About this file

This document is a Contracting Officer's Determination that Circumstances of the Contract Action justify soliciting from a single source for lawn care equipment under simplified acquisition procedures. FLETC has a requirement to procure equipment for in-house ground maintenance due to a break in service, and determined that Sapelo Equipment Co., LLC is the only reasonably available source that can provide the brand-name equipment needed to maintain uniformity with the current inventory. The government determined that competition would not result in additional savings or interested parties, and that soliciting from a single source under FAR 13.106-1(b) is in the best interest of the government. FLETC subsequently awarded a firm-fixed-price contract to Sapelo Equipment Co., LLC for $140,875 on July 11, 2024.

MEMORANDUM FOR: File

FROM:

Contracting Officer

SUBJECT: Contracting Officer’s Determination that Circumstances of the

Contract Action to Solicit from a Single Source for Lawn Care Equipment

Reference: FAR 13.106-1(b), Soliciting from a single source

In accordance with 41 U.S.C. § 3305(d) and FAR § 13.104 when utilizing simplified acquisition procedures, contracting officers must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the government.

Federal Acquisition Regulations (FAR) Part 13, Simplified acquisition procedures (SAP) are designed to promote efficiency and economy in contracting, and to avoid unnecessary burdens for agencies and contractors where, as here, the value of the acquisition is under the value of the

SAT.

FAR13.106-1(b) states: “Soliciting from a single source (1) For purchases not exceeding the simplified acquisition threshold (SAT). (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name, or industrial mobilization).

1. In accordance to Far 13.106-1(b), a contracting officer can determine the circumstances of the contract action indicate an exception to general competition requirement is acceptable, and necessary to avoid burdens when one source is reasonably available for services when the government requires an expedited start of performance due to a break in service for a requirement.

FLETC has a requirement to procure equipment to support in house ground maintenance for the entire FLETC campus. FLETC is currently without a service contract to help support the mission.

The government requires the equipment as Brand Name/Model only in order to maintain uniformity

CO Determination of services, repairs, training, and operations to the current inventory equipment on hand. Limiting brand names on-site promotes efficiency for in house repairs or part orders. In addition, the required delivery is expedited due to urgent need to attend to areas that are out of standard throughout FLETC. The current inventory cannot support the increase of workload.

1. The POC has performed market research within the local area for factory authorized dealers that could perform any warranty work locally to determine availability of the items for delivery.

2. GSA was used to determine availability, however, not all items were found on GSA Advantage, or one vendor could not supply all the items when the resource were reviewed.

3. Due to the need to start performance now, the government does not have an expectation that competing this acquisition would create any additional savings or interested parties.

4. The following company was the only vendor reasonably available to provide all requested items.

Sapelo Equipment Co, LLC

110 Peek Road

Brunswick, Georgia 31525

Phone: 912-264-6066 www.sapeloequipmentco.co m

5. Sapelo is currently registered in SAM.gov and is reasonably available to make a direct award. Fair and Reasonable pricing will be based on the current fair market pricing found for similar training published on available internet resources or from other companies that were able to provide pricing during our sources sought/market research.

6. Sapelo has equipment on had to mobilize immediately to service FLETC.

Based on the information above, and to promote efficiency and economy, it has been determined by the contracting officer to solicit to a single source, Sapelo Equipment, FAR 13.103-1(b) is in the best interest of the Government. Prices are determined to be fair and reasonable based on published prices.
