and will base its evaluation solely on the information presented in the offeror’s quotation. Therefore, offerors are encouraged to provide their best quotation with the materials requested for evaluation. However, in the event that discussions are considered necessary, the Government retains the right to limit the number of offerors included in the competitive range for purposes of efficiency.
Evaluation Criteria The provision at Federal Acquisition Regulation (FAR) 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below. Award will be made to the lowest priced, technically acceptable offer with acceptable or neutral past performance.
Price: The offeror shall provide pricing as requested in Attachment 1 – Schedule of Services.
Any quantity price discounts and discounts for prompt payment should be included in this section. The offeror’s quotation will be evaluated using one (1) or more of the techniques defined in FAR 13.106-3, in order to determine if it is fair and reasonable. Total price evaluation will be for the base period, all option periods and IAW FAR 52.217-8, a six (6) month extension period. Failure to quote pricing for the base period and the option periods on individual line items may result in a quotation being excluded from further consideration.
For purposes of evaluation, the potential need to exercise the option under FAR 52.217-8 to extend a period of contract performance for a maximum period of six (6) months beyond any period of performance will be considered the same for all offerors. The Government will consider that if the extension of service clause (FAR 52.217-8) is exercised, it will be on the exact same rates and terms, other than length of performance, as the period of performance being extended. For purposes of evaluation only, the Government will use the rates specified in the last option period and add the cost of six (6) months to the prices quoted for the base period and all option periods to determine total evaluated price of the contract. The Government will determine whether the price, including the options available under FAR 52.217-8, is fair and reasonable.
Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide a sound, compliant approach that meets all requirements listed in the Statement of Work (SOW) and demonstrates a thorough knowledge and understanding of the requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.
All offerors must provide the following minimum information and documentation with their quotations:
Ability of the offeror to meet the Delivery requirements listed in the
SOW.
Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror.
Past Performance: The offeror’s Past Performance will be evaluated to determine if it is “acceptable” or “neutral”. The Past Performance evaluation will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s demonstrated Past Performance. The Government may use information available from past contracts/purchase orders with the United States Coast Guard (USCG), delivery information found in the USCG’s Asset Maintenance Management Information System (AMMIS) system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS).
The Government reserves the right to limit or expand the number of references it decides to contact and to contact additional references other than those provided by the offeror. In the event that the offeror has no record of relevant past performance or for whom information on past performance is not available, the offeror will be given a neutral past performance rating.
Evaluation Method Only the lowest priced offer will be evaluated for Technical Acceptability. Should the lowest priced offer not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced offer only until the lowest priced, technically acceptable offer with acceptable or neutral past performance is identified.
