Questions for 70RFP222REC000002 Amendment 0003

The purpose of this amendment is to incorporate the industry questions and associated answers for informational purposes only and do not themselves constitute a change. Any changes to the terms and conditions of the solicitation are expressly and separately indicated as such.

1. What’s the current contract value?

Answer: The current contracts have additional locations not included on this recompete. The current contract value for these contracts will not be released.

1. How many personnel are currently working on the contract?

Answer: The seniority list (Attachment 10) lists 86 PSOs. It is unknown how many other personnel are working under this contract (e.g., supervisors, corporate staff etc.)

1. How much does the Government anticipate obligating for this effort?

Answer: The indefinite delivery/indefinite quantity type contract will be awarded with the minimum guarantee of $100,000 (please see pages 3-4 of the SF1449). Task orders will be issued for the actual known service requirements based on the post requirements at that time (see Contract Clauses, paragraph 03., Maximum Quantities) and the awardee’s billing rate both of which are not known at this time.

1. Is the contract currently fully staffed?

Answer: The current contracts are being staffed as required; however, the Government has no insight in relation to how they are staffed (e.g., overtime etc.)

1. Is the Government satisfied with the current staffing?

Answer: The current contracts are being staffed as required.

1. Ref SOW 14.8 – Is the Contractor required to purchase PTS computer/tablet/kiosk devices, replacement PTS computer/table/kiosk devices, and applicable software licenses?

Answer: Yes. Refer to SOW Exhibit 10 and the post exhibit for the equipment, licenses, and software the Contractor is required to furnish. The contractor is responsible for maintaining the quantity of tablets listed in the post exhibit. Also, please reference Contract Clauses, paragraph 04. Prices, paragraph E, which indicates that the contactor is also responsible for purchasing additional tablets if additional posts/buildings etc. are added to this effort.

1. Are the listed supervisors the only supervisory hours?

Answer: This is an indefinite delivery; indefinite quantity type contract and the Government can order up to the maximum quantities in the schedule. Task orders will be issued for the actual known service requirements based on the post requirements at that time. The Contractor shall maintain no less than the amount of supervision prescribed in the Post Exhibit. Please see SOW 12.2.1.1.

1. How many supervisors are allocated and how many hours are allocated per location?

Answer: The Government does not require a specific number of supervisors - that is at the discretion of the vendor. Refer to the post exhibit for the estimated minimum supervisory hours per location. Task orders will be issued for the actual known service requirements based on the post requirements at that time. The Contractor shall maintain no less than the amount of supervision prescribed in the Post Exhibit. Please see SOW 12.2.1.1.

1. RFP SOW Attachment 1, Section 14.3 Vehicles, page 80. 14.3.1 The Contractor shall obtain applicable permits, titles, inspections, and registrations in accordance with applicable Federal, state, and local laws for the operation of vehicles; 14.3.2 All costs for the operation and maintenance of vehicles, including license and insurance fees, shall be borne by the Contractor. Question: Please describe the types and number of vehicles and associated equipment required to provide mobile roving patrols?

Answer: There are no contractually required vehicles for any of the patrol and response posts. These are all foot patrols. Refer to SOW Exhibit 10 Contractor Provided Equipment, 5. Contractor Provided Equipment, Contractor Vehicle Requirement.

1. Attachment 10 - Seniority List (VA3045, VA0040, VA1413, VA0430, VA0919) - There are no employees listed for VA0919; is this location currently in service?

Answer: Please see Paragraph B of this Amendment and the revised Attachment 10 - Seniority List (VA3045, VA0040, VA1413, VA0430, VA0919), attached and posted as part of this amendment.

1. Attachment 10 - Seniority List (VA3045, VA0040, VA1413, VA0430, VA0919) – The oldest seniority date is 04/01/2017 for any employee on this list; we believe this is the hire date on contract and not the actual SCA seniority date. Will FPS please clarify with the incumbent Contractor and provide a corrected list that reflects the SCA seniority date?

Answer: Please see Paragraph B of this Amendment and the revised Attachment 10 - Seniority List (VA3045, VA0040, VA1413, VA0430, VA0919), attached and posted as part of this amendment.

1. SOW 4.4 Licenses - Would the Government confirm that Armed PSOs and Supervisors are also required to obtain a Virginia Department of Criminal Justice (DCJS) license?

Answer: Confirmed. Both PSOs and supervisors cannot work on a DHS contract without the proper license for an Armed Security Officer. Both Armed PSOs and Supervisors are required to obtain a Virginia Dept. of Criminal Justice license.

1. Clauses, Addendum to FAR 52.212-4 Contract Terms and Conditions— Commercial Products and Commercial Services, .04 Prices, C. SCA Base Year Wage Adjustments and Solicitation Provisions, Price Realism Evaluation - VA0818 is covered by local WD 2015-4281 R1. Offerors familiar with the market conditions in the National Capital Region understand the Guard II wage rate of $20.57 is insufficient compensation to attract and retain qualified PSOs. The market conditions are further exacerbated by the demand for security personnel causing personnel shortages – Will FPS conduct a price realism analysis to assess the bidder’s understanding of the solicitation requirements and for assessing the performance risk inherent in the contractor’s price if the below-market wage rate of $20.57 is proposed?

Answer: The Guard II wage rate is the minimum wage rate required by the Department of Labor (DoL). It is the offerors’ responsibility to understand the market conditions in the DC metropolitan area and ensure that they can recruit and retain qualified personnel for this effort at their proposed rates. As indicated in the solicitation (pages 9-10 of the solicitation provisions), FPS may conduct a price realism analysis for the purpose of measuring the Contractor’s understanding of the solicitation requirements and for assessing the performance risk inherent in the Contractor’s price. Please see Paragraph C of this Amendment and the attached WD 2015-4281, R23 covering VA0818. The DoL rate has increased to $21.69.

1. Clauses, Addendum to FAR 52.212-4 Contract Terms and Conditions— Commercial Products and Commercial Services, .04 Prices, C. SCA Base Year Wage Adjustments And Solicitation Provisions - A number of the CBAs have wage/H&W/pension rates that increase at some point during the anticipated base period, 10/1/2022 – 9/30/2023. For example, the CBA covering VA4035 has new rates effective on 3/31/2023. - Assuming NO updated CBA would be incorporated after the date of proposal submittal: Will FPS please confirm that bidder’s should calculate weighted average/blended rates to account for the mid-year rates changes, as there is no mechanism for the awardee to seek an adjustment in the base year?

Answer: The offeror should calculate a blended rate for the hourly rate.

1. Solicitation Provisions, Price Proposal, and Attachment 6 Price Element Breakdown Templates - Is it permissible for bidders to combine the (2) files into (1)….. as long as the Supervisory Model for Price Realism & FTE tabs are kept as separate worksheet tabs from the PSO tabs? We ask because both MPR worksheets would share similar back up cost information (Post exhibit hours, ODCs, overhead costs, etc.)

Answer: The Government recommends 2 attachment 6 Price Element Breakdowns – one for basic PSO services and one for supervisory PSO services; however, there is no prohibition on a contractor combining the 2 files.

1. Can FPS verify if there are any Supervisor CBAs in place for any of these contracts and provide any Supervisor CBA's in place?

Answer: There are no known Supervisor CBAs in place for any of the contracts.

1. Site VA0818 has not commenced services yet as per the seniority list. Can FPS confirm this statement and provide more detail on this new site?

Answer: VA0818 has not yet commenced services. Refer to the post exhibit for details concerning the site.

1. Is a separate Excel Pricing Schedule required in addition to the SF1449? If yes, will the government provide?

Answer: Please refer to Pages 8-10 of the Solicitation Provisions. Under the Price Proposal paragraph: “Using the Pricing Schedule, the Contractor must submit unit prices and extended prices (i.e. Unit Price x Estimated Quantity) for every line item listed under each ordering period (not including the 6 month option available under FAR 52.217-8)”. In addition, the Contractor shall also provide a detailed breakdown of its proposed unit prices for each contract line item. The Government recommends the use of the Price Element Breakdown PSO and Price Element Breakdown Supervisory which are included as part of this RFP.

1. Who is the incumbent contractor(s) currently providing PSO Services?

Answer: The incumbent contractors are KR Contracting, Inc. and Golden SVCS, LLC.

1. What is the current weapons platform used by the incumbent PSOs at each building?

Answer: The incumbent (KR) PSO’s carry Glock 17 9mm handguns at: VA3045, VA0040, VA1413, VA0430, and VA0919. The incumbent (Golden) PSO’s carry Glock 17 9mm handguns at: VA0506, VA0883, VA0816, and VA0812. Services have not started at VA0818.

1. Are shotguns required at any facilities?

Answer: No.

1. Are current contractor employees fully qualified in terms of training completion?

Answer: No. In order to stand post under this follow-on effort (unless the awardee acquires the incumbent firearms), PSOs would need to qualify with their duty weapon (by serial number). SOW Section 5.2.2.1 indicates that Incumbent PSOs shall undergo a medical and physical examination every five (5) years to continue working on any FPS PSO contract. The NWDTP training is post specific so not all PSOs require this training. Please refer to the Attachment 11s, PSO Master Certification matrixes for the PSOs current training and expiration dates. All incumbent PSOs must be fully qualified/certified in order to stand post under this follow-on effort.

1. Are the current PSOs and Supervisors trained to the NWDTP standards in the solicitation?

Answer: The current contracts have the same NWDTP training. Not all PSOs require this training, only PSOs that work at screening stations or supervisory PSOs who have oversight of these screening posts. Also, please note that SOW Section 6.7.2.1.5 requires PSOs to have OJT every 60 days, or their training is voided. The contractor is required to meet the training requirements specified within the contract.

1. Is the level of effort reflected on the Post Exhibit the same level of effort that is currently being performed by the incumbent guard force?

Answer: VA0818 has not yet commenced services. The other sites have not changed in relation to the level of effort required; however, this is an indefinite delivery, indefinite quantity type contract and task orders will be issued for the actual known service requirements based on the post requirements at that time.

1. Does the incumbent guard force require all new medical certifications?

Answer: SOW Section 5.2.2.1 indicates that Incumbent PSOs shall undergo a medical and physical examination every five (5) years to continue working on any FPS PSO contract.

1. Do all incumbent PSOs require a fresh drug screen during transition?

Answer: SOW Section 5.2.4.1 indicates that New Hire PSOs shall submit to a urine drug screening as part of initial pre-employment and medical examination. Incumbent and New Hire PSOs may undergo random and Government – requested urine drug screenings throughout the contract period.

1. Is there an NWDTP certified Instructor on the contract?

Answer: Yes. There are certified NWDTP Training Instructors on the current contracts.

1. Are Supervisors included in the Seniority list? The total count is similar to Master Certification which includes Supervisor Training dates. If included, would the government provide revised seniority lists separated by PSOs and Supervisors?

Answer: No. Supervisors are not included on the seniority lists and the Government does not have this information. Please note that Supervisors are not covered under the Service Labor Standards (see Pages 10-11 of the Contract Clauses).

1. Is the current contract fully staffed?

Answer: See answer to Question #4.

1. Is the Post Tracking System (PTS) currently in use at all buildings? If not, when does the Government anticipate the new Post Tracking System (PTS) will become active on this contract?

Answer: No. PTS is a new requirement. The Government is aware of some logistical challenges associated with the procurement of these devices and will work with the awardee regarding the implementation of PTS.

1. Columns AA and AB on the post exhibit shows the number of tablets per post. Would the government review and confirm the numbers? Since each row is one post, the number of Shared tablets seems excessive.

Answer: The Government confirms that a total of 12 tablets are required, as stated in the post exhibit.

1. Attachment 10 is missing the seniority list for VA0919

Answer: Please see Paragraph B of this Amendment and the revised Attachment 10 - Seniority List (VA3045, VA0040, VA1413, VA0430, VA0919), attached and posted as part of this amendment.

1. Attachment 10 notes that VA0818 has not commenced service as of 2/15/22. Will this location be staffed prior to this contract start date?

Answer: VA0818 has not yet commenced services. Refer to the post exhibit for details concerning the site.

1. Would the government provide Agency information for each building?

Answer: The agency information will not be released to potential offerors.

1. Is Annual IRS Security Awareness Training required for any buildings?

Answer: No, although it would be required if an IRS building, or posts were added to this contract. IRS is not an agency currently at the sites included under this solicitation.

1. Does Exhibit 15 Apply to any buildings on this contract?

Answer: No, although it would be required if an FBI building, or posts were added to this contract. FBI is not an agency currently at the sites included under this solicitation.
