FAR 52.252-1 Solicitation Provisions Incorporated by Reference (FEB 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a solicitation provision may be accessed electronically at Internet address http://acquisition.gov/far/index.html (End of Provision)
The following provisions are incorporated by reference and are addendum to FAR 52.212-1:
FAR 52.204-16 Commercial and Government Entity Code Reporting (JUL 2016) FAR 52.217-5 Evaluation of Options (JUL 1990)
FAR 52.212-2 Evaluation – Commercial Items (Oct 2014) is not applicable to this acquisition. In lieu of this provision, quotes will be evaluated in accordance with FAR 13.106-2 based on the criteria listed below:
Evaluation Criteria:
Technical Acceptability: 1) Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. Technical Acceptability will be evaluated on the ability of the offeror to provide new manufactured commercial items from the Original Equipment Manufacturer (OEM) or an OEM approved source. Offerors must be able to provide traceability to the OEM on all parts and be able to provide a certificate of airworthiness, Federal Aviation Administration (FAA) 8130 (preferred) or equivalent European Aviation Safety Agency (EASA) Certification, and a certificate of conformance (COC). Part 21 of the Federal Aviation Regulation outlines certification procedures.
All offeror’s will need to provide in writing with their quote a validation that they are able to provide the required technical acceptability certificates upon delivery of the parts on the List of Contract Line Items.
2) Offeror’s shall provide exact part numbers or an approved alternate part number.
3) Offeror’s shall be registered and current within the System for Award Management (www.SAM.gov).
Offerors shall submit the above mentioned validation as part of their quote.
Price: The contractor shall provide pricing as requested in Attachment 1 titled “List of Contract Line Items 70Z03818QB2000001”. Any quantity price discounts and discounts for prompt payment should be included in this section. Price quotations will be evaluated to determine completeness and fair and reasonableness. Price quotations will be reviewed to verify pricing was provided for the base and all four (4) option periods. Failure to quote pricing for the base year and all respective option periods on individual line items may result in a quote being excluded from further consideration. The government will also evaluate prices for each contract period of performance. The Government may determine that a quote is unacceptable if the option period prices are significantly unbalanced.
Past Performance: Past Performance will be evaluated to assess the Government’s confidence in the offeror’s ability to fulfill the solicitation requirements. The evaluation will consider the offeror’s demonstrated record of performance in supplying the products listed in the solicitation and will consider quality, meeting delivery schedules, compliance with contractual requirements and overall customer satisfaction.
References are not required. The Government may use information available from the Past Performance Information Retrieval System (PPIRS) and the Contractor Performance Assessment Reporting System (CPARS), previous contracts/purchase orders with the USCG and any information found using Federal as well as state and local Government sources.
An offeror must receive an Acceptable Confidence Rating to be considered for award. Offeror’s will be given the opportunity to address/comment on adverse past performance information that may result in an Unacceptable Confidence Rating. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will receive a neutral rating.
Evaluation Method: Only the lowest priced contract line items will be evaluated for Technical Acceptability. Should the lowest priced contract line item not receive an acceptable technical or past performance rating, the process will continue in order of lowest priced contract line item until the lowest priced, technically acceptable contract line item with acceptable past performance is identified.

(xi) Implement subnetworks for publicly accessible system components that are physically or logically separated from internal networks.
(xii) Identify, report, and correct information and information system flaws in a timely manner.
(xiii) Provide protection from malicious code at appropriate locations within organizational information systems.
(xiv) Update malicious code protection mechanisms when new releases are available.
(xv) Perform periodic scans of the information system and real-time scans of files from external sources as files are downloaded, opened, or executed.

This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(End of clause)
FAR 52.216-19 Order Limitations (OCT 1995)

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.
(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within fifteen (15) days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.
(End of clause)
FAR 52.216-21 Requirements (OCT 1995)
(a) This is a requirements contract for the supplies or services specified and effective for the period stated in the List of Contract Line Items. The quantities of supplies or services specified in the List of Contract Line Items are estimates only and are not purchased by this contract.
Except as this contract may otherwise provide, if the Government’s requirements do not result in orders in the quantities described as “estimated” or “maximum” in the List of Contract Line Items, that fact shall not constitute the basis for an equitable price adjustment.
(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the List of Contract Line Items and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.
(c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the List of Contract Line Items that are required to be purchased by the Government activity or activities specified in the List of Contract Line Items.
(d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.
(e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.
(f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after determined at the time of award based on the latest contract delivery date.
(End of clause)

The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
