FAR 52.212-2 - EVALUATION -- COMMERCIAL ITEMS (November 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
• Technical Acceptability
• Offeror Equipment Ordering Process
• Software and Services Maintenance Program
• Past Performance
The Technical evaluation factors, when combined, are approximately equal to price.
The Government reserves the right to award the contract to other than the lowest priced offeror.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c)A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Quotes that are not submitted in accordance with the Statement of Work (to include addressing section F.2.1 through F.2.7) shall be considered non-responsive and will not be considered.
(End of Provision)
Proposal Evaluation Information:
Technical Specification (Non-price factors) – The Government shall incorporate all elements of the successful Contractor’s technical proposal (in full or by reference) into any contract resulting from this RFQ. The Contractor is required to submit the following technical (non-price) information:
TECHNICAL SPECIFICATIONS:
1. Detailed list of proposed hardware to include at a minimum:
a) Equipment model number, part number, and quantity.
b) Manufacturer data sheet.
c) Itemized price list. All items shall match those on the manufacturer data sheets.
d) Any accepted streaming formats
e) Identify specifics regarding backlight compensation
70RFP422QE5000001 68 of 117
f) Identify specifics regarding mega pixels
g) Identify specifics regarding degree/range of coverage
h) Identify specifics regarding IR capabilities
i) List if provided cameras have a newer generation that has been released
j) List number of USB and HDMI connections on all equipment (e.g., NVRs, Monitor(s)
k) Outline restore procedures for cameras
2. Detailed list of proposed software to include at a minimum:
a) Name and version of software.
b) Software data sheet.
c) Itemized price list. All items shall match those on the manufacturer data sheets.
3. List of Materials
a) Part number and quantity and/or length in feet.
b) Itemized price list. All items shall match those on the manufacturer data sheets.
4. Calculations
a) UPS and/or battery backup.
b) Video storage.
Note: Cut sheets (manufacturer data sheet) shall be consolidated into one (1) file and in the order, they appear on the Offeror provided furnished equipment list. The Offeror shall not send individual cut sheets. If the cut sheets are compressed via WinZip, they shall all still be one (1) file.
Technical Specifications will be evaluated for adherence to the stated requirements in the attached Statement of Work. If the government determines that the specifications do not adhere to the Statement of Work, the quotation will be found to be non-conforming and will not receive further consideration for award. Vendors who fail to submit the cut sheets and narrative descriptions may not receive further consideration for award.
Offeror Equipment Ordering Process: FPS desires that offerors provide strategies and proposed solutions demonstrating how they will result in better value to the government. In response to the evaluation factor, offerors will describe in detail the timelines for major milestones/steps associated with obtaining all necessary equipment and materials necessary to complete the project installation starting from notification of award. The timeline shall take into account the overall project completion date of 60 workdays after receipt of notice to proceed.
Software and Services Maintenance Program:
Offerors shall outline significant aspects for its software and services maintenance program.
While there is no comprehensive list of significant aspects that are required to be addressed, it is recommended that offerors address screen development, report generation, software upgrades, OS patches, virus protection, system configuration, response plan implementation and other such support required for operation. In addition, address technical services, support, testing, 70RFP422QE5000001
68a of 117 maintenance and repair of the system and components installed in this SOW. Include annual patch updates (i.e., if available), cleaning of equipment frequency (i.e., clearing of dust and debris). Details should also include reinitializing cameras, and replacements for all CCV system equipment. This will cover equipment with routine failure, factory defects, and weather-related causes. Offerors, at their discretion may also discuss any nuances of the subject requirements and/or local conditions that might present a risk to successful software and services maintenance and how this risk will be mitigated. This discussion may enhance the Government’s understanding of the quote.
Past Performance The Offeror shall demonstrate relevant past performance by submitting a list of references for projects performed within the last three (3) years. Relevant past performance information includes performance under projects (currently being performed or performed within the past three (3) years although those projects of short duration or recently awarded may be considered as slightly less relevant and/or presenting a higher performance risk given the shorter period of performance) that are of a similar or directly related scope, magnitude, and complexity to that described in the solicitation and as defined below. Note that the Government reserves the right to evaluate submitted projects individually or in the aggregate in order to determine relevance and will do so consistently across all evaluated offers. The Government will also consider the quality of the Offeror’s relevant past performance. Information provided in response to this factor will assist the Government in determining the degree of risk associated with award of this project to the Offeror in question based upon that Offeror’s past and present performance on other relevant projects. In addition, the Contracting Officer may use past performance information as one of the components in making a determination of responsibility.
The offeror shall provide up to a maximum of two (2) “Attachment B – Past Performance Project Form(s)” for projects performed for Government agencies and/or commercial customers within the last three (3) years. For each project submitted, the Offeror shall fill out one (1) “Attachment B – Past Performance Project Form” and submit those Past Performance Project Forms to the Government along with the Offeror’s submission.
Past Performance Questionnaires: In accordance with the Past Performance Project Form(s) that are provided by the offeror, the Offeror is responsible for sending Attachment C – Past Performance Questionnaire, to each end-customer listed on the Offeror’s provided Attachment B, Past Performance Project Form.
Vendors shall follow the instruction on Attachment C, Past Performance Questionnaire, on how to send the completed questionnaires to the Government. Past Performance Questionnaires, Attachment C, shall be sent directly to the Contracting Specialist and in accordance with the vendor submitted Past Performance Project Forms. The Government will not accept any Attachment C - Past Performance Questionnaire(s), sent directly from the offeror.
If the Government does not receive any Attachment C - Past Performance Questionnaire(s), from the end-customer(s) listed on the Attachment B - Past
70RFP422QE5000001 68b of 117
Performance Project Form(s), then the Government reserves the right to directly contact the end customer to facilitate submission of completed Past Performance Questionnaires.
If the requested past performance information is not submitted to the Government, the Government reserves the right to obtain past performance through all available sources.
Past Performance will be evaluated for:
Period of Performance: When the contract was completed or if it is in progress.
Completed projects will be considered more relevant than work in progress.
Scope: The type of services provided and what was installed. Video Surveillance System (VSS) system will be considered more relevant.
Magnitude: Total contract value should be similar in magnitude.
Complexity: Not limited to, but including licensing, types of responsibilities, similarity to technical specifications of the current Government requirement, systems integration, offeror qualifications, and any issues that arose from the installation work and ability of the offeror to successfully rectify those issues. Complexity of projects completed for Government agencies will be considered more relevant than projects for commercial customers.
The Evaluator will consider individual projects that meet or exceed the scope and magnitude to have a higher degree of relevancy than those that meet only the scope or magnitude or are combined to meet or exceed the magnitude.
Information provided in response to past performance will assist the Government in determining the degree of risk associated with award of this project to the Offeror in question based upon that Offeror’s past and present performance on other relevant projects.
The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government.
Offerors lacking recent and relevant past performance history will not be evaluated favorably or unfavorably on past performance. The Government will consider the quality of an offeror’s past performance. This consideration is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s relevant past performance will be used as a means of evaluating the relative capability of the offeror and other competitors to successfully meet the requirements of the RFQ. In determining the rating for the past performance evaluation factor, the Government will give greater consideration to the contracts which the Government feels are most relevant to the RFQ.
PART III – PRICE SUBMISSION:
(1) The offeror must complete blocks 12, 17a, 17b and blocks 30a, 30b, and 30c of the
SF 1449.
70RFP422QE5000001 68c of 117
(2) Complete Pricing Schedule on starting on page 3 of the SF1449, Contract Line Item 0001.
The price submission on the SF 1449 shall include a total price for all requirements to include labor, supervision, material/equipment, travel, per diem, shipping/freight, training, and warranty as specified within the Statement of Work (SOW). (Price for entire job)
QUOTATION SUBMISSION REQUIREMENTS:
Acknowledge Amendments (if any): in accordance with the instructions in Block 11 of the Amendment(s) SF 30.
Page Limitation: Excluding the cover page, technical specification items 1 – 4 and past performance, the technical proposal covering Offeror Equipment Ordering Process and Software and Services Maintenance Program is limited to five (5) pages in at least 11pt. font and 1” margins. Pages in excess of this limitation will not be evaluated. The pages excluded from evaluation will be at the discretion of the Agency.
Initial Quotes: Contractors are informed that it is the Government’s desire to make award on initial quotes when deemed possible by the Contracting Officer, however the Government reserves the right to communicate and/or negotiate with offerors if later determined necessary.
Validity of Quote: Quotes shall specify the offer expiration date. Offerors shall hold their offers valid for 120 days after the solicitation closing date, unless requested to further extend it by the Contracting Officer.
Non-Compliance with RFQ Requirements: Failure to meet any of the instructions for submission of Offeror quotations may result in the rejection of the Offeror’s quotation.
70RFP422QE5000001 68d of 117
Basis for Selection: The Government will select the responsible Contractor whose proposal, in conforming to this RFQ, provides the overall best value to meet the government's requirements, price and non-price factors considered. Only apparent successful contractors determined to be responsible pursuant to FAR 9,104-1 will be issued a contract.
