ATTACHMENT 1
1. The Post Exhibit designates whether or not each post is a screener post, but it does not specify whether each screener post is specifically “X-Ray” (16 hours) or “Non X-Ray” (8 hours). Would the government provide this additional level of detail for the screener posts?
Amendment 0001 revises Exhibit 13, Post Exhibit to indicate whether screening posts are
X-Ray or non X-ray. Please refer to the updated Post Exhibit included as part of
Amendment 0001.
2. The current CBA language does not contain sick leave that satisfies the conditions of
Executive Order 13706. Moreover, under 29 CFR 13.5(f)(2), offerors may not use their
Service Contract Act obligations to satisfy the Executive Order requirements in any event. Please confirm that the requirement for 56 hours of sick leave is in addition to the successful offeror’s obligations under the CBA and Section 4(c) of the Service Contract
Act.
Please refer to RFP Pg. 16, Section 4, Prices, Paragraph C. “Paid Sick Leave Under 29
C.F.R. § 13.” The language in the RFP is clear on its face in regards to how offerors must comply with the Paid Sick Leave based on ratification date of CBA.
3. The Government has substantial small business subcontracting goals for this contract that cannot be met simply by purchasing uniforms and equipment from small business vendors. Therefore, it seems clear that the Government desires large businesses to use small businesses for post coverage as well. This adds substantial costs to a large business, based on efficiencies and economies of scale. Can the Government confirm that it expects all small business goals to be met each and every year of the contract or is it willing to consider the goals in the 5 year aggregate?
The Government does expect the contractor to meet its proposed goals each year of performance.
FAR 52.219-9, Small Business Subcontracting Plan, requires prime contractors to submit an
Individual Subcontracting Report (ISR) semi-annually during contract performance. In accordance with FAR 19.705-6, the CO must monitor prime contractor’s compliance with its subcontracting plan by reviewing the ISR no later than 60 days after submission and assessing whether the prime contractor made a good faith effort to comply with its small business subcontracting plan.
4. The Pricing Schedule requests a maximum of 225,000 PSO hours per year and the post schedule shows a total of 166,783.25 hpy – a difference of 58,216.75 hpy (25.87%). If an offeror allocates its supervision and fixed overhead costs over the entire SF1449 requested hours and the Government requests only those listed on the post schedule, the offeror will not be paid for almost 26% of its overhead costs. Does the Government intend to purchase all the hours on the SF1449 or the hours listed on the post schedule?
Please refer to RFP, Page 13 Section 03, Maximum Quantities. The solicitation is clear regarding the difference between the post exhibit hours and the SF1449 hours.
