Paragraph (b)(4), The following terms and definitions are applicable to this provision, Terms and Definitions:

“Original Equipment Manufacturer Part Number (OEM PN)” means a unique part number that the original equipment manufacturer assigns to a specific component with specifications.

“New” means composed of previously unused components, whether manufactured from virgin material, recovered material in the form of raw material, or materials and by-products generated from, and reused within, an original manufacturing process; provided that the supplies meet

Contract requirements, (e.g. performance, reliability, and life expectancy).

“Supersede” means to take the place of, as by reason of superior worth or right. Original manufacturer often supersedes their part numbers due to administrative reasons, engineering changes, part improvement, substitutions, obsolescence, or manufacturing enhancements which do not affect the items Form-Fit-Function. Many manufactures will have multiple changes on a single part number which do not affect the items Form-Fit-Function.

“Form, Fit, and Function”

• Form. The form of a commodity is its configuration (including the geometrically measured configuration), material, and material properties that uniquely characterize it.

For software, the form means the design, logic flow, and algorithms.

• Fit. The fit of a commodity is its ability to physically interface or connect with or become an integral part of another commodity. For software, the fit is defined by its ability to interface or connect with a defense article.

• Function. The function of a commodity is the action or actions it is designed to perform.

For software, the function means the action or actions the software performs directly related to a defense article or as a standalone application.

Offeror must submit the following information for evaluation and to be considered for award:

mailto:Dennis.S.Kokoskie@uscg.mil mailto:Micha.A.Wisniewski@uscg.mil

The Offeror’s quote submission serves as confirmation they are capable and willing to perform all the requirements in Attachment I Statement of Work (SOW) and resulting Contract. If applicable, the

Contractor must submit with their quote any exceptions to the terms and conditions for the

Government’s review and acceptance.

1. Technical Capability: The Offeror must provide their quote for the purchase of the items listed in Attachment II Price Schedule. The Offeror must provide the following information for each item, as required by Attachment II:

• Unit Price

• Lead Times for each item, in calendar days, after receipt of award.

• Proposed Equivalent Part Number and Brand if different than Column B, C and D and include the reason, using one of the below listed“Acceptable Part Number

Exceptions”.

o If the Offeror is proposing the exact item per columns B, C, and D, the

Offeror must only provide the unit price and lead time (in calendar days, after receipt of award).

o Submission of only a unit price and lead time for an item is confirmation by the Offeror that they will be able to procure and deliver that exact part number if they receive award before the end of the Government’s current fiscal year.

The items proposed must be new and contain the identical part number listed on Attachment II, unless an exception is authorized by the Government. The U.S. Government (USG) has identified the following Acceptable Part Number Exceptions.

a. Original Equipment Manufacturers’ Part Number Supersession.

A superseded part number is a part number that has been replaced by a new part number by the OEM, that qualifies as an exact Form-Fit-Function product. The superseded part number cited in the item description has been superseded by the OEM. The USG has attempted to recognize these changes, but often part numbers change so frequently making it challenging to catch every supersession. OEM part number supersessions are allowable pending they do not impact the Form-Fit-Function of the intended part and providing the vendor can provide supporting documentation, upon request, as proof of the supersession.

b. Supplier or Distributor Part Number.

Supplier or Distributor Part Number is defined as a specific supplier (usually a distributor or retailer) part number assigned to a single OEM Part Number. Supplier Part Numbers are an acceptable exception pending the part is new and the vendor can provide supporting documentation, with their quote, of traceability back to the OEM Part

Number.

c. Form-Fit-Function Replacement Items.

Product's design, performance, and compliance to a specification. If a proposed part, other than those specifically referenced in Attachment II, do not impact the Form-Fit-

Function of the intended item, as determined by the Government. The Form-Fit-Function part numbers are an acceptable exception pending the part is new and the vendor can provide supporting documentation, with their quote, of the salient characteristics of the part and why it is a Form-Fit-Function replacement. The Government reserves the right to make the final acceptability determination on all Form-Fit-Function parts proposed.

2. Delivery Schedule: The Offeror must provide a Delivery Schedule in accordance with

Attachment I Statement of Work § 3.3. The Delivery Schedule must include the number of calendar days, after receipt of award, that all items will be available for inspection and acceptance by the Government. In addition, the Delivery Schedule must include the number of calendar days after acceptance that the items will be prepared for DTS pickup and shipping.

Items not in production by the OEM and that are not currently available from the OEM, or a distributor or reseller MUST be identified by the Offeror. The Government reserves the right to remove any part(s) from the CLIN list, if none of the offerors are able to provide the part or if the

Government verifies with the applicable OEM that a part is no longer available, or superseded, or does not have a Form-Fit-Function replacement. No alternate, refurbished, reconditioned, aftermarket or used parts will be acceptable. Parts not in production by the OEM and that are not currently available shall be identified by the Offeror.

Paragraph (b)(6), Offeror must submit the following as their price quote:

The Offeror must provide a Firm Fixed-Price (FFP) quote for the work required in Attachment I

Statement of Work by filling out Attachment II Price Schedule. For Price only, the Offeror is only required to insert a Unit Price in column (H). The Extended Price column (I) will auto-populate.

If the Offeror is unable to source an item, the line item must clearly be marked “NO BID ITEM” on

Attachment II and documented on the first page of the quote. Failure to do so will render the quote non-compliant.

Paragraph (b)(8), The Offeror must complete the representations and certifications at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items. The Offeror must complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror must complete only paragraphs (c) through (v)) of this provision.

In addition, the Offeror must complete and submit the self-certifications found in the following solicitation provisions in Attachment IV:

• FAR 52.204-29 Federal Acquisition Supply Chain Security Act Orders—Representation and

Disclosures (below)

• FAR 52.209-7 Information Regarding Responsibility Matters (below)

• FAR 52.229-11 Tax on Certain Foreign Procurements (below)

Paragraph (b)(9), The Offeror must provide acknowledgement of any solicitation amendment(s) by submitting signed copies of the SF-30(s) or submit an acknowledgment statement with your quote.

https://www.sam.gov/

Paragraph (b)(10), the Offeror need not submit past performance information. See the Evaluation

Provision below for a description of how the Government will evaluate past performance.

FAR 52.212-2, Evaluation—Commercial Products and Commercial Services is supplemented as follows:

FAR 52.212-2 EVALUATION– COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

Paragraph (a) is deleted in its entirety and replaced with the following:

(a) The Government intends to award one Firm Fixed-Price Contract to the responsible Offeror, whose quote, in conforming to the Request for Quote (RFQ), provides the overall best value to the

Government considering the technical evaluation factors, past performance and price. Best value is https://www.acquisition.gov/far/current/html/52_212_213.html#wp1179178 defined, in FAR 2.1, as the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit in response to the requirement.

The Government will determine best value by performing a comparative evaluation (comparing offers to each other) to select the Offeror that is best suited and provides the most advantageous offer, considering the evaluation factors in this solicitation.

Quotes will be evaluated based on the following factors in descending order of importance: 1) Technical

Capability, 2) Delivery Schedule, 3) Past Performance, and 4) Price. All non-price factors when combined are significantly more important than price. However, as technical, delivery schedule, and past performance evaluations become more equal, price can gain importance in determining overall best value. The evaluation process will include the following:

Compliance Review The Government will perform an initial review of each offer received to determine if the quote is complete and complies with the Instructions to Offerors. The Government may reject any quote that it determines to be non-compliant with the solicitation requirements. This includes submission of the self-certifications required by the supplement to FAR 52.212-1 (Instructions to Offerors) above.

During the compliance review, each offer received will be evaluated to determine:

1. If the Offeror can provide all items listed in Attachment II,

2. If a NO BID for a line item due to obsolescence and a Form-Fit-Function item is not available,

3. If each part number being proposed is acceptable.

Comparative Evaluation A comparative evaluation is defined as comparing each offer directly to each other to determine which offer provides the best value to the Government utilizing technical capability, delivery schedule, past performance, and price as described below. The Government will perform a comparative evaluation for each non-price evaluation factor. Then the Government will take the results of the individual non-price factor evaluations, combine such results (using the relative importance of each non-price factor), and then determine the overall best-suited offeror using the non-price factors. Once the Government determines the best-suited offeror using the non-price factors, the Government will then evaluate price. After the Government calculates the total evaluated price (TEP), the Government will determine which offeror is the most advantageous and represents the best value to the Government, TEP and other factors considered, and make the contract award.

Exchanges with Apparent Successful Offeror

There will be no communications with Offerors after receipt of offers and prior to selection of the apparent successful Offeror. Once the Government determines the apparent successful Offeror, the

Government reserves the right to communicate only with that Offeror to address any remaining issues (which may include technical and price) and if necessary, finalize the contract. If the

Government is unable to successfully address any remaining issues with the apparent successful

Offeror, the Government reserves the right to communicate with the next best-suited Offeror based on the original evaluation and address any remaining issues to successfully award the contract.

Technical Capability Technical capability will be evaluated based on direct comparisons to other offers to discern which

Offeror is the most advantageous and provides the greatest overall benefit to the Government.

Technical Capability factor will be evaluated as follows for each sub-factor and are in order of importance:

1. The Government will evaluate Attachment II of each Offeror. The evaluation will identify which proposed list is the most advantageous to the Government and the benefit associated with those advantages.

2. The Government will evaluate the Delivery Schedule to determine the number of calendar days, after receipt of award, that the spare parts will be available for inspection and acceptance by the Government. A Delivery Schedule this is achievable and allow for faster delivery, will be considered more advantageous to the Government. The Delivery

Schedule will be incorporated in the awarded contract.

Past Performance A comparative evaluation of the past performance findings will be completed to identify which

Offeror is the most advantageous for the past performance evaluation factor.

Past Performance will be evaluated by reviewing recent and relevant performance evaluations in the

Contractor Performance Assessment Reporting System (CPARS) (https://cpars.gov) for each

Offeror. Recent is defined as within three (3) years from the closing date of this solicitation.

Relevant is defined as contracts of similar size, scope, and complexity.

Once all CPARS evaluations that meet the definition of recent and relevant are identified for each

Offeror, the ratings and narratives supporting those ratings will be reviewed. Ratings above

Satisfactory will be evaluated more advantageously. Ratings below Satisfactory will be evaluated less advantageously. Ratings of Satisfactory and lack of past performance ratings will be evaluated neither favorably nor unfavorably.

The Government reserves the right to utilize any source of information reasonably available to it to assess past performance. This includes, for example, other public databases such as Federal

Awardee Performance and Integrity Information System (FAPIIS) (https://cpars.gov) and USCG experience with Offerors performing under recent and relevant contracts for the USCG.

A comparative evaluation of the past performance findings will be completed to identify which

Offeror is the most advantageous for the past performance evaluation factor.

Price The Government will evaluate each offeror’s Total Evaluated Price (TEP) by using the sum of all

CLIN extended prices. The Government may use various price analysis techniques and procedures to make a price reasonableness determination.

The information requested in this solicitation is required to enable the Government to perform a price analysis to determine price reasonableness. The Government will evaluate each Offeror’s

TEP by using the sum of all CLIN’s extended prices

(b) Options. This paragraph is deleted in its entirety.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, must result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of Provision)
