TERMS AND CONDITIONS Attachment 2 90 Pound 3 Hole Punch Paper
70Z03819QE0000012
Federal Acquisition Regulation (FAR) and Homeland Security Acquisition Regulation (HSAR) Clauses and Provisions The clauses and provisions contained herein are applicable to any order awarded as a result of this solicitation. The terms and conditions set forth herein supersede all other terms and conditions. Acceptance of the order in accordance with FAR 13.004 constitutes acceptance of all terms and conditions contained herein.
The following clauses and provisions are included:
52.212-1 Instructions to Offerors - Commercial Items Jan 2017
Period of Acceptance of Offers
(c) Prices must remain effective for 90 days after solicitation closes.
Cost or Pricing Data It is Department of Homeland Security (DHS) policy that pricing for competitive negotiations should be based on adequate price competition. However, in the event only one (1) responsible offeror is obtained as a result of this solicitation, that offeror may be required to submit Data Other Than Certified Cost or Pricing Data (FAR 15.403-3) to support price negotiations.
Delivery Requirements F.O.B. Destination is requested as the F.O.B. point for all deliverables. All offers will be considered F.O.B. Destination unless F.O.B. origin is specified AND estimated shipping costs are included.
Award on Initial Quotations The Government retains the right to award without discussions. Offerors shall assume the Government has no prior knowledge of their experience and will base its evaluation solely on the information presented in the offeror’s quotation. Therefore, offerors are encouraged to provide their best quotation with the materials requested for evaluation. However, in the event that discussions are considered necessary, the Government retains the right to limit the number of offerors included in the competitive range for purposes of efficiency.
Evaluation Criteria The provision at FAR 52.212-2 Evaluation of Commercial Items is not applicable to this solicitation. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below. Award will be made to the lowest priced, technically acceptable offer with acceptable or neutral past performance.
Price: The offeror shall provide pricing as requested in Attachment 1- Schedule of Supplies.
Any quantity price discounts and discounts for prompt payment should be included in this section. Total price evaluation will be for the base period and all option periods. Failure to provide pricing for the base period and all option periods may result in a quotation being excluded from further consideration.
Technical Acceptability: Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the offeror to provide the paper that meets all the requirements as follows:
90 pound paper
8.5” X 11”
3-hole pre-punched
Hole size must be 3/8”
Box size must be 11.5” X 9” X 11”
No hanging chads
1,000 sheets per box
It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to meet these requirements.
Past Performance The offeror’s Past Performance will be evaluated to determine if it is “acceptable” or “neutral”.
The Past Performance evaluation will assess the offeror’s ability to successfully accomplish the proposed effort based on the offeror’s demonstrated Past Performance. The Government may use information available from past contracts/purchase orders with the USCG, delivery information found in the USCG’s AMMIS system, and any information found using sources such as Federal Government sources, Past Performance Information Retrieval System (PPIRS)/Contractor Performance Assessment Reporting System (CPARS) to determine if the Contractor has acceptable or neutral Past Performance. The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the offeror.
If an offeror has no past performance history, the offeror must affirmatively state that it possesses no past performance history.
Evaluation Method Only the lowest priced offer will be evaluated for Technical Acceptability. Should the lowest priced offer not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced offer only until the lowest priced, technically acceptable offer with acceptable or neutral past performance is identified.
