Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(b)(2)(ii)(A)
In June 2012, GSA competitively awarded the ETS2 contract for government wide, web-based, world-class to Concur Technologies, Inc. The Period of Performance of the ETS2 contract award to Concur Technologies, Inc. (Concur) is June 2012 with options which could extend the contract thru June 2027. The second option period was exercised for the period June 4, 2019 through June 3, 2023.
The period of performance for the DHS/S&T task order is for a base period of 12 months beginning July 11, 2019 through July 10, 2020 with three (3) one year options. The total estimated cost of the task order inclusive of base and option periods is $.
2. Statutory Exception and rationale for its use: (Select one and explain rationale below):
_________FAR 16.505(b)(2)(i)(A). The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
__ X____FAR 16.505(b)(2)(i)(B). Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. [Explain why supplies or services are unique].
_________FAR 16.505(b)(2)(i)(C). The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. [For logical follow-on, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value)]:
_________FAR 16.505(b)(2)(i)(D). It is necessary to place an order to satisfy a minimum guarantee.
_________FAR 16.505(b)(2)(i)(E). For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.
Rationale:
On June 12, 2013, DHS Immigration and Customs Enforcement (ICE) awarded a standard implementation services contract to Concur Technologies, Inc. under task order number HSCETE-
13-F-00049. The task order was awarded to Concur Technologies, Inc. to provide services to ICE and federal agencies serviced by ICE (Customer Components: S&T, HQ, CISA, USCIS, OBIM, and FPS), for the implementation of Concur’s E-Gov Travel Service Solution – Concur
Government Edition (CGE). At the time of award, Concur Technologies, Inc. was the sole awardee under contract GS33FY0026 (ETS2 Master Contract).
Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(b)(2)(ii)(A)
DHS/S&T partnered with DHS/ICE (its Federal Shared Services provider for financial services) to reduce ETS2 implementation, training, and integration costs. DHS/S&T is currently implementing Concur's CGE system under a task order issued by DHS/ICE to Concur, GS-33-F¬
Y0026/HSCETE-13-F-00049. This task order provides DHS/S&T services for the implementation of CGE but the DHS/ICE task order does not include transaction-based services which are required for this proposed action. The award under order number HSCETE-13-F-00049 confirmed ICE and the Customer Components’ intent to use Concur’s travel management system to acquire travel services three months prior to the General Services Administration (GSA) naming an additional awardee under the ETS2 Master Contract.
These services are not severable from the services currently performed by Concur as the travel management services and helpdesk support cannot be provided by other awardees because they do not have access to the system owned and operated by Concur. Concur is the sole vendor capable of providing S&T these services because it is their travel management system and other contractors cannot access it therefore the task order proposed for this action must be issued on a sole-source basis.
Additionally, there have been significant ETS2 project progress (labor hours) and payments made under the ICE task order at the benefit of S&T and other customer components to support a deployment in early June 2014. Failure to deploy ETS2 under the current ICE ETS2 implementation plan will further costs to and impact travel operations for S&T. Due to the pressing mission needs of this support, as well as the costs, delays, and difficulties associated with pursuing alternative actions, the use of another ETS2 contractor is not considered to be in the Government’s best interests.
DHS Office of the CIO conducted market research to determine if there are any other comparable travel management systems that could fulfill these eservices. The results of the market research indicates that these services are not severable from the services currently performed by Concur as the travel management services and helpdesk support cannot be provided by other vendors because they do not have access to the system owned and operated by Concur. Concur is the sole vendor capable of providing these services because it is their travel management system and other contractors cannot access it therefore the order must be issued on a sole-source basis. Due to the pressing mission needs of the support that will be provided under this proposed action as well as the anticipated costs, delays, and difficulties associated with pursuing alternative actions such as re-soliciting for these services, the use of another ETS2 contractor is not considered to be in the
Government’s best interests.
Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(b)(2)(ii)(A)
Based on the foregoing, it is in the Government' s best interest to issue a task order to Concur for the ETS2 transaction-based services and supplemental services pursuant to the FAR subpart authority of FAR 16.505 (b)(2)(i)(B): "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized."
