About this file

This document is a Justification for Exception to Fair Opportunity, Exceeding the Simplified Acquisition Threshold, related to a federal contract opportunity.

The Department of Homeland Security, U.S. Citizenship and Immigration Services (USCIS), Office of the Chief Financial Officer (OCFO) proposes to award a firm fixed-price task order to provide subscriptions to Gartner Inc. for Chief Financial Officer support services. This task order will be issued under the Library of Congress FEDLINK Contract #LCFDL21D0001. The total estimated value of the task order is $253,204 for a one-year period of performance from September 30, 2024 to September 29, 2025.

The justification cites FAR 16.505(b)(2) exceptions to the fair opportunity process, specifically that Gartner is the only responsible source capable of providing the unique and highly specialized Gartner research databases required by OCFO. The agency need is urgent, and Gartner's proprietary data and analysis are essential for OCFO's requirements.

(CISAM 3016.505-90(b)(4) -- Justification for Exception to Fair Opportunity.

Exceeding the Simplified Acquisition Threshold (SAT) pursuant to FAR 16.505(b)(2)(ii)(B))

Justification for Exception to Fair Opportunity, Exceeding the Simplified Acquisition Threshold, Gartner Inc. Finance Advisory

REFERENCE: - and PR Number: CFO240033

4. Statutory exception and supporting rationale.

The applicable statutory FAR citation and basis for using an exception to fair opportunity process is:

FAR 16.505(b)(2)(i)(A). The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

FAR 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

FAR 16.505(b)(2)(i)(D). It is necessary to place an order to satisfy a minimum guarantee. The minimum order guarantee of [insert dollar amount] as set forth in the contract has not yet been awarded.

FAR 16.505(b)(2)(i)(E). A statute expressly authorizes or requires that the purchase be made from a specified source.

Rationale:

OCFO intends to procure on a sole source basis as the only responsible source capable of delivering the subscription services, Gartner Research Databases. Therefore, the below information regarding the sole source justification as the only responsible source capable of delivering the subscription services is provided as required by FAR 16.505(b)(2)(ii)(A).

Gartner has the largest information technology research body of knowledge available gleaned through proprietary information gathered via analyst interviews of CFOs, CIOs, CTOs, CDOs, CISOs and other executives in both the public and private sector. This data is not available through any other means at a reasonable cost. In addition, the Gartner magic quadrants and similar propriety products based on their research are immensely valuable to OCFO.
