Question No: QUESTION Gov't RFP Reference ANSWER

The Pricing Schedule requests a maximum of 677,160 PSO hours per year and the post schedule shows a total of 602,057.25 hpy – a difference of 75,102.75 hpy (12.5%). If an offeror allocates its supervision and fixed overhead costs over the entire SF1449 requested hours and the Government requests only those listed on the post schedule, the offeror will not be paid for almost 12.5% of its overhead costs. How will the contractor be reimbursed for those costs?

SF1449, Pricing Schedule, Addendum to FAR 52.212-4, Para 03 and Para 04(E)(1)

The 677,160 hours is the maximum order quantity inclusive of the current Post Schedule hours, Temporary Additional Service (TAS) hours and potential growth.

The government may order any quantity from the minimum up to the maximum.

The prices proposed by the vendor on the SF1449 are fixed and not subject to an adjustment resulting from the variations in Government ordering up to the maximum quantity. Any pricing risk associated with variations in order quantity should be fully considered by the vendor and reflected in the proposed prices. It is at the contractor’s discretion to determine their pricing strategy taking into consideration all cost elements required to support the Government up to the maximum quantities. The Contractor’s price shall be inclusive of all the

Contractor’s direct costs, indirect costs and profit.

The quantity of hours on the Pricing Schedule increases by approximately 5.6% each year.

Do these increases represent new buildings that are planned to be added to the contract?

Addendum to FAR 52.212-4, Para 03 SOW Exhibit 13, Post Exhibit

The current, known service requirements are provided for informational purposes only. The Government reserves the right to order up to the maximum quantities set forth in the Schedule, to include, if the need arises, the addition of new posts/buildings/locations and/or expansion of duty hours at existing posts.

If the expansion hours noted in question #2 are not requested by the Government, the contractor will not recapture its supervision and fixed overhead costs, similar to question #1.

Would the government consider a separate CLIN for the potential growth / new buildings? See Response to Question 1 above No.

4 Do any of the jurisdictions require a gross receipts or similar tax on guard services? FAR 52.212-4(K) It is the responsibility of the vendor to research and determine all applicable taxes.

Does the Government expects all small business goals to be met each and every year of the contract or is it willing to consider the goals in the 4 year aggregate? Yes, the government expects offerors meet the small business goals proposed every year.

The SOW in section 11.1.4 states that Key Personnel “shall not perform any PSO duties while assigned as “Key Personnel” on the contract” and section 11.5.3 states that “Under no circumstances shall individuals appointed as QC Monitors serve as the Contract Manager or PSOs”.

a. Please clarify if Key Personnel (CM, QC Monitors, Trainers) can remove their key personnel status for a shift or part of a shift and stand post as a PSO, similar to a supervisor removing their rank and standing post?

b. The language does not prohibit a Supervisor from acting as key personnel or vice versa.

It is our understanding from a recent vendor forum that FPS did not want QC Monitors to ever act as Supervisors under the new SOW. Can you confirm that a CM, QC Monitor or Trainer could also act as a Supervisor when not performing as a CM, QC Monitor or Trainer?

Amendment 0008, SOW Para 11.1.4 and 11.5.3

a. Key Personnel cannot remove the their key personnel status for a shift or part of a shift and stand posts as a PSO.

B. CM, QC Monitor or Trainers cannot act as supervisors.

Are all incumbents required to have a new medical/PAT/drug test to meet the new SOW requirements prior to contract start? SOW Para 5.2.2.1

No. Incumbent PSOs medical screening are valid for 5 years from their last medical exam.

Usually the Government provides the list of attendees to the pre-bid conference so that small businesses can consider teaming arrangements and subcontracting opportunities.

Will the Government publish the attendee list for the pre-bid meeting? No, the government will not publish the attendee list for the pre-bid meeting.

Will the Government please clarify if there are any additional stakeholder agency specific clearance or training/orientation requirements that are not noted in the solicitation?

No, there are no other requirements known to FPS at this time

Under Proposal Submission Requirements of Solicitation Provisions, the text reads “Offerors shall possess a (Insert either Secret or Top Secret) facility clearance prior to the date and time established for PSO’s to begin standing post.” Would the Government please clarify which type of facility clearance is required? Amendment 0006, RFP page 403 Facility Clearance is Secret. Refer to amendment 0006.

Under Attachment 9, Proposal Checklist, it is stated that a CD/DVD copy of the Price Proposal is to be submitted, but this requirement is not listed in the solicitation provisions.

Would the Government please clarify if the Price Proposal shall be submitted with a CD/DVD copy? Amendment 0006 page 112

A CD/DVD is required. Refer to Amendment 0006 page 112 for price proposal submission.

In Exhibit 8 Contractor-Provided Training, a. Firearm Qualification Course (Handgun), it is stated that the minimum qualification score is two hundred out of two hundred-fifty. But, under Marksmanship Rating, 220 is the lowest score displayed. Would the government please clarify what is the minimum qualification score? Page 156 of RFP, Exhibit 8, para 3a The minimum qualification score is 200 out of 250 for 80%.

Exhibit 10 Contractor-Provided Equipment lists “Pump-action shotgun, when applicable.”

Would the Government please confirm that pump-action shotguns are required on this contract? Pump action shotguns are not required. Refer to amendment 0006 question #23

Recent FPS Armed PSO Services RFPs have allowed electronic submissions (Minnesota & Wisconsin, Indiana, Michigan, Ohio, Illinois, Arkansas, New Jersey). Printing the submission documents adds considerable time and cost for a contractor. Would the Government please consider changing the submission for this requirement from hard copy to electronic submission? Solicitation is clear on its face.

It is stated that the Federal Bureau of Investigations and National Regulatory Commission have been identified as agencies which require the PSOs to have Top Secret Clearances, unless otherwise noted. Please confirm that no other agencies require PSOs to have a Top Secret Clearance?

11 Key Personnel

11.1 General Information

11.1.1 Under this contract, the Government designates the positions of Contract Manager, QC Monitors, and Training Instructors to include NWDTP Training Instructors as “Key Personnel.”

11.1.2 The Contractor shall provide personnel resumes for all Key Personnel and the following contact information to the CO and COR, by the first post award meeting:

• Name (first/mi/last)

• Mailing and physical office addresses

• Telephone number (office and cell)

• E-mail address

11.1.3 The Contractor shall not replace Key Personnel without submitting personal resumes for approval.

11.1.4 The CO and COR shall approve proposed Key Personnel prior to assignment under this contract and have the right to request replacement of Key Personnel, when deemed necessary. The Contract Manger, Training Instructors and QC Monitors shall not perform any PSO or Supervisory duties while assigned as “Key Personnel” on the contract.

11.2 Contract Manager

11.2.1 The Contract Manager position requires a minimum of five (5) years of specialized experience. The Specialized experience includes: project development and implementation from inspection to deployment; expertise in management and control of funds and resources using complex reporting mechanisms; and demonstrated capability in managing multi-task Contracts or subcontracts of various types and complexity.

11.2.2 The Contract Manager shall have a bachelor’s degree in any field of study or have substantial and verifiable law enforcement, military or business management experience, which demonstrates individual’s capacity to effectively manage a security force and contract/task order equivalent to scope, magnitude, and complexity as described in this contract.

11.2.3 The Contract Manager shall have complete authority to act for the Contractor during the term of this contract and shall have authority to accept notices of deductions, inspection reports, and correspondence on behalf of the Contractor.

11.2.4 The Contract Manager shall have overall responsibility for implementing, monitoring, and upgrading Contractor’s quality control plan and is responsible for ensuring Contractor’s workforce complies with contract requirements.

11.2.5 The Contract Manager shall be available during normal working hours (8:00 am to 4:30 pm local time) within thirty (30) minutes by telephone or in person to discuss deficiencies; after normal duty hours or on weekends and holidays, within two (2) hours.

Amendment 0008 to perform First Aid, CPR and AED instructions. This certification must be as an Instructor with the American Red Cross or American Heart Association. The Instructor shall recertify as required by their certification expiration date.

11.4 NWDTP Instructor Qualifications

11.4.1 NWDTP Instructors shall have a background with a minimum of two (2) years of training experience in civilian community law enforcement, military service law enforcement, or commercial/industrial security force service.

11.4.2 Contract NWDTP Instructors shall certify in accordance with 6.7.3 and recertify annually.

Recertification consists of co- teaching the sixteen (16) hour X-Ray NWDTP curriculum with a certified FPS NWDTP instructor. Failure to recertify or pass recertification will result in the Contract NWDTP Instructor to attend and pass the initial NWDTP Instructors course.

11.5 Quality Control Monitors

11.5.1 Quality Control Monitors shall have a background with a minimum of two (2) years’ experience in monitoring the quality assurance of performance contracts involving personnel.

11.5.2 The QC Monitors will closely monitor the overall performance of the contractor, to include equipment, uniform and appearance, attendance and/or compliance with the SOW, possession of required licenses and permits; current firearms qualification.

11.5.3 The contractor shall submit their QC Plan within 15 days of award of the contract. Under no circumstances shall individuals appointed as QC Monitors serve as the Contract Manager, Supervisor or PSOs working on post. QC Monitors may service as other Key Personnel Positions (PSO Instructors, etc.), if they meet the same qualifications.
