Statement of Work (SOW) Road Shoulder Reconstruction and Stabilization

Emergency Response (ER) Range 3 – West Campus FLETC Artesia Training Delivery Point

I. Purpose

• The purpose of this requirement is to reconstruct, stabilize, and regrade a failed roadway shoulder located at Emergency Response (ER) Range 3 on the West Campus of the FLETC Artesia Training Delivery Point.

• Existing conditions have resulted in progressive erosion, rutting, subgrade instability, and water retention along the roadway edge.

• These conditions present a vehicle safety hazard, restrict operational access, and will continue to degrade if not properly reconstructed.

• This work is intended to permanently correct the failure condition by restoring proper grade, compaction, and drainage characteristics consistent with continuous training and operational vehicle traffic.

II. Scope of Work

• The contractor shall provide all labor, materials, equipment, supervision, transportation, tools, and incidentals necessary to fully reconstruct approximately 300 linear feet of roadway shoulder.

• Work includes excavation of failed material, subgrade preparation, installation of mechanically compacted aggregate, precision grading, and establishment of positive drainage control.

• The intent is to construct a stable, compacted, load-bearing shoulder section designed to prevent recurrence of erosion, rutting, and water retention.

• All work shall be performed in accordance with:

o OSHA safety standards o Environmental protection best practices o FLETC security and access requirements o Industry standards for roadway shoulder construction, compaction, and drainage control

Work Shall begin on or before 12 February and all work shall be complete within no more than two (2) days.

III. Location of Work

• Emergency Response (ER) Range 3

• West Campus

• FLETC Artesia Training Delivery Point

• The Government Representative will identify and mark the limits of disturbance prior to start of work.

IV. Required Finished Dimensions (Post Compaction)

• Length: 300 linear feet

• Width: 8 feet

• Compacted aggregate thickness: 6 inches minimum across entire width

• Total area: approximately 2,400 square feet

• The finished shoulder shall tie seamlessly into the existing roadway surface and surrounding grade.

V. Subgrade Preparation Requirements

• Remove all loose, eroded, saturated, or unstable material.

• Scarify the exposed subgrade.

• Regrade and proof the subgrade to a firm, stable condition.

• Notify the Government if unstable soils are encountered that require additional correction.

• No aggregate shall be placed until the subgrade is stable and approved by the

Government Representative.

VI. Materials

• Crushed-run granite or Government-approved equal.

• Well-graded aggregate suitable for mechanical compaction and repeated vehicle loading.

• Material shall be free of organic matter, debris, excessive fines, or contamination.

Estimated quantities for planning:

• Approximately 60 cubic yards

• Approximately 80 tons

• Approximately 5–6 truckloads

• The contractor is responsible for providing sufficient material to meet required dimensions and performance outcomes.

VII. Aggregate Placement and Compaction

• Aggregate shall be placed in controlled lifts not to exceed 3 inches per lift (loose depth).

• Each lift shall be mechanically compacted using appropriate compaction equipment before the next lift is placed.

• Compaction shall be sufficient to prevent rutting, displacement, or deformation under vehicle loading.

VIII. Grading and Drainage Construction

• Establish positive grade away from the roadway.

• Construct a crowned or swale profile as required by site conditions.

• Ensure water is directed down the shoulder and away from the road surface.

• Tie into existing drainage patterns without causing additional erosion.

• Eliminate conditions that allow standing or pooled water.

Drainage performance is a primary acceptance factor.

IX. Transition and Tie-In

• Provide a smooth, drivable transition to the existing roadway.

• Avoid abrupt elevation changes.

• Blend the repaired shoulder into the surrounding terrain and grade.

X. Schedule and Work Hours

• Work shall occur during non-training hours.

• Work shall be performed on a weekend.

• Estimated duration: two working days.

• Work is weather dependent.

• Work Shall begin on or before 12 February and all work shall be complete within no more than two (2) days.

• Contractor shall coordinate schedule, staging, and access with the Government

Representative.

XI. Site Control, Cleanup, and Restoration

• Maintain a clean and organized work site.

• Remove and dispose of unsuitable material offsite.

• Remove debris and excess material upon completion.

• Restore disturbed areas outside the shoulder footprint.

XII. Inspection and Acceptance Criteria The Government will inspect for:

• Compliance with specified dimensions.

• Proper lift placement and compaction.

• Proper grading and drainage characteristics.

• Surface stability under vehicle traffic.

• Professional finish and site restoration.

• Acceptance will be based on performance of the finished shoulder section, not simply material placement.

XIII. Security and Access Requirements

• All contractor personnel shall comply with FLETC badging, escort, and access procedures for the West Campus.

• Arrival times, equipment staging, and work hours shall be coordinated with the Government Representative.

XIV. Safety Requirements

• The contractor shall maintain a safe work environment at all times.

• All OSHA regulations and site-specific safety requirements shall be followed.

(2) A binding contract is formed when the supplier accepts the Government’s offer, either by written acceptance of the purchase order or substantial performance of the purchase order. The contracting officer may request that the contractor provide written acceptance of the order.

The Government reserves right to cancel this solicitation, either before or after the closing date. In the event the Government cancels this solicitation, the Government has no obligation to reimburse an offeror for any costs.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(b) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the Government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post acceptance rights-

(1) Within a reasonable time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(c) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C. 3727). However, when a third party makes payment (e.g., use of the Governmentwide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract.

(d) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties.

(e) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. The Contractor shall proceed diligently with performance of this contract, pending final resolution of any dispute arising under the contract.

(f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence. Examples of occurrences include acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. When an excusable delay occurs, the Contractor shall-

The Contractor shall indemnify the Government and its officers, employees, and agents against liability, including costs, for actual or alleged direct or contributory infringement of, or inducement to infringe, any United States or foreign patent, trademark, or copyright, arising out of the performance of this contract, provided the Contractor is reasonably notified of such claims and proceedings.

(4) Overpayments. If the Contractor becomes aware of a duplicate contract financing or invoice payment or that the Government has otherwise overpaid on a contract financing or invoice payment, the Contractor shall-

(C) The Contractor requests a deferment of collection on a debt previously demanded by the Contracting Officer (see FAR part 32).

(iv) If a demand for payment was previously issued for the debt, the demand for payment included in the final decision shall identify the same due date as the original demand for payment.

(A) The date fixed under this contract.

(B) The date of the first written demand for payment, including any demand for payment resulting from a termination for cause.

(l) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges the Contractor can demonstrate to the satisfaction of the Government using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.

(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. The Government will send a cure notice to the Contractor, unless the reason for the termination is late delivery. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.

(o) Warranty. The Contractor warrants and implies that the items delivered under this contract are merchantable and fit for use for the particular purpose described in this contract.
