| Q No. | Solicitation or Attachment | Question | Government Response |
| 1 | Attachment 1: Statement of Work | We are advised that the hourly rate for emergency PSO services shall be inclusive of all costs directly related to or incidental to providing services when ordered. We are also informed that requirements under emergency force service CLINs shall be short term in nature. Under which CLIN should these services be considered for pricing purposes? | There is no requirement for ESS under this contract. |
| 2 | Attachment 1: Statement of Work | We are directed to obtain applicable permits, titles, inspections, and registrations for the operation of vehicles, and that all costs for operation and maintenance of vehicles, including license and insurance fees, is a cost to the Contractor. However, Section 5 of Exhibit 10 indicates that no vehicles are required of the contractor. Would the Government please clarify which is accurate? | There is no vehicle requirement under this contract. |
| 3 | Exhibit 10: Contractor Provided Equipment | At Section 4 of Exhibit 10, there is a note that reads: NBACC provides radios/frequency to PSOs. No Contractor provided radios/cell phones required on post. The paragraphs below the table of equipment continue with guidance regarding equipment capability, and instruction to provide a listing of radio(s) and associated equipment used to the COR prior to standing post, as well as cellular telephone numbers. There appears to be a contradiction; please clarify. Is the NBACC providing radios for contractor use? If so, is the contractor still required to provide a list of radios and equipment to the COR? | The customer, NBACC, will provide the radios and frequencies. If deemed necessary, as a business decision, the vendor can provide the PSOs with a cell phone to allow the on-site PSOs to call the vendor contract manager and supervisors as needed. |
| 4 | Attachment 9: Proposal Submission Checklist Attachment 5: Department of Labor Wage Determination(s) Attachment 6 - Separate File: Price Element Breakdown (Suggested Format) | On page 412, at paragraph 3, we read: “The minimum wage rates and fringe benefits applicable to this contract are outlined in the attached Department of Labor (DOL) prevailing wage determination(s) and/or the predecessor contractor’s Collective Bargaining Agreement(s).” Attachment 5, Department of Labor Wage Determination(s), contains a single CBA (CBA-2023-80) that addresses Armed Security Officers, and no other labor categories/positions. Attachment 6, on the non-PSO positions tab, lists managerial, instructional, and administrative personnel, not all of which are exempt from the SCLS. There is no SCA WD referenced in the solicitation document pages. Would the Government please clarify if does one apply? And if so, request it be incorporated into the solicitation documents. | The only SCA labor category to be engaged in performance of services required by the contract is Guard II. The wage determination for this contract is CBA-2023-80. It provides the minimum wage rate and fringe benefits for all Guard II PSOs (non-supervisory) on the contract. Is there an armory available in which this can be accomplished? How is this requirement being handled by the incumbent? | The customer, NBACC, provides a space at the facility for weapons to be cleared and stored which includes a safe and clearing barrel. The supervisors on-site issue these weapons from this room during each shift. Authorized contractor individuals are allowed to remove the weapons in bulk for maitenance or weapon qualifications. |

If a Company decided to bid the 10/1/2023-9/30/2024 period at a rate of $33.80 giving the PSO’s a $2.00 increase. Then negotiates a new CBA accordingly with an additional $2.00 increase on 10/1/2024. Would the SCA adjustment allowed on the 10/1/2024-9/30/2025 period be for the entire increase of $31.80 to $35.80 ($4.00) or only for the $2.00 increase or change in rate on 10/1/2024? This will affect how you price out the option years. | The vendor would only be entitled to a $2.00 increase in this scenario as per the Service Contract Act (SCA), the adjustment is based on the wage increase stated in the CBA that is above what the PSO is currently being paid, which is verified by payroll records submitted as part of the SCA wage adjustment request. For additional information, please refer to to FAR 52.222-43(d)(1) |

| 33 | Contract Terms and Conditions | Considering the economic uncertainty and inflation present in the labor market and material supply chain today there is serious doubt concerning price stability during the extended period of contract performance. The uncertainty is industry-wide and outside the contractor's control. The solicitation pricing instructions require the contractor to include both labor and associated material and other costs into one firm fixed labor rate, which increases the economic risk to the contractor even further. The market variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor. Under the current economic circumstances, would the Contracting Officer consider including the clause at FAR 52.216-4, Economic Price Adjustment-Labor and Material, or the clause at FAR 52.216-5, Price Redetermination-Prospective, or an agency-prescribed clause as authorized in paragraph (a)(2) of FAR 16.203-4? | No, the government will not include these clauses into the solicitation. |
| 34 | Contract Terms and Conditions | If the government is unwilling to include FAR 52.216-4 or -5 in the contract, would the Contracting Officer consider separating the direct labor rate from materials and other ODCs and including the materials and other ODCs on a separate cost-reimbursement CLIN? | No, the government will not change the pricing structure of the contract. |

Communications Equipment Requirement it states “ The Contractor shall provide, maintain, and supplement, as may be necessary at the site identified above, the following number(s) of radios/cellular phones and described associated equipment/ to equip each security officer on post a method to communicate with FPS”, the note above states “ NOTE: NBACC provides radios/frequency to PSOs. | 42 | Attachment 1 - Statement of Work | Does the government know how many of the incumbent’s current guard force are certified as NWDTP Instructors? | Information pertaining to current staffing strategies utilized by the predecessor vendor is not releasable or necessary for offerors to submit a proposal under this solicitation. |
