Industry Q&A

1. Considering the economic uncertainty and inflation present in the labor market and material supply chain today there is serious doubt concerning price stability during the extended period of contract performance. The uncertainty is industry-wide and outside the contractor's control. The solicitation pricing instructions require the contractor to include both labor and associated material and other costs into one firm fixed labor rate, which increases the economic risk to the contractor even further. The market variables for labor and materials are too unstable to permit a reasonable division of risk between the Government and the contractor. Under the current economic circumstances, would the Contracting Officer consider including the clause at FAR 52.216-4, Economic Price Adjustment-Labor and Material, or the clause at FAR 52.216-5, Price Redetermination-Prospective, or an agency-prescribed clause as authorized in paragraph (a)(2) of FAR 16.203-4?

2. If the government is unwilling to include FAR 52.216-4 or -5 in the contract, would the Contracting Officer consider separating the direct labor rate from materials and other ODCs and including the materials and other ODCs on a separate cost-reimbursement CLIN?

3. Please provide the last Contract Number(s) and the Contract Award amount(s) to include Option Years for the current contract(s)

Services at buildings DC0382, DC0302, and DC0367 were awarded under Contract 70RFP218DEC000003 with KR Contracting, Inc. in the amount of $19,053,436.13, inclusive of all ordering periods (5-year contract). Services at buildings DC0045, DC0060, DC0424, DC0347, and DC0506 were awarded under FPS’ Multiple Award Contract (MAC) 70RFP218DEC000016 Task Order 70RFP220FREC00096 with Master Security in the amount of $5,101,909.44 (one year order).

4. Please provide on average, historically, how much TAS hours were used annually over the past contract term of five years?

The following historical information is provided for informational purposes and is not a representation of any future requirements. The Post Exhibit provides the current, known service requirements, but the government may order up to the maximum quantities specified in the 1449 pricing schedule; see page 11 of A. Contract Clauses of the RFP, section 03 Maximum Quantities and page 15 of A. Contract Clauses,

04. Prices, E. Definitions, 1. PSO Services. Under Contract 70RFP218DEC000003, a total of 321 hours of Temporary Additional Services (TAS) has been ordered at building #DC0382 in the last five years. No

Industry Q&A other TAS was ordered at any of the other sites under this effort in the last five years. There has not been any TAS ordered under Task Order 70RFP220FREC00096; however, we note that the incumbent effort to 70RFP220FREC00096 required 433 hours of TAS at building #DC0060 for the period 06/01/2018 – 09/30/2018. No other TAS was ordered at any of the other sites under this effort in the last five years.

5. With Bldgs. DC0045, DC0060, DC0506 and DC0424 under the DOL Wage Determination and or the current job market, can the government provide an estimate of their current wage rates being paid?

No, the Government cannot provide an estimate of the wages currently being paid to guards at DC0045, DC0060, DC0506 and DC0424. See Price Proposal Instructions beginning on page 7 of the Attachment W. Solicitation provisions of the solicitation, regarding minimum wage rate and fringe benefits applicable to this effort. Please be advised that the Wage Determination reflects the minimum wage rate and fringe benefits applicable to those locations but given the market dynamics and CBAs applicable to other locations under the solicitation, vendors may want to consider paying more than the Wage Determination minimums to attract and retain qualified PSOs.
